STICK BUILT MODULAR UNITS
BY ADVERTISEMENT FOR SEALED BIDS

UNDER AND BY VIRTUE of a Resolution of the Board of Education of Duplin County and under authority of Sections 115C-518(a) and 160A-266(a)(2) of the General Statutes of North Carolina, the undersigned will offer for sale for by advertisement for sealed bids the following described personal property owned by the Board of Education of Duplin County as follows:

The terms and conditions of sale by sealed bid set by the Duplin County Board of Education are as follows:
1. PUBLIC NOTICE: The Notice for sealed bids shall be posted and advertised as by law so provided.
2. TERMS OF SALE: The manufactured and stick built modular units hereinabove identified are being offered by the Duplin County Board of Education for sale by the written submission of sealed bids to the Duplin County Board of Education and must be received no later than Wednesday, May 31, 2017, by 4:00 o'clock p.m. No extension of time will be granted. Bid form #857-5-31 may be obtained from the Duplin County Board of Education Finance Office located at 315 North Main Street, Kenansville, North Carolina. between 9:00 o'clock a.m. and 4:00 o'clock p.m. Bid forms may also be requested by emailing Ashley Sutton at , refer to bid #857-5-31.
3. PAYMENT: Purchaser will be required to pay the balance of the purchase price in full to the Board of Education no later than Tuesday, June 13, 2017, by 12:00 o'clock noon in the form of cashier's or certified funds payable and delivered to the Duplin County Board of Education located at 315 N. Main Street, Kenansville, North Carolina. A default in payment will result in the forfeiture of bid deposit, rejection of bid and Purchaser shall have no further rights in and to the modular unit.
4. BID DEPOSIT: All sealed bids must be submitted with a ten percent (10%) deposit of the sealed bid amount in the form of cashier's or certified funds payable to "Duplin County Board of Education" as evidence of good faith.
5. TITLE TO MODULAR UNITS: The Duplin County Board of Education will issue a Bill of Sale for each modular unit that has been approved for sale. The Duplin County Board of Education does not have DMV Certificates of Title.
6. BIDS/BOARD MEETING: All sealed bids so submitted will be on the Board's agenda and presented for consideration to the Duplin County Board of Education at its regularly scheduled meeting as scheduled for June 6, 2017. Each bid will be approved or rejected at this meeting. All bidders will be notified by an agent of the Duplin County Board of Education on June 7, 2017, as to whether or not their bid was accepted or rejected. The Duplin County Board of Education reserves the right to reject any and all sealed bids so submitted.
7. MODULAR UNIT MOVING COSTS: Each successful bidder shall be required to move his/her modular unit at his/her own cost. Coordination for the moving of modular units should be made with Roger Jones, facility director, at 910-296-1521 or by email at . It is imperative that each unit be moved as soon as possible after June 15, 2017, and no later than July 1, 2017. Time is of the essence in the moving of these units. In the event that the successful bidder fails to remove his/her unit by July 1, 2017, and it becomes necessary for the Board of Education to move the unit to a staging area, then in that event, the successful bidder will incur additional costs.
8. NO WARRANTY: All manufactured and stick built modular units are being sold in their "as is" condition and "where is" condition with "All Faults" and "Without any warranty, written or implied".
9. RISK OF LOSS: Purchaser will assume all risk of loss upon payment of the purchase price in full. Purchaser will be required to pay the balance of the purchase price in full to the Board Attorney within twenty (20) days after confirmation by the Board of Education.
10. VIEWING OF MODULAR UNITS: All modular units will be made available for public viewing and inspection at the following locations on May 26, 2017, from 3:00 o'clock p.m. to 7:00 o'clock p.m. as follows:
