Re: Your request to use

NIBCO agrees that you may use . You agree that in using said name and logo, you receive no right to use the NIBCO Logo other than what is given here. Upon NIBCO’s request, you agree that you shall immediately cease and desist from any further use of the logo/graphic(s). The right to use said name and logo extends and applies to use in only. Use of said name, logo and or art outside this area is strictly prohibited. Contact NIBCO's International Customer Service Coordinator at (574) 295-3487 for inquiries outside the United States.

Further you agree that:

  1. Where the advertising and promotional material has not been provided by NIBCO, you shall obtain prior written approval from NIBCO for any advertising copy, promotional material, or other written or printed material used by you in promoting sales of NIBCO product, which NIBCO may withhold for any or no reason.
  2. You will not directly or indirectly license or attempt to license, whether orally or in writing, any other person or firm to use any NIBCO Licensed Trademark.
  3. You confirm and acknowledge that the Licensed Trademarks are the sole and exclusive property of NIBCO. If necessary, you agree to enter into any “Registered User” agreements and to perform any other acts necessary to vest and protect NIBCO Licensed Trademarks on behalf of NIBCO.
  4. You agree to immediately notify NIBCO of any adverse uses in the Licensed Trademarks, which come to your attention. Further, the obligation to maintain the Licensed Rights shall be the obligation of NIBCO. Such obligation shall be limited solely to the payment of fees for application, registration, declaration, and renewal of the Licensed Trademarks.
  5. Nothing in this agreement should be construed as creating any relationship other than Manufacturer and Customer. Your use of NIBCO Trademarks does not entitle you to bind or commit NIBCO to any contractual agreement, whether orally or in writing. Further, NIBCO may choose, at its sole discretion, to terminate any relationship existing between the parties for any reason or for no reason.
  6. You agree not to file or otherwise attempt to obtain registration of the name/mark of NIBCO or any other mark of NIBCO.
  7. You agree to use the symbol ® or other appropriate symbol adjacent to the NIBCO Logo, or any other mark as instructed by NIBCO.
  8. You agree to use the NIBCO Logo and any other marks of NIBCO only in association with NIBCO products.
  9. You confirm and acknowledge that if you translate any of the NIBCO materials provided for your use, that NIBCO is only bound by the representations in the original English in any such materials. If necessary, you agree that you will indemnify and hold NIBCO harmless for any dispute of any nature (including reasonable attorneys' fees) that may arise against NIBCO that in NIBCO’s sole determination is based on an inaccuracy in any such translation.
