I have been dealing with insurance personal injury claims since 1974, and qualified as an Associate of the Chartered Insurance Institute by examination in 1986.

I am experienced in all aspects of liability claims investigation and case management, particularly in the entertainment / licensed sector.

I also have considerable experience in liability and risk management surveys – in particular for hotels / pubs / entertainment risks and social clubs and have carried out risk / liability surveys, and dealt with personal injury claims, for a variety of premises in Ireland, Scotland and England .

I have also carried out fire surveys for a number of social and sporting clubs and licenced premises.

Instructions are accepted directly from individual businesses, representative organisations brokers or insurers The specific nature of each survey, the basis of each report, and of course fees, are discussed and agreed in advance with clients.

Hotel / Licensed Premises Liability Risk Surveys

The frequency of injury claims being pursued against hotels / licensed premises / entertainment risks is increasing. This may lead to insurers imposing higher levels of premium on such risks.

The likelihood of a finding of liability against an Occupier based on negligence may not simply depend on the existence of a physical hazard but also due to the failure to implement adequate systems to manage risk, or maintain adequate records.

Claims can arise from employees, from visitors, or indeed from trespassers.

In order to enable claims to be defended, an Occupier should be aware :-

1)  That a common source of claim relates to physical hazards on their premises. Whilst it is unreasonable to expect the Occupier of any premises to eradicate any possibility of persons being injured, the Occupier is required to carry out risk assessments and take reasonable steps to eliminate any risk identified.

2)  That the information provided to persons visiting or undertaking activities at their premises should be adequate to provide all relevant information regarding the existence of potential physical hazards

3)  That the basis by which risk assessments are circulated to staff, and the basis by which staff record any incidents which might occur, should be in a format appropriate to satisfy insurers and if necessary to satisfy a Court.
