The terms and conditions herein represent the complete Agreement of the parties, and no terms or conditions in any way adding to, modifying or otherwise changing the provisions stated herein shall be binding.

Buyer understands that Grain Busters, LLC is not a licensed general contractor, but is a seller of a custom product. Buyer understands that this is a custom order and the goods are custom made, cut, processed, altered and designed by Buyer, to Buyer’s specifications. Variations in grain, color, sap and texture could appear randomly, as well as warping may occur due to drastic climate changes.

Barn Door Disclaimer: There’s usually an additional 6” to the width and 3” to the height to provide overlap. There also may be light that shows through the planks due to the wood expanding and contracting. Buyer is aware that Grain Busters, LLC is not responsible to construct support headers to withstand the weight of the barn doors, this will be the responsibilities of the homeowner. Grain Busters, LLC is not liable for warping or twisting of wood due to extreme temperature changes in environment.

Reclaimed/Pallet Wood Disclaimer: When selecting reclaimed wood, there may be holes that go through the wood, nail holes, nails that embedded inside the wood, old sawmill marks, variations of color and other natural deformations due to the wood being old. Also when selecting paint, you might see circles of sap appear through the paint. These are naturally occurring tendencies when dealing with wood and wood products, and are considered acceptable. There is no warranty or guarantee on the wood products utilized for the custom product. Grain Busters, LLC is not liable for any malfunctions as a result of failed hardware or installation.

If Agreement does not include delivery of custom product, Buyer shall pick up product within 2 business days from being notified of it’s completion. Charges for storage after 2 business days shall be billed at a rate of $15 per day. Grain Busters, LLC can withhold the custom order until the storage fees are paid in full.

Installation is not included in this custom purchase order and it is Buyer’s responsibility. Buyer assumes any and all liability surrounding any installation of the custom product.

50% of the cost of the custom purchase is to be paid as a deposit at the time of signing this Agreement. Agreement is considered binding once initial deposit is made. Materials are purchased with the deposit funds and therefore the deposit is non-refundable once materials/supplies are purchased.

There shall be no exchanges or returns. There will be no changes to the existing custom order without written agreement from all parties. If buyer decides to make changes to custom order, they will be subject to additional fees and cost. All quoted completion and delivery dates are estimates only and Grain Busters, LLC is not liable for any delay of order, it’s shipment or receipt of goods.

Grain Busters, LLC shall not be liable for special, punitive, incidental, consequential losses, damages or expenses directly or indirectly arising from the services in the making and the custom product it provides whether such claims are based upon breach of contract, breach of warranty, strict liability and tort, negligence, personal injury, or any other legal theory. Further and in no event shall Grain Busters, LLC be liable for any damages or other amounts for any reason whatsoever in excess of the purchase price of the goods ordered by Buyer. Grain Busters, LLC liability may be further limited as per the terms of the manufacturer’s warranty on the hardware.

This Agreement shall be deemed to have been executed and delivered in Pooler, Georgia. Any disputes shall be resolved through arbitration and shall be binding and an entry of judgement shall be deemed to the prevailing party that may be entered in any court having jurisdiction. Attorney fees and related costs shall be awarded to the prevailing party.

WAIVER OF LIABILITY

This Agreement releases Grain Busters, LLC from liability to injuries that may occur. By signing this Agreement, I agree to hold Grain busters, LLC entirely free from any and all liability, including financial responsibility for injuries incurred regardless of whether injuries are caused by negligence.

I also acknowledge the risks involved in custom furniture building. These include but are not limited to abuse of furniture, wood splinters, color fading and defective hardware. I swear that I am participating voluntarily, and that all risks have been made clear to me.

By signing below, I forfeit all right to bring suit against Grain Busters, LLC for any reason. I will also make every effort to obey safety precautions as listed in writing and as explained to me verbally. I will ask for clarification when needed.
