GENESEE TOWNSHIP BOARD MEETING MINUTES

JUNE 11, 2013

The meeting was called to order at 6:05 p.m. by Supervisor Fuhr.

All present gave Pledge of Allegiance to the Flag.

Present: Fuhr, Bates, Mannor, Burrus, Jean, Witte.

Absent: Sutton

Moved by Jean supported by Bates to approve the agenda as presented. Vote taken. Motion carried.

Moved by Burrus supported by Witte to approve the minutes of the May 14, 2013 regular board meeting. Vote taken. Motion carried.

Moved by Bates supported by Mannor to approve the minutes of the May 20, 2013 special board meeting. Vote taken. Motion carried.

Moved by Bates supported by Burrus to approve the minutes of the June 4, 2013 special board meeting. Vote taken. Motion carried.

PRESENTATION

Donnell Reid from the MAPE Union here to represent the township clerical employees in regards to part of a step three process of MAPE grievance 130-039 that has been filed. It appears Township Supervisor Mr. Fuhr promoted Mr. Zumbach to a position of Assistant DPW Director, position was not posted, a newly created position, this is a clear violation of the union contract; it violates Article 12, Section 12.1 which states any new created position or vacancies within this bargaining unit will be posted for 2 weeks on the union board and every member will have an opportunity to apply. This did not happen. The township’s Policy and Procedures under Section 2.3-Recruitment, Section 3.1 states that any vacancies within the township will be posted before there is external seeking for one who is qualified for the job. This did not happen. Mr. Zumback, one of our members, was given a promotion into a newly created position with no one else given the opportunity to apply; this promotion gave him a $2596.00 pay raise, which equates to a 5.5% pay increase, when the rest of the members agreed to concessions in their contract of a 1.5% reduction of wages and a total of 5% through other concessions in the contract. There was possibly another qualified person who would have applied for the position and with the pay increase. Mr. Fuhr’s response to the Union was it didn’t fall under 12.5 but didn’t say how the promotion did not fall under 12.5. Mr. Fuhr has stated that he has talked with Union Representative Jim Steffes, which is not true; Mr. Steffes has been on medical leave since April 2013. Mr. Steffes stated he was at the township for another matter, Mr. Fuhr mentioned something in regards to this subject while in the hall, never has been a sit down, clear dialog, agreement, understanding or signed document agreeing to the way Mr. Zumbach was promoted into the position. Mr. Zumbach is still doing union work in the capacity of Supervision. The union asks for the demotion back to his position in the union and position then be posted and everyone has the opportunity to apply in accordance to township policy and procedures as well as the union contract.

Moved by Bates supported by Witte to approve cable television funds to enhance broadcasting program for Genesee School District at a cost of $49,017.12. Discussion held. Roll call vote: All yes. Motion carried.

Moved by Bates supported by Witte to approve amending township budget as presented. Roll call vote: All yes. Motion carried.

Moved by Bates supported by Burrus to approve up to $4500.00 for Genesee County Road Commission clean up from tornado/storm. Roll call vote: All yes. Motion carried.

Moved by Bates supported by Witte to approve selling 2002 Chevy Impala with blown motor for $500.00 to Thomas J. Brissette Jr. Discussion held. Roll call vote: All yes. Motion carried.

Moved by Jean supported by Witte to approve hiring Bobby Irish Jr. as firefighter for Fire Station #1 pending passing physical and drug test. Discussion held. Roll call vote: All yes. Motion carried.

FINANCE

Moved by Bates supported by Witte to approve bill list dated June 11, 2013 in the amount of $440,171.12. Roll call vote: All yes. Motion carried.
