Hooper City Council Meeting Minutes

April 16, 2015

WORK MEETING

The agenda was reviewed. Water ordinance was reviewed. Shared Solutions letter discussed. Councilwoman Binkerhoff submitted the sidewalk proposal for Freedom Elementary. Councilman Beus said the sports mall is still in discussion stage. Reminder there is a budget work meeting on April 22nd at 6:00 p.m.

COUNCIL MEETING

1.  Mayor Green opened the meeting at 7:00 p.m.

2.  The Pledge of Allegiance was given by Councilman Beus and prayer was given by Councilwoman Brinkerhoff.

APPROVAL OF MINUTES

The minutes from the Council meeting were reviewed by the Council. There were some changes made to the minutes.

Motion: Councilman Cooke made a motion to approve the April 2, 2015 Council meeting minutes with corrections.

Seconded: Councilman Beus seconded the motion and it was passed unanimously by the Council.

BUSINESS LICENSES

Mayor Green presented the following business licenses to the Council for approval.

1.  Backyard Buds, proprietor is Jeanette Harmon at 5738 S. 6750 W. Ms. Harmon wants to sell plants out of her greenhouse. She has been granted a Conditional Use Permit for the business from the Planning Commission and has passed the inspections for the building.

Motion: Councilman Scoffield made a motion to approve the Backyard Buds business license at 5738 S. 6750 W.

Seconded: Councilwoman Brinkerhoff seconded the motion and it was passed unanimously by the Council.

2.  On-site Finishing, LLC, proprietor is Cory Rasmussen at 5139 S. 5500 W. This is a commercial license. Mr. Rasmussen will install and refinish cabinets. The Building Inspector has given an occupancy permit for the part of the building they will be using at the above address.

Motion: Councilman Cooke made a motion to approve the On-site Finishing LLC at 5139 S. 5500 W. business license as presented.

Seconded: Councilman Ostler seconded the motion and it was passed unanimously by the Council.

3.  Twin Stitchers, proprietor is Coley Jarvis at 5102 S. 6300 W. She does stitchery design like cross stitching but it is a backstitch design. She creates the patterns on the computer and sells them on-line. She also sells the patterns at Bennion Crafts and some stores in Logan so she has inventory at her home. She said she designs about 10 patterns a year.

Motion: Councilwoman Brinkerhoff made a motion to approve the Twin Stitchers business license at 5102 W. 5500 S.

Seconded: Councilman Cooke seconded the motion and it was passed unanimously by the Council.

NEW BUSINESS

1.  Mayor Green presented the Lorenzo Castillo Subdivision at 5202 W. 5500 S. Mr. Castillo has a larger lot and built a home on the east side of it. He now wants to divide the lot into two. Hooper Irrigation still needs to send an official letter that they have approved the Lorenzo Castello Subdivision. Mr. Castillo has paid the Hooper Irrigation Company for a half of share of water. Mr. Castillo will either construct the curb, gutter and sidewalk or escrow the money for it before a building permit will be issued. An address needs to be given to the new lot by Tracy Allen.

Motion: Councilman Cooke made a motion to approve the Lorenzo Castillo Subdivision at 5202 W. 5500 S. as presented.

Seconded: Councilman Beus seconded the motion and it was passed unanimously by the Council.

2.  The consideration of a water conservation ordinance was talked about.

Mayor Green said back in 2002 when there was a water shortage, Mayor Durk Bailey implemented an ordinance to not allow watering with culinary water between the hours of 10 a.m. and 6 p.m. There was discussion the State has a water ordinance restricting the water usage is a class B misdemeanor if not followed.

Councilman Scoffield said the Hooper Water Improvement District said it may be a good thing to have but they were not willing to support it because they didn’t want the City in their business. They questioned who is going to inforce it and how do you tell if they are using irrigation water or a surface well?

Mike Martinez said the State shouldn’t be shipping water to Arizona and California.

Mayor Green said Hooper City and the two water companies are separate entities and we should stay out of their business. Hooper Irrigation already enforces excessive water use by locking the water boxes.

Councilman Ostler said he felt it was good to keep the ordinance but doesn’t see that the City can enforce it but keep it as a good faith ordinance.

Mike Martinez wanted to know if you are only allowed to have 35% of your property with hard surface. Wouldn’t it be better to have more hard surfaces

for a drought. It was explained that the property needs to be able to absorb the water runoff into the drains and water aquafers.

Motion: Councilman Beus made a motion to keep the Title 6 Chapter 1 Water Conservation Ordinance.

Seconded: Councilman Scoffield seconded the motion and it was passed unanimously by the Council.

CITIZENS COMMENTS

Mike Martinez wanted to know how he fixes his problem with being over 35% of hard surface. He was instructed to get with the Public Works director.

Lorenzo Castillo asked if he would go over the hard surface allowed if he put in a basketball court and installed decorative rocks. Mr. Castillo was told that rocks are not considered hard surface.

Lori Brinkerhoff said she would like to remind the water companies that the water ordinance is still in force.

Councilman Beus made a motion to adjourn.

Councilman Cooke seconded the motion.

The meeting was adjourned at 7:55 p.m.
