Asyouwerepreviouslyinformed,yourstudentisrequiredtocomplywiththeimmunizationrequirementsofHealthandSafetyCode Section120335(b).OurrecordsindicatethatyouhavenotprovidedinformationshowingthatyourstudenthasmettheimmunizationrequirementsinSection120335(b).Pleasecontactus if thisisinerror.However,ourrecordsalsoindicatethatyourstudent is a studententitledtospecial educationandrelatedservicesundertheIndividualswithDisabilitiesEducationAct.Section120335(h)oftheHealthand SafetyCodeandtheCaliforniaDepartmentofPublicHealthhaveindicatedthatspecialeducationstudentsshouldcontinuetoreceiveallnecessaryservicesidentifiedintheirIEPregardlessofvaccinationstatus.Accordingly, eDistrictwillpermityourstudenttocontinuetoattendschooldespitenotbeingincompliancewiththeimmunization law.
However,the lawrequiresparentsandguardianstocontinuetoprovide immunizationrecordsforspecialeducationstudentstotheirschools,andschoolsarerequiredtomaintainandreportrecordsofimmunizationsthathavebeenreceivedforspecialeducation students.SpecialstudentsarenotexemptfromtheimmunizationrequirementsofSection120335(b).

Furthermore,becauseyourstudenthasnotbeenfullyimmunizedinaccordancewiththelaw,heorshe may beunilaterallyexcludedfromschoolifwebelievethatheorshehasbeenexposedtooneofthe followingdiseases:(1)Diphtheria;(2)Haemophilusinfluenzatypeb;(3)Measles;(4)Mumps;(5)Pertussis(whoopingcough);(6)Poliomyelitis; (7)Rubella;(8)Tetanus;(9) HepatitisB;(10)Varicella(chickenpox);and(11)AnyotherdiseasedeemedappropriatebytheDepartmentofHealthandHuman Services. Ifsuchaneventweretooccur,yourstudentwouldnotbe permittedtoreturntoschool untilthelocalhealthofficerdeterminedthatthestudentwasnolongerat risk for transmittingthedisease. Inaddition,thelocalhealthofficermayorderthatyourstudent beexcludedforaperiodoftimeifthereisalocaloutbreak of acontagiousdisease.

PursuanttoSenateBill277,allstudentsenteringkindergarten(includingtransitionalkindergarten)intheDistrictoradvancingfromsixthtoseventhgradeintheDistrictarerequiredtocomply withtheimmunizationrequirements ofHealthandSafetyCodeSection120335(b).
Additionally,allstudentsnewlyenrollingintheDistrictwithoutacopyofapersonal-belief
exemptiononfilewithanotherschoolinCaliforniaprior toDecember31,2015,arerequiredto comply with theimmunizationrequirementsofSection120335(b).Theonlyexemption tothisrequirementisifthestudentprovidestheDistrictwithavalid exemptionfromalicensedphysician.
Ourrecordsindicatethatyouhavenotprovidedinformationshowingthatyourstudenthasmettheimmunizationrequirementsin Section120335(b).Pleasecontactusifthisisinerror.
However,our recordsalsoindicatethatyourstudentisastudententitledtospecialeducationandrelatedservice underthe Individuals with DisabilitiesEducationAct.Section120335(h)oftheHealthandSafetyCodeandtheCaliforniaDepartmentofPublicHealthhaveindicatedthatspecialeducationstudentsshouldcontinuetoreceiveallnecessaryservicesidentifiedintheir
IEPregardless of vaccinationstatus.Accordingly,theDistrictwillpermityourstudenttocontinuetoattendschooldespitenotbeing incompliancewiththeimmunizationlaw.
However,the lawrequiresparentsandguardianstocontinuetoprovideimmunizationrecordsforspecialeducation studentstotheir schools,andschoolsarerequiredtomaintainandreport recordsofimmunizationsthathavebeenreceivedforspecialeducationstudents.Special
educationstudentsarenotexemptfromtheimmunizationrequirementsofSection120335(b).
Furthermore,becauseyour studenthasnotbeenfullyimmunizedinaccordance withthelaw,heorshemaybe unilaterallyexcludedfromschoolifwebelievethatheorshehasbeenexposedtooneofthe followingdiseases:(1)Diphtheria;(2)Haemophilusinfluenzatypeb;(3)Measles;
