Conditions for the scientific use of
VEGETATION products

Requests to access VEGETATION products at preferential conditions that are submitted to the VEGETATION Programme can be accepted if:

  1. the proposal fulfills all the criteria listed below. Compliance with these criteria is judged by the VEGETATION Programme Scientist.
  2. the user agrees with the conditions mentioned below. In case the proposal is submitted by a consortium, all of its members should sign this agreement.

Criteria:

  1. The request is made by a 'bona fide' research institution or consortium.
  2. The proposed research contributes significantly to the objectives pursued by the VEGETATION Programme, such as improvement of the system, products or services or advances in thematic issues related to the VEGETATION mission.
  3. The research is carried out in the frame of a project and is well-documented in terms of objectives, principal investigator, co-investigators, work plan, schedule, expected results and deliverables, VEGETATION products and other data requests.
  4. The requested volume of VEGETATION products should be clearly justified and limited in the light of the pursued research goals.
  5. There project should be accepted, funded and endorsed either by a scientific committee awarding research grants, at regional, national or international level (e.g. R & D framework programmes of the European Commission).

Conditions:

  1. The cost of product medium, packing and expedition is borne by the user.
  2. The delivered VEGETATION products and any information processed, reconstructed, derived, enhanced, or reproduced from such products may be used, reproduced, and disclosed only for the purpose of research authorised in the framework of the project described herewith; and will not be used, reproduced, or disclosed for commercial or operational purposes. Accordingly, in the event of the breach or threatened breach of this agreement by the VEGETATION product user, the VEGETATION Programme may exercise all applicable legal remedies, including seeking injunctive relief.
  3. All the results of the project should be made available to the VEGETATION Programme. The proposal should indicate how this will be done. If the reports or publications are copyrighted, the VEGETATION Programme will have a royalty-free right under the copyright to reproduce, distribute, and use the copyrighted works "for its internal needs".
  4. If requested, the user will also provide the VEGETATION programme with a short progress report.
  5. The publication or use of any other kind of the research results of the VEGETATION product set should properly acknowledge the VEGETATION Programme in the following terms: “VEGETATION Images were provided by the VEGETATION Programme”.
  6. The operational exploitation of the algorithms and processing techniques developed in the framework of the project falls under the sole authority of the VEGETATION Programme.
  7. Commercial uses prohibited under this agreement involve the sale or resale of the VEGETATION products and all VEGETATION-derived products.
  8. Nothing in this agreement shall be construed as granting or implying any rights to, or interest in, patents or inventions of the Parties, or their contractors, subcontractors, or co-investigators (as appropriate).
  9. This agreement covers all the products that are part of the delivered VEGETATION product set.
  10. By signing this agreement, the user agrees with all the terms listed above.
