1. DEPARTMENT OF LABOUR, GOVERNMENT OF
KARNATAKA wishes to place services order on competent
Company/ Agency for providing Cleaning Services to Karmika
Bhavana.
2. The Tenderers are invited to submit an offer for providing
Cleaning Services.
3. The tenderer should satisfy the conditions stipulated in the Tender
Document.
4. In case of any clarifications required, the tenderer must contact
the Commissioner of Labour and seek the clarifications in
writing.
5. The tender should be accompanied by EMD amount as specified
in the tender document.
6. Tenders shall be submitted in the format provided. The quotation
shall be scaled and superscribed as ‘ Quotation for providing
Cleaning Services to Karmika Bhavana’
7. The tenders should reach the Commissioner of Labour, before
3-00 p.m. on 20 -01-2006. The Bids will be opened on the same
day 20 -01-2006 at 4-00 p.m. in the presence of tenderers,
interested tenderers may participate in tender opening.

BRIEF TENDER NOTIFICATIONS

1. Sealed Tenders are invited for Providing Cleaning Services to Karmika
Bhavana.
2. The Tenderers who fulfill the following conditions only need to apply:
a] The Tenderer should have satisfactorily executed at least one order for the
services quoted for.
b] The Tenderer on whom order/ orders were placed and subsequently cancelled or therefore closed by any Department of Government of Karnataka or Public Sector undertakings in the last 5 years due to un-satisfactory performance need not apply.
3. The Tenderer should submit their proposal along with EMD of Rs.2,000/- in the form of D.D. drawn in favour of Commissioner of Labour payable at Bangalore.
4. The Tenderers who fulfill the above requirements may obtain the tender document on payment of Rs. 50.00[Non-refundable] on or before 19 -01-2006, up to 1-00 p.m.
5. The last date for submission of tender is 20 -01-2006 up to 3-00 p.m. and the tenders will be opened on same day 20 - 01-2006 at 4-00 p.m. in the Office of the Commissioner of Labour.
6. Department Reserves the right to accept/reject any application or cancel the Tender process without assigning any reason whatsoever.

3.0 GENERAL INSTRUCTIONS;
1. The Commissioner of Labour will receive the Tenders in respective of
services to be provided.
2. All the Tenders shall be prepared and submitted in accordance with these
instruction.
3. Tenders will not be accepted after the time and date fixed for the receipt
of tenders as set out in the Tender Notice or subsequent extensions if any.
4. Tenders shall be in the form. No tender will be considered which is not as
per the printed form and does not bear the tender’s signature and seal at
the bottom of the page of the schedule on which the rates are entered.
5. The Tenders shall contain the Cleaning services provided along with
tender drawing certificates, references of major Undertakings/ Boards
and Government Departments.

5.0 PROCEDURE FOR SUBMISSION OF TENDER
The Tenders shall be prepared by typing or printing with indelible ink and submit it to the Commissioner of Labour in sealed cover super scribed with the subject and enquiry No. noted in the cover and addressed to the Commissioner of Labour, Department of Labour, Karmika Bhavan, ITI Compound, Bannerghatta Road, Bangalore-29, [ Karnataka State, India] on/ before 20-01-2006 before 3-00 p.m. The Tenderers shall ensure each page of the tender is signed by the person authorised to sign the tenders.
6.0 EARNEST MONEY DEPOSIT
An earnest Money Deposit as mentioned in the Brief Tender Notification shall be furnished in the form of D.D. in favour of Commissioner of Labour, Department of Labour Bangalore and must be enclosed. CHEQUES ARE NOT ACCEPTABLE AS EARNEST MONEY DEPOSIT UNDER ANY CIRCUMSTANCES. EMD will be released to te successful Tenderers after the release of order. The EMD of unsuccessful Tenderers shall be released after placement of work order with the successful Tenderer. Tender without EMD amount will not be considered and rejected out right.
All applications for the refund of Earnest Money Deposit shall be made to the COMMISSIONER OF LABOUR, DEPARTMENT OF LABOUR, BANGALORE, quoting the receipt No. date and tender No. & Date.
7.0 TENDERER TO GET INFORMED HIMSELF FULLY
The tenderer shall be deemed to have carefully examined the terms and conditions before tendering the work.
8.0 TERMS AND CONDITIONS
8.1 The agreement shall come into force from 1st of February , 2006 and the duration of
this agreement shall be for one year unless otherwise indicated by the Commissioner
for the extension or cancellation without assigning any reason whatsoever.
8.2 The Cleaning Agency shall provide five persons to perform the below mentioned
tasks at karmika Bhavana on contract basis.

8.3 Task:-
a] Seeping and swabbing of the floor of the entire Karmika Bhavan Building
This task shall be completed by 10.00 a.m. on every working day of this
Office ensuring thorough cleanliness.
b] Thorough cleaning of all the toilets in the Karmika Bhavan building shall
be done twice on every working day of this Office, in the mornings before
10.00 a..m. and in the afternoon between 3.00 p.m. and 3.30. p.m.
c] Disposal of garbage shall be completed before 4,00 p.m. on every working
day.
d] Removal of cobwebs, dusting and cleaning of doors and windows shall be
completed by 10.00 a.m. in every working day.
8.4 The Cleaning Agency will be responsible for the maintenance of discipline by the
personnel employed by them.
8.5 The employ engaged by the Cleaning Agency will be in the employment of the
Cleaning Agency only and not of the Labour Department. The Cleaning Agency
will be responsible for payment of minimum wages as per the prevailing Govt.,
Notification No. kaEe 43 LMW 2001 dated 5-2-2003 and other service benefits
under the various Labour Laws applicable to its personnel posted as detailed below:
a. The Agency shall not pay wages and other allowances to its cleaning
employees below the rates of minimum wages fixed by Government
from time to time. The prevailing rate of wages as per the Notification
mentioned supra the wage is Rs. 2146+ VDA Rs.275-40
= 2421-40 . In the event of revision of wages or revision of
VDA pursuant to the hike or decline in the CPI Index, the increased
wages and increase or decrease in VDA shall have to pay
during the curency of agreement.
b. All the personnel engaged shall be covered under the
ESI, PF and shall pay contribution of the workers together
with their own contribution to the PF & ESI aothorities.

c The Cleaning Agency shall provide weekly holidays, national
and Festival Holidays and Leave with Wages and other benefits
as per Karnataka Shops and Commercial Establishments Act.
d. The cleaning Agency shall pay the Gratuity and bonus
as per the provisions of the Payment of Bonus Act and
payment of Gratuity Act, 1972
e. That apart the personnel engaged by the Cleaning
Agency shall extend all the benefits accruing to them
under the various Labour Laws applicable.
8.6 Persons so deployed shall not be below 21 years and not above 60 years
They will perform their duties to the satisfaction of the Commissioner. A
representative of the Cleaning Agency will report at least once in a week
for co-ordination with the departmental Officer.
8.7 Senior Officer of the Cleaning Agency should visit and check their personnel
periodically and monitor their performance.
8.8 If personnel provided by the Cleaning Agency to the department are found to be
indulging in any undesirable or unfair activities in the premises of the Karmika
Bhavan, the agency will solely be responsible for all the consequences, apart from,
the liberty of the department to lodge a complaint before appropriate authorities.
8.9 The Commissioner shall not employ the personnel of the Cleaning Agency for
any other task not mentioned in this agreement.
8.10 The Cleaning Agency which is entrusted with the task of providing persons for
cleaning the premises of Karmika Bhavana will be solely responsible for the
maintenance of utmost cleanliness of the premises. If the services rendered are
found to be unsatisfactory, this agreement will be terminated at one month’s notice.
8.11 For satisfactory performance of all the tasks mentioned at para 8.3 above,
the monthly payment by the Commissioner to the Cleaning Agency shall be

with DA, ESI & PF contributions for five persons.
8.12 Mode of payment will be monthly and would be paid by 10th of each
succeeding month. Payments to the Cleaning Agency will be though
Account payee cheques only. Payment of salary to personnel must be
made immediately after receipt of cheque from the Commissioner.
However, it is the responsibility of the Cleaning Agency to produce
previous months ESI, PF contribution receipts and salary statements
of the employees as per the Minimum Wages Act, along with the bill
for payment to facilitate the Commissioner to issue the cheque
towards the payment. This will be strictly adhered to before making
payment
8.13 This agreement will be in force for a period of one year from the date
of execution and can be terminated by one month notice on either
side.
8.14 Any dispute arising out of this agreement or that which may arise in
future, will be resolved by taking recourse to mutual settlement in the first instance, failing which the dispute will be subject to Bangalore Jurisdiction only. The Commissioner is entitled to wich hold payments due to the Cleaning Agency in case of dispute till it is resolved.
8.15 The employees so employed on contract basis for purpose of Cleaning
will not be treated as employees of the Labour Department.
8.16 The Commissioner of Labour or his nominee, if found any of the
personnel not performing his work as per the requirement, the Cleaning Agency shall change such workers and replace by a new person.
8.17 The Cleaning Agency shall strictly follow all the terms and conditions
of the agreement. In case of violation of any of the terms, the
agreement shall be liable for cancellation and it will be cancelled with one- month prior notice.
