GuideLINES for PLOT OWNERs for obtaining noc

The following guidelines will help the plot owners to obtain NOC from the Ferns Paradise (FP) No Object Certificate (NOC) committee. These guidelines will also help the plot owners to brief the architects/engineers/contractors about the FP guidelines before the design work commences. These guidelines are prepared based on Bruhat Bangalore Mahanagara palike (BBMP) by-laws, Ferns Builders and Developers (FBD) by-laws and past experience of the Ferns Paradise Plot Owners Association (FPPOA).

  1. Setback and FAR Rules
  1. SET BACK and FAR Rules: The current BBMP Rules are strictly to be complied with for NOC approval. No additional set back, over and above the BBMP requirement, is required though the same is welcome. Access/Exit ramps are provided at actual site location for all the plots as per the FBD layout plan. Owners must use the same access/exit ramp points provided at their plot for both corner and other plots.
  1. Adequate parking space must be included in the plan as parking on the road is not permitted.
  1. Solid compound walls are not permissible, except the rear one (maximum 5ft height).
  1. Entry / Exit ramps should not extend into the road.
  1. Multi dwelling Units or Apartments are not permissible.
  1. Other requirements / rules are included in the NOC application forms.
  1. NOC must be obtained from the NOC committee, before commencement of construction for which the following conditions are to be met:
  1. All dues and fees towards Lay out Maintenance and Club Subscription must have been paid.

b. All NOC forms are to be duly filled and submitted. (FORM I & II).

c. Undertaking to comply with all FPPOA Construction Rules to be signed. (FORM III)

d. Both Sanction Plan and Construction Drawings are to be submitted for issue of NOC. Also, a certificate from the architect on full compliance of BBMP rules may be required for phase 2 plots.

e. All fees / deposits as applicable are to be paid.

Note: Blank NOC forms and Construction Rules can be collected by the plot owners from the FP estate manager.

Other Reasons –

I undertake clearing your site of any construction shed/materials/debris after completion of my house construction. I fully understand that you have the right to object to any activities we perform on your plot and disallow us from using your plot at any point of time.

hOUSE CONSTRUCTION RULES - FORM III

  1. No personal bore-well is permitted in the layout.
  2. Construction workers and vehicles with construction materials are allowed only between 0800 hrs and 1800 hrs on all days except Sundays.
  3. Working on Sundays and working beyond 1900 hrs (up to 2130 hrs) is allowed only duringthe two weeksbefore “griha-pravesham” with written permission of the Ferns Paradise (FP)estate manager. Inany case, noisy work is NOT allowed on Sundays or during the extended hours.
  4. Only 1 watchman and his immediate family (wife and dependant children) are allowed tostay in a separate shed and toilet to be provided by the owner.
  5. Dumping of materials on the road is not allowed. In unavoidable circumstances, owner should seek FP estate manager’s clearance to use the road temporarily and undertake special measures to avoid blocking/spoiling the existing road and drainage conditions.
  6. Each plot has a sewage chamber which must be kept clean during the construction asany material getting inside will block sewage system of the layout.
  7. Owner will be held responsible for any misbehavior of people employed by them for construction including the contractors and they could be barred from entering the layout permanently.
  8. Owner must deploy adequate sized tarpaulin curtains on the sides covering all floors to prevent materials falling out and also ensure privacy of their neighbors from start of construction till the time of completion of all construction activities.
  9. Temporary toilet must be provided to the workers on the site before start of construction.
  10. No water will be provided to the owner for construction work by the association. Owners can get water through water tankers. Contact FP estate manager for further details.
  11. Owner must ensure that No Objection Certificate (NOC) revalidation is done by the NOC committee at different stages of construction, as specified in the NOC, by informing the FP estate manager in time.
  12. Owner must clear the construction shed/materials/debris from the neighbour plot which he/she uses for storage purpose.
  13. Owner must pay a construction security deposit of Rs.50000/- before start of construction. Rs. 25,000/- to be treated as non-refundable deposit and Rs. 25,000/- will be refundable.The following are the penalties on contractors/owners for construction rules violations::

- Violation of agreed plans: Not allowed in any circumstances, must be corrected if any.

- Failure to do NOC revalidation: Rs 5000 per stage and correction, if any

- Staying labors, vehicles beyond approved time: Rs 200 per hour per head/vehicle

- Misbehaviors, misconducts, extra workers staying in night: Rs 1000 per instance.

- Blockage of sewage lines: Rs 1000 per instance and rectification of the blockage

- Not using tarpaulin sheets for covering the sides: Rs. 1000 for each warning

  1. The constructionsecurity deposit will be refunded afterall applicable deductions, on completion of work.
  2. FP estatemanager must be notified of any change in contractor during the course of construction.
