City Council Workshop

The Hyde Park City Council Workshop began at 6:00 pm and was conducted by Mayor Bob Christensen.

City Officials Present: Mayor Bob Christensen, Council members; Brad Robinson, Mark Hurd,Bret Randall, and Charles Wheeler, and P&Z Commissioner; Mark Lynne.

Workshop to discuss zoning in Hyde Park City

Council memberRandall informed the Council that the purpose of the workshop is to discuss Water and Sewer Capital projects. He informed the Council that there will be no other major sewer projects in the near future other than the new facility in Logan that everyone is already aware of. He discussed the water projects that were highlighted in the water plan that Scott Archibald compiled. The Council discussed the priority of each of the projects.

Citizen Input: No Input

Consider Traffic Calming Option for roads throughout Hyde Park City (Roger Jardine): Police sergeant, Roger Jardine approached the Council and informed them that there has been an increase in traffic since the new high school opened. The North Park Police came up with a plan to position a traffic counting machine at different locations by the high school for a week. The machine will indicate if there really is an issue and if so what the dates and times are. If there is an issue, an officer will patrol that area. A complete report will indicate what has been done. Once an area is identified, he will come back to the City to figure out traffic calming devices. He recommended a combination of enforcement and calming devices. The Council discussed traffic calming options such as roundabouts and speed bumps.

Public Hearing to receive citizen input on Ordinance 2017-09 – an ordinance annexing 9.023 acres pursuant to section 10-2-407, U.A.C. as requested by property owner Bob Fotheringham: The Mayor opened the public hearing. There was no input. The Mayor closed the public hearing.

Consider Ordinance 2017-09 – an ordinance annexing 9.023 acres pursuant to section 10-2-407, U.A.C. as requested by property owner Bob Fotheringham: Council member Robinson requested that the Ordinance include Jeff Purser’s name. Council member Randall made a motion to approve Ordinance 2017-09 with the requested change. Council member Flint seconded the motion. Council members Robinson, Hurd, Randall, Flint and Wheeler voted in favor. The motion carried 5/0.

Consider Ordinance 2017-06 – An Ordinance replacing Ordinance 7.30.020 domestic Pets – Dogs and Cats. –The Council discussed limiting the number of cats. The Council discussed the number of dogs. Council member Flint made a motion to approve Ordinance 2017-06. Council member Robinson suggested that more than 2 dogs becomes a pack. Connor Balls approached the Council and added more input in support of allowing additional dogs. Council member Hurd suggested changes to the kennel permit rather than changing the Ordinance. Council member Randall seconded the motion. Council members Flint and Randall voted in favor. Council members Robinson, Randall, and Wheeler voted in opposition. The motion failed.

Public Hearing to receive citizen input on Ordinance 2017-10 – An Ordinance amending Ordinance 12.110.050 and 12.130.060 Site Development Standards for A-1, RE-20, and R-1 to remove Conditional Use Permit Requirements for Accessory Buildings. The Mayor opened the public hearing. There was no input. The Mayor closed the public hearing.

Consider Ordinance 2017-10 – An Ordinance amending Ordinance 12.110.050 and 12.130.060 Site Development Standards for A-1, RE-20, and R-1 to remove Conditional Use Permit Requirements for Accessory Buildings. Council member Hurd informed the Council that the reason this ordinance is before the Council is becausethe Planning & Zoning Commission is trying to clean up Ordinances that requirea conditional use permit when it is ultimately allowed by the Ordinance. The Council discussed public notices and having some way for the citizens to receive notices. The Council recommended that the Ordinance include the following language in each of the zones under #3 “shall be allowed after review and public notice issued by the Planning & Zoning Commission”. Council member Randall made a motion to approve Ordinance 2017-10 – An Ordinance amending Ordinance 12.110.050 and 12.130.060 Site Development Standards for A-1, RE-20, and R-1 to remove Conditional Use Permit Requirements for Accessory Buildings with the amendments listed above. Council member Flint seconded the motion. Council members Robinson, Hurd, Randall, Flint and Wheeler voted in favor. The motion carried 5/0.

Consider Final Plat for the Highland Cove PUD –Council member Randall made a motion to approve the final plat for the Highland Cove PUD. Council member Flint seconded the motion. Council members Robinson, Hurd, Randall, Flint and Wheeler voted in favor. The motion carried 5/0.

Consider Options for complaints about the Crockett Landscaping Business at 25 south 100 east. The Council discussed a landscaping business owned by Kendall Crockett that is currently operating without a business license. He would not be eligible to run a home based landscaping business out of his parent’s home in Hyde Park City because the business does not fit into parameters of the Hyde Park City Ordinance. The Crockett family is currently requesting a large shed in the middle of a residential area. Many neighbors are concerned about the business and the operations of the business creating a nuisance to the neighbors. The Council discussed that it is two separate issues and the shed will most likely need to be allowed but the business as it has been described,is not an allowed use. The Council requested that Donja send a letter requesting acease & desist until Kendall Crockett gets his business compliant with City Ordinance.

Consider options for possible closure of 50 east: Council member Robinson made a motion to proceed with the steps necessary to close the road on 50 east at the south end. Council member Hurd seconded the motion. Council members Robinson, Hurd, Randall, & Wheeler voted in favor. Council member Flint voted in opposition. The motion carried 4/1.

Parks: Council member Wheeler informed the Council that if the Council decides to purchase the Murray land, there is opportunity to move the shares of water to the center of the park where it will be easier to hook up. The completion of the design will be held off for a few weeks until the appraisal is back.

Business License -Council member Randall informed the Council that Freckle Farms has still not become compliant with Storm Water requirements. The owner has been notified on many occasion and met with LUA and the Council where he was offered time and assistance to help him correct his storm water piping issues. The Council requested that Donja send him a letter from the Council informing him that his business license will not be renewed in January if he does not become compliant.

Council member Hurd informed the Council that the bill giving Hyde Park City 80 acres of BLM land needs to pass the house and senate and then be signed by Trump’s office. There is currently no timeline on when it will happen.

Streets: Council member Robinson informed the Council that the Public Works crew is trying to get paint on road for crosswalks etc.

Administrative: Mayor Christensen informed the Council that he has had some requests to renumber the City. He recommended discussing this further and having a public hearing to see what the citizens think about the addressing. He will talk to the post office.

The Mayor informed the Council that Mark Lynne will continue as Chairman of the Planning and Zoning Commission (P&Z) and Gary Anderson will complete Melinda Lee’s term on P&Z.

Executive Session: Council member Wheeler made a motion to move to an executive session to discuss the purchase of real property. Council member Robinson seconded the motion. Council members Robinson, Hurd, Randall, Flint and Wheeler voted in favor. The motion carried 5/0.
