Georgia College & State University StudentPolicyon Alcoholand IllegalDrugs
Georgia College & State University recognizes the need to address the issues of alcohol and other drug abuse among university students. Drug use may pose physical and psychological risks, and long-term harm to self and others, in addition to the legal consequences of involvement with controlled substances.
Thepurposeofthispolicyisto circumscribeandeducate aboutthelawfulandresponsibleuse ofalcoholbystudents,andto educateabout illegaldrugsinorderto maintainanenvironmentthatisconsistentwiththeeducationalmissionofGeorgia College & State University.
Georgia College & State University willcomplywithallfederal,state,andlocallawsandpolicies,includingthe policiesoftheBoardofRegentsofthe UniversitySystemofGeorgia,ontheabuseofalcoholandotherdrugsbyitsstudents.ThelegaldrinkingageintheStateofGeorgiais 21.
EachmemberoftheGeorgia College & State University communityshouldbeinvolvedintheimplementationofandcompliancewiththisPolicy.Unless otherwisestatedbylaw,eachindividualretainsresponsibilityfor hisor heractionsatalltimesregardlessof hisor hermentalstate, evenifalteredbyalcoholicbeveragesorotherdrugs.
Campusorganizationsmaydevelopandenforceadditionalgroup/individualstandardswhicharemorerestrictivethanthose establishedinthisPolicy.
STANDARDSOFCONDUCTANDSANCTIONS
Inaccordancewithfederaland statelawsandbecauseofthepotentialdetrimentto the healthandwell-beingofitsstudents,all studentsareprohibitedfromengagingintheunlawfuluse,possession,manufacture,distribution,dispensation,and sale ofalcoholic beverages,controlledsubstances(includingmarijuana),andotherdangerousdrugs.
- Alcohol
- Thesale,distribution,andconsumptionofalcoholicbeveragesinoronallGeorgia College & State University ownedorleased(by)propertyoron sidewalks/streetsare specificallyprohibited,withtheexceptionofthosedesignatedannuallybytheOfficeofStudent Affairs.Anofficial listofdesignatedlocationsisavailableintheVicePresidentforStudentAffairsofficeandontheStudentLifewebsite.Thisdoes notprohibitthelawfuluseofalcoholinresidences.
- Individualpossessionand/orconsumptionofalcoholicbeveragesisacceptable,providedindividualsdo not:
- Possessorconsumealcoholicbeveragesifunder21 yearsofage.
- Furnish,orcauseto be furnished,anyalcoholicbeveragesto personsless than21 yearsofage.
- Conspicuouslydisplayopencontainersofalcoholicbeveragesinanypubliclocation,including,butnotlimitedto, grounds,sidewalks,and streetswithincampusboundaries(withtheexceptionofthe grounds,butnotthepublicsidewalks and streets,orprivatelyownedorleasedproperty).
- Sellalcoholicbeverages.
- Misrepresentone'sageoridentityinanymannerforthepurposeofobtainingorpossessinganyalcoholicbeverage.
- Serveormakeavailablealcoholto obviouslyintoxicatedpersons.
- Alcoholicbeveragesmaybe servedand/orconsumedbyindividualsover21 ateventsandactivitiesthatareadvertised,promoted, sponsored,or supervisedbyarecognizedGeorgiaCollege & State University organization,providingtheorganizationshall:
- BeresponsibleforenforcingtheentireStudentPolicyon AlcoholandIllegalDrugs.
- Haveanacknowledgmentofthe"Policyon StudentAlcoholandIllegalDrugUse" formonfileintheDepartment of Campus Life in the Student Activities Center. AcknowledgmentofthePolicyonStudentAlcohol andIllegalDrugsFormsareavailableintheDepartment of Campus Life.Thismustbe signedwithevery changeoverofofficers.
- Ensurethatalcoholisnotthe focalpoint,thereasonfor,orthedrawingcard foranevent.
- Submit,andhaveapproved,a completedAlcoholEventPlanningFormto Department of Campus Life beforetheevent. AlcoholEvent PlanningFormsareavailableintheDepartment of Campus Life in the Student Activities Center.
- Notadvertisethe service oravailabilityofalcoholicbeveragesatfunctions.
- Ensurethatalcoholicbeveragesare notconsumedbyanyindividualunderthelegaldrinkingageof21.
- Providenon-alcoholicbeveragesandfoodinreasonablequantity,inthe samegeneralarea,and forthe sametimeperiod, asthealcoholicbeveragesare accessible.
- Controlaccessto thealcoholicbeveragesthrougheithera centralpointofdistributionbya designatedserverorbyanother methodsuchas wristbandsand sober monitors.Controlisforthepurposeofrestrictinguse bythoseunder21 and/orwho are obviouslyintoxicated.
- Notuseorganizationalfundsto purchasealcohol.Anymoneysusedto payforalcoholicbeveragesmustbetakenfrom personal/privatesourcesbya properlylicensedthirdpartyvendor.Alcoholicbeveragesmaynotbepaid forbythe student organizationsellingthemattheactivityorbycharginganadmissionfeeeitherinadvanceoratthedoor(asstatedinthe GeorgiaCodeofLaw,1981Section3-3-21).
- Notusekegs,champagne/punchfountains,orothercommonusagecontainers(suchas punchbowlsor frozendrink machines)foralcoholicbeverages.
- Intheabsenceofa third-partyvendor,designateor hireaTIPS(TrainingInterventionProceduresforServers)trained servertomonitorthe serviceandconsumptionofalcohol.Itisunlawfulto serveormakeavailablealcoholto obviously intoxicatedpersons(asstatedintheGeorgiaCodeofLaw,Section3-3-22).
- Requirea StudentAffairsrecognizedadvisor,whomustnotbea minor,to beawareoffunctionsofstudentorganizations wherealcoholis servedormadeavailable.Advisorsareencouragedto attendsuchfunctions.
- Tailgating with alcohol at major events
- Tailgating is defined as a social event held on and/or around the open tailgate of a vehicle. Tailgating often involves consuming beverages and grilling food. Tailgate parties usually occur in the parking lots at stadiums and arenas before, and occasionally after or during, sporting events and concerts. Individuals may still “tailgate” even if their vehicles do not have tailgates, or are not using a vehicle.
- Tailgate parties are permitted in Georgia College & State University parking areas and gathering sites during major campus events which are designated annually by the Office of Student Affairs.
- Pre-determined areas of the Georgia College & State University parking areas and gathering sites during major campus events in use for tailgate parties will be identified as “family friendly zones” and individual possession and/or consumption of alcoholic beverages will not be permitted in this area.
- It is acceptable for individual possession and/or consumption of alcoholic beverages in areas not identified as “family friendly zones” within the tailgating area designated by Office of Student Affairs provided individuals do not:
- Possess or consume alcoholic beverages if under 21 years of age.
- Furnish, or cause to be furnished, any alcoholic beverages to persons less than 21 years of age.
- Sell alcoholic beverages.
- Misrepresent one's age or identity in any manner for the purpose of obtaining or possessing any alcoholic beverage.
- Serve or make available alcohol to obviously intoxicated persons.
- Use kegs, champagne/punch fountains, or other common usage containers (such as punch bowls or frozen drink machines) for alcoholic beverages.
- Engage in any disorderly, profane, indecent conduct or misbehavior that would interfere or disrupt the peaceful activities of others.
- Begin more than three hours prior to the event, and do not continue more than three hours after the event unless prior authorization has been given when designated by the Office of Student Affairs.
- Litter; all trash must be placed in the appropriate receptacles.
- Public safety must be present at all tailgate parties involving alcohol onallGeorgia College & State University ownedorleased(by)propertyoron sidewalks/streets.
- Promotionalactivitiesregardingalcoholareas follows:
- Thepostedadvertisementofalcoholicbeveragesoncampusis notpermitted.Campuspublicationsareencouragedto minimize/eliminatealladvertisementofalcoholicbeverages.
- No promotionoradvertisingoncampusofincentivedrinkingisallowed.
- Studentgroupsandorganizationsmaynotseekoracceptsponsorships fromcompanies/vendorswhosemain focusofbusinessisthemanufacture,distribution,or saleofalcoholproducts.
- Participantsin StudyAbroadprogramsareboundbythelegaldrinkingageoftherespectivecountriesin whichtheyarestudying, as well as the guidelines established by their program's faculty leader(s), andinallotherrespectsthispolicyapplies.
- SanctionsforViolationofStandards
- Studentswhoviolatethispolicywillbe subjectto disciplinaryactionandpenaltiesin accordancewiththeGeorgiaCollege & State UniversityStudentConductCodeaspublishedintheStudent Handbook.
- Attemptsto circumventthe provisionsinthisPolicyinanywayareaninfractionofthisPolicy.
- Possessionand/orUseofIllegalDrugs
- GeorgiaCollege & State Universitydoesnotpermitorcondonetheillegalpossessionand/oruseofcontrolledsubstances.Controlledsubstancesmeansany drug,substance,orimmediateprecursorincludedinthedefinitionofcontrolledsubstancein theOfficialCodeofGeorgiaSection16-13-21(4)orScheduleI throughV ofSection202oftheFederalControlledSubstanceAct [21UnitedStatesCode812]. “Dangerous drug”isusedasdefinedintheOfficialCodeofGeorgiaSection16-13-71.
- SanctionsforViolationofStandards:
- AnystudentwhoviolatesthisPolicyoranyfederalor statelaworpolicyregardingthe manufacture,distribution,sale,possession,or useofcontrolledsubstancesorotherdangerousdrugsshallbe subjectto disciplinary actionsandpenaltiesinaccordancewiththeGeorgiaCollege & State StudentConductCodeaspublishedintheStudent Handbook.
- InaccordancewithGeorgialaw,anystudentconvictedofafelonythatinvolvesthemanufacture,distribution,sale, possession,or useofcontrolledsubstancesorotherillegaldrug,or studentorganizationsinvolvedintheseactivitieswill be subjectto specificpenaltiesrequiredbystatelaw.
- Furtherinformationregardingtheeffectsofdrugabuseandpenaltiesformanufacture,distribution,sale,possession,or useof controlledsubstancesorotherillegaldrugsisavailableintheCounselingCenter,StudentHealthCenterandtheDean ofStudentsOffice.
- Participantsin StudyAbroadprogramsareboundbythepoliciesoftheGeorgiaCollege & State University as well as the guidelines established by their program's faculty leader(s), regardingthe possession and/oruseofillegaldrugs.
DrugandAlcoholCounseling,Treatment,andRehabilitationPrograms:Studentswithalcohol-ordrug-relatedproblemsmaybe referredto orseekassistancefromtheDivisionofStudentAffairs.TheDivisionofStudentAffairsprovidestrainedprofessionaland paraprofessionalcounselorsin the CounselingCenter fordrugandalcoholabuseprevention,education,andcounseling.
PolicyReview:ThispolicyshallbereviewedannuallybyaTaskForcewhichincludesstudentrepresentationandisappointedbythe DeanofStudentsortheirdesignee,to determineitseffectiveness,to ensurethatpoliciesareenforcedandthedisciplinarysanctions areconsistentlyapplied,to evaluatetheeffectivenessoftheimplementationoftheeducationalcomponentofthepolicy,andto recommendandimplementchangesasappropriate.
POLICY DISTRIBUTION
TheDeanofStudents,ortheirdesignee,shalloverseetheannualdistributionofthisPolicyto everyGeorgiaCollege & State University student.AdditionalcopiesofthePolicyonStudentAlcoholandIllegalDrugs maybeobtainedfromtheDeanofStudentsOffice.
