You may know that Indiana Legal Services, Inc, through its Immigrants’ and Language Rights Center, handles a wide range of immigration cases, but did you know that we also handle cases related to immigrants’ rights and language access issues?Immigrants and Limited-English Proficient Hoosiers are entitled to certain governmental benefits, and the government agencies who provide those benefits and services do not always comply with federal law. We help advocate on behalf of immigrant and LEP clients in these areas.

Here are some examples of cases we have recently worked on:

  1. A United States citizen with two US citizen children and an undocumented spouse was wrongfully denied housing assistance because her spouse is undocumented;
  2. A client with a U Visa needed assistance applying for housing assistance for her US citizen child;
  3. A lawful permanent resident was denied food stamps, even though she was eligible. She was incorrectly told she had to wait ten years to apply;
  4. A lawful permanent resident was wrongfully denied social security disability because he was in removal proceedings;
  5. A lawful permanent resident who needed to apply for citizenship to keep her SSI;
  6. LEP individuals were denied or terminated from Medicaid because of a failure to cooperate, which really meant an inability to communicate with their caseworker to comply;
  7. An LEP who was denied the opportunity to take a professional licensing exam because of an inability to speak English (when English was not a qualification);
  8. LEP parents who were unable to access services from a state-funded program because of their inability to speak English.

Many immigrants, non-English speakers, and, even, social service advocates, do not realize that federal law requires agencies and other recipients of federal funds to ensure access to services for limited English proficient individuals. If you know of someone who has been denied benefits or services because of their immigration status or their inability to speak English, they can apply for our free services by calling 866-964-2138. I’ve attached a flyer. Please let me know if you have any questions!
