LICENCE AGREEMENT

THIS LICENCE is made on 11 December 2018 between The Warden or Rector and Scholars of the College of Blessed Mary and All Saints Lincoln in the University of Oxford (“the College”) and (“the Licensee”).

In this agreement the following definitions apply:-

“Room” is the Room numbered or such other Room as the College shall direct from time to time the said Room being occupied by the Licensee for his or her single occupation whilst studying at the College.

The “Licence Period” is between the following dates (177days).

08/10/2013 – 07/12/2013 – (Michaelmas Term)

16/01/2014 – 15/03/2014 – (Hilary Term)

24/04/2014 – 22/06/2014 – (Trinity Term)

“Licence Fee” shall be the sum of £3,540.00in respect of the provision of the Room for the Michaelmas Term 2013, Hilary Term 2014 and Trinity Term 2014 by the College to the Licensee to be paid in three instalments at the start of the Michaelmas, Hilary and Trinity Terms respectively; and the additional Kitchen Charge of £504.00 in respect of the Meal Plan payable by three equal instalments at the start of the said Michaelmas, Hilary and Trinity Terms.

“Meal Plan” shall mean the plan agreed between the College and Licensee as described in the Student Handbook.

“Student Handbook” shall mean the Handbook issued by the College from time to time for the benefit of students outlining the College’s rules and regulations a copy of which will be handed to the Licensee.

IT IS AGREED THAT

1.The College permits the Licensee to occupy the Room during the Licence Period in return for payment of the Licence Fee subject to the terms of this agreement.

2.The Licensee will:

  1. Pay the Licence Fee as defined above.
  1. Vacate the Room by 12 noon on the designated day at the end of the Licence Period. The Licensee notes that occupation of the Room during periods other than those specified in this Licence Agreement is subject to the arrangements given in the Student Handbook under “Vacation Residence”.
  1. Occupy the Room for his or her own use and will not assign sublet share or part with possession of the Room and will not have guests to stay in the Room.
  1. Retain the keys to the Room supplied by the College and will not part with possession of the said keys nor arrange for copies to be passed to third parties.
  1. Not damage the Room or any fixtures fittings and decorations and comply with the requirements of the Student Handbook insofar as fixing posters or pictures to walls is concerned.
  1. Keep the furniture, fittings and equipment in the Room in good and clean condition and repair allowing for fair wear and tear and not remove from the Room any furniture fittings or equipment belonging to the College.
  1. Not use electrical appliances in the Room unless the procedure set out in the Student Handbook has been complied with.
  1. Not undertake any cooking activities in the Room apart from boiling a kettle.
  1. Not keep animals in the Room.
  1. Not use candles, joss-sticks or naked flames in the Room or in any of the College premises and observe all fire and safety regulations.
  1. Not smoke in the Room.
  1. Leave the room in a clean and tidy condition at the end of the Licence Period and arrange for all personal property to be removed from the Room.

3.The College shall provide in or to the Room:

a.A bed (but not bed linen).

  1. A desk and chair.
  2. A bookcase / shelving.

d.At least one other chair.

  1. A wardrobe.
  2. A working Ethernet connection and a telephone (but only where the

Licensee has been notified prior to the signing of this Agreement that such a connection and/or telephone has been supplied)

  1. Heat, light, water and other services. The charges for the supply of gas,

electricity and water are included in the Licence Fee.

4.The College may:

a.Enter and inspect the Room or carry out work to the Room after giving the Licensee reasonable notice of its intention to do so apart from cases of emergency.

b.Carry out works to the building in which the Room is situated after giving reasonable notice to the Licensee save in case of emergency.

c.Enter the Room without prior notice for the purpose of inspection, cleaning and carrying out minor maintenance works, and/or emergency repairs.

  1. Require the Licensee to move to any other Room or Rooms at any time at the sole discretion of the College.
  1. a. The College will ensure that the Room and its contents are presented in a state

of cleanliness.

b. The College will endeavour to carry out repairs and maintenance as required promptly once the need for any such repairs or maintenance has been identified and the relevant College officers informed. In cases where the necessary repairs and maintenance cannot be carried out within a reasonable time period the College undertakes to keep the Licensee informed as to the state of affairs and to make alternative arrangements for accommodation at its discretion.

  1. The College will arrange for the College’s property and contents to be insured against loss and/or damage by a fire and all other risks normally covered by a comprehensive policy of insurance. The College will not arrange such insurance to cover the belongings and possessions of the Licensee.
  1. Breaches of the terms of this agreement by the Licensee will be dealt with by the College’s By-law on Discipline and Related Matters, which will be printed in the Student Handbook.
  1. This Agreement may be terminated before the expiry of the Licence Period as follows: -

a.By the College,

  1. If a determination to that effect is made under Paragraph 7 above
  1. If the Licensee is rusticated or sent down by the College, or ordered to leave his/her Room under the College’s By-law on Discipline and Related Matters.
  1. If the Licensee ceases to be a student pursuing a course of study provided by the College.

To terminate the Agreement upon the occurrence of any of the said events the College shall give written notice of termination to the Licensee. Unless the said notice indicates otherwise, it will take effect immediately and the Licensee will be required to vacate the Room immediately. The Licensee accepts that the delivery of such a notice to him or her personally or the placing of such a notice in the Licensee’s pigeon hole in the College Lodge will be sufficient notice to oblige the Licensee to vacate forthwith.

  1. By the Licensee

iBy giving the College at least three months written notice of termination. The said notice is to be delivered to the Bursar or his secretary by hand or left in the Bursar’s pigeon-hole at the College Lodge. The College will use its best endeavours to find another Licensee to occupy the Room but the Licensee will remain liable for the balance of any unpaid Licence fee payable under this agreement (up to a maximum of three months’ Licence Fee) if the College is unable to find a replacement Licensee. The College will at its discretion issue an appropriate refund to the Licensee of any Licence Fee that he or she has paid covering the period after the expiry of the Licensee’s notice in the following circumstances

a)if the College is able to find a replacement Licensee

b)if the College in its discretion decides that the particular circumstances that have caused the Licensee to seek early termination merit such a refund.
