LIMITED WARRANTY FOR POLYETHYLENE TANKS
1. Warranty Explanation and Length:
Your Polyethylene Tank purchase from Poly-Mart, Inc. is warranted to be free from defects in workmanship and in materials under normal use. All Poly-Mart tanks that are found to be defective in material and/or workmanship will be repaired or replaced under our Repair & Replacement Procedure described below in Section 2. Poly-Mart Tanks carry a 5-year warranty from the date of manufacture.
2. Repair & Replacement Procedure:
If your Poly-Mart, Inc. tank develops a defect during the period in which it is warranted, please notify our Customer Service Department at 512-402-6644. Please contact us as soon as a defect occurs as Poly-Mart cannot be responsible for any repair or replacement after the warranty period. After your timely notice and adequate proof of manufacturers defect, Poly-Mart, Inc. will have a choice of the following options:
a.) Poly-Mart may ship a new product to its closest Distributor to be exchanged free of charge for the defective product returned by you.
b.) Poly-Mart may require you at your expense to deliver or ship the product to its factory or Authorized Distributor. The defective product will be repaired or replaced, then returned to you or our distributor free of charge. Any tank returned to Poly-Mart, Inc. and found not to be defective will be returned to you freight collect with explanation.
c.) Poly-Mart may ship a new tank to your address and take the defective tank.
d.) Poly-Mart, Inc. may refund the tank’s value based off of a pro-rated life span upon return of the product to Poly-Mart, Inc. or an Authorized Distributor.
e.) Poly-Mart, Inc. may choose to compensate purchaser in another reasonable procedure.
3. Warranty Coverage Information:
In order to receive coverage under this warranty, a copy of the original invoice showing the distributor name, date of purchase and location of purchase is required in proceeding with a claim. Poly-Mart, Inc. is liable for the value of the tank itself and specifically excludes the cost of labor for installation and/or removal of personal property. Poly-Mart is not liable for consequential damages such as but not limited to personal/property damages, loss of time, loss of revenues/earnings, transportation costs, travel time, postage, road service charges or any other losses. The warranty does not cover any tank that has been altered or modified so as to affect the tank’s use, durability or performance or that has been modified to change the intended use of the tank. Additionally, the warranty does not extend to repairs made necessary by abnormal use, damage, unreasonable use including failure to provide needed maintenance. Poly-Mart, Inc. has no liability whatsoever if any tank has been misassembled or subject to neglect, negligence, misuse, accident, incorrect installation, flood, landslide, natural disaster or if the tank is used in any way contrary to the intended use.
4. Poly-Mart Exclusive Warranty:
This is the only warranty made for Poly-Mart Tanks. No Poly-Mart employee, Distributor, or other party is allowed to change or alter this warranty. There is no extended warranty coverage available. Poly-Mart does not assume responsibility or liability not covered by this warranty.
