CDBG Spot Demolition Policies & Procedures

Policies

Hamilton County’s Spot Demolition program provides Community Development Block Grant (CDBG)funds to participating communities to demolish dilapidated residential structures. The list below establishes criteria for qualifying a property for demolition under this program:

  • All structures must be residential
  • All structures must have environmental clearance
  • All structures must be vacant for a minimum of 90 days
  • All structures must meet the Ohio Revised Code for “blight” (see attachment 1)
  • All demolitions must have the owner’s written consent (see attachment 2) or be legally permissible for demolition through the community’s local condemnation process

Participating communities are permitted to apply for funding for the demolition of one residential building per year on a first-come first-served basis; however, this does not guarantee that the project will be funded. Demolition grants are dependent on the amount of CDBG funds allocated to the Spot Demolition Program each year, but in no instance can the total cost for exceed $10,000.

Procedures

If you have a blighted or condemned property identified in your community and you would like assistance in demolishing, please follow the procedures below and make sure to call David Spatholt at 513-946-8215 if you have any questions:

  1. Complete the CDBG Spot Demolition Application and submit to the Planning and Development office for review. The form can be submitted by mail, email or fax.
  2. Along with the application, submit the following:
  3. Documentation confirming the structure meets the Ohio Revised Code definition of Blight (see attachment 1)
  4. Proof of ownership
  5. Condemnation Orders or a right-of-entry agreement (see attachment 2) from the legal owner if the property is not owned by the community
  6. Proof that the property has been vacant for at least 90 days
  7. Bids from a minimum of three contractors; bids must include an asbestos inspection (all bidders must show proof of the following types of insurance: worker’s comp, employee liability, public liability, and property damage)
  8. Photos of property showcasing its blighted condition
  9. Once the completed application and required documentation is received, staff will review for eligibility and determine if funding is available. If funding is available, staff will obtain an Environmental Review for the project.
  10. Assuming there are no issues with the Environmental Review, staff will notify the applicant that they may proceed with accepting the “lowest and best” quote. Once the chosen contractor’s quote is accepted, please submit the signed and dated quote to the Planning and Development Office.
  11. Upon completion, forward photos of the cleared site along with the contractor invoice and Request for Payment form to the Planning and Development office for payment. Payment will be made as specified on the application form.
  12. If the property is not owned by the community, submit documentation that a lien has been placed on the property for the cost of the demolition.

ATTACHMENT 1

Blighted Parcel – Ohio Revised Code 1.08

(B) “Blighted parcel” means either of the following:

1)A parcel that has one or more of the following conditions:

a)A structure that is dilapidated, unsanitary, unsafe, or vermin infested and that because of

its condition has been designated by an agency that is responsible for the enforcement of housing, building, or fire codes as unfit for human habitation or use;

b)The property poses a direct threat to public health or safety in its present condition by reason of environmentally hazardous conditions, solid waste pollution, or contamination;

c)Tax or special assessment delinquencies exceeding the fair value of the land that remain unpaid thirty-five days after notice to pay has been mailed.

2)A parcel that has two or more of the following conditions that, collectively considered, adversely affect surrounding or community property values or entail land use relationships that cannot reasonably be corrected through existing zoning codes or other land use regulations:

a)Dilapidation and deterioration;

b)Age and obsolescence;

c)Inadequate provision for ventilation, light, air, sanitation, or open spaces;

d)Unsafe and unsanitary conditions;

e)Hazards that endanger lives or properties by fire or other causes;

f)Noncompliance with building, housing, or other codes;

g)Nonworking or disconnected utilities;

h)Is vacant or contains an abandoned structure;

i)Excessive dwelling unit density;

j)Is located in an area of defective or inadequate street layout;

k)Overcrowding of buildings on the land;

l)Faulty lot layout in relation to size, adequacy, accessibility, or usefulness;

m)Vermin infestation;

n)Extensive damage or destruction caused by a major disaster when the damage has not been remediated within a reasonable time;

o)Identified hazards to health and safety that are conducive to ill health, transmission of disease, juvenile delinquency, or crime;

p)Ownership or multiple ownership of a single parcel when the owner, or a majority of the owners of a parcel in the case of multiple ownership, cannot be located.

ATTACHMENT 2

Limited Right-of-Entry Agreement

THIS AGREEMENT is made as of this ____ day of ______, 2017,between ______, hereafter referred to as “Grantor(s),” and the City/Village/Township of ______of Hamilton County, Ohio, hereafter referred to as “Grantee,” for the purpose of permitting Grantee and its agents, employees, and contractors to enter upon (Grantor’s/Grantors’) property commonly known as ______and also known as parcel number ______, in order to demolish the existing structure(s) and any other debris deemed by an authorized City/Village/Township Official to be “blighted”, as defined in Section 1.08 of the Ohio Revised Code.

For and in consideration of Grantee’s removal of the “blighted” structure(s) and other debris from the Property, Grantor(s) hereby grants to Grantee, and to Grantee’s agents, employees, and contractors, the right to enter upon the Property to remove said “blighted” structure(s).

Grantor(s) acknowledges that the Grantee will file a lien against (Grantor’s/Grantors’) property for the demolition costs associated with the removal of the “blighted” structure(s) and that said lien must be paid if/when the property is sold.

Once executed by the parties, Grantor(s) may not terminate this agreement without the consent of Grantee. Grantee’s right to enter upon the Property shall terminate upon completion of the improvements as set forth above.
