Interim Study Committee on Public Policy - E-Cigarettes, Smoking Bans
Summary:Information from the October 6 meeting was recently released. During the meeting the committee presented the following information:
1. The Smoking Ban:Several small business owners testified to the potential negative effects banning cigarettes in bars would have on their businesses. There was also a presentation for the Indiana Legislative Services Agency regarding the impact of casino/racino smoking ban on gaming revenues. American for non-smokers rights testified that the legislature should level the playing field in smoking ban laws.
2. E-cigarettes: The Indiana Legislative Service Agency presented a memorandum concerning taxation of E-cigarettes. Several different trade associations and business owners discussed the health and science research regarding E-cigarettes. The American Cancer Society provided a handout to the committee regarding E-cigarettes.
3. Cigarette tax, funding of programs, and the impact on public health: Again the Indiana Legislative Service Agency presented a memorandum concerning the impact of cigarette taxes on consumption. Several different organizations presented information to the committee regarding the public health benefits of increasing the tobacco tax.

S.B. 2877 - E-Cigarettes, OTP Stamping, Self-Service Display, Tobacco (Labeling/Packaging)

Summary:Introduced version: Provides that no person, either directly or indirectly by an agent or employee, or by a vending machine owned by the person or located in the person's establishment, shall sell, offer for sale, give, furnish, or distribute for commercial purpose at no cost or minimal cost or with coupons or rebate offers, liquid nicotine to any person unless the liquid nicotine is sold, offered for sale, given, furnished, or distributed for commercial purpose in a child-resistant container.
Defines child-resistant container as a container which is designed and constructed in a manner so that it is significantly difficult for a child five years of age or younger to open the package or otherwise risk exposure to liquid nicotine.
Defines liquid nicotine as any solution containing nicotine which is designed or sold for use with an electronic smoking device.

Tobacco Settlement Revenue Oversight Committee on Tobacco Use in American Indian Communities. - Smoking Bans
Summary:The New Mexico Tobacco Settlement Revenue Oversight Committee met October 21 to discuss Tobacco use in American Indian Communities. Kevin English, Director of theAlbuquerque Area Southwest Tribal Epidemiology Center testified that "...currently 71% of American Indian high school students are not exposed to second hand...but approximately 1 out 3 uses marijuana".

Summary:Current version (6/22/2015): Adds electronic cigarettes in the definition of tobacco products for the purposes of prohibiting the sale of electronic cigarettes to minors.
Defines "tobacco products" as a) any product containing, made or derived from tobaccoor nicotine that is intended for human consumption, whethersmoked, heated, chewed, absorbed, dissolved, inhaled,snorted, sniffed or ingested by any other means, including,but not limited to, a cigarette, a cigar, a little cigar,chewing tobacco, pipe tobacco, snuff and snus; or b) any electronic device that delivers nicotine orother substance to the person inhaling from the device,including, but not limited to, an electronic cigarette, acigar, pipe and hookah. Includes any component, part or accessory of suchproduct or electronic device, whether or not sold separately. Excludesproducts that have been approved bythe United States Food and Drug Administration for sale as atobacco cessation product or for other therapeutic purposeswhere the product is marketed and sold solely for such approvedpurpose.
