I.INTRODUCTION

UndertheleadershipofDistrictAttorneyGeorgeGascón,theSanFranciscoDistrictAttorney’sOffice(SFDA)strivestoadheretooursocialidealsandadministerjusticeinanequitablemanner.Weworktirelesslytoholdoffendersaccountable,protectandsupportvictims,andinnovatetobreakthecycleofcrime.OurgoalistomakeSanFranciscothesafestlargecityinAmerica–andtoachievethisinpartnershipwiththediversestakeholdersthatcompriseourcommunity.

TheSFDAisissuingthisRequestforQualifications(RFQ)toidentifyoneormorehighly-qualified501(c)(3)organizationsorindividualfirmsdemonstratingsuccessfulexperienceinprovidingalternativedisputeresolutionservices.Respondentsmayapplytooperatecomponentsofoneormoreofthesetwodistinctcitywidedisputeresolutionprograms:

1.SFDANeighborhoodCourts:community-driven,restorative-justiceresolutionofcriminalmattersreferredbytheSFDAasanalternativetoprosecution.

2.CivilAlternativeDisputeResolutionVolunteerTraining:alternativedisputeresolutionandmediationforconflictsbetweenneighbors,merchantsandothersthatcouldotherwiseresultinthefilingofcivillawsuitsorgounresolved,leadingtofurtherconflictbetweenneighbors.

Infundingtwodistinctprograms,theCityisensuringthegreatest possibleaccesstodisputeresolutionprogramsandservices.

II.PROGRAMOVERVIEWS

1.NeighborhoodCourts

NeighborhoodCourtsisa pre-chargingdiversionprogramfornon-violentmisdemeanorsthatemphasizescommunityparticipationandrestorativejustice.SanFranciscoDistrictAttorney(SFDA)prosecutorsreviewallmisdemeanorcasestoidentifythosethataresuitableforNeighborhood Courts.Suitablecasesarethosethat(1)arelegallyeligible,perNeighborhoodCourtguidelines and(2)wouldotherwisebechargedforprosecution.

ParticipationinNeighborhoodCourtsisvoluntary.PotentialparticipantsarecontactedbytheSFDAandprovidedinformationabouttheprogram,includingtheirlegalrightsandprogramrequirements.A panel of trained volunteer “adjudicators” (or panelists) trained in restorative justice and problemsolving,hearmisdemeanorcasesatoneoftenNeighborhoodCourtslocatedinSanFrancisco’s10policedistricts.Therearenoprosecutorsordefensecounselinthehearings.Panelsof3-4adjudicatorsheareachcaseseparatelytodialoguewiththeparticipant,assesstheharmcausedbytheincident, and issue “directives” to addressthe harm caused to the victim, thecommunity, and theparticipanthim/herself.Oncetheparticipantcompleteshis/herdirectives,theSFDAdischargesthecase(e.g.doesnotfile itincriminalcourt).Ifcandidatesfailtorespondtotheinvitationtoparticipate,optout,orfailtoappearatNeighborhoodCourtorcompletetheirdirective,theircasewillbereferredbacktotheHallofJusticefortraditionalcriminalcaseprocessing.Neighborhood

Courthearingsareconfidential;anyinformationrevealed throughtheNeighborhoodCourtsprocesscannotbeusedforprosecutionpurposes.

TheSFDA’sselectednonprofitNeighborhoodCourtpartner(s)willperformmultiplefunctionstosupportthemodel,includingsupportatNeighborhoodCourtsessions,day-to-dayprogramadministration,participanttrackingandreporting.AdditionaldetailsareprovidedinSectionVIbelow.

2.CivilAlternativeDisputeResolutionVolunteerTraining

Thisprogramareaisfocusedontheprovisionofalternativedisputeresolutionandmediationservicesforresidentsandmerchantswhoareseekinganalternativevenuetoresolvetheirconflicts,ofteninlieuofcivilcourt.

TheSFDA’sselectednonprofitpartner(s)willreceivereferralsthroughcommunityoutreachandpubliceducation,recruitandtrainvolunteerdisputeresolutionandfacilitatetheoperationofthosedisputeresolutionandmediationservices.Thenonprofitpartner(s)alsowillprovide trainingandongoingtechnicalassistanceforNeighborhoodCourtsvolunteeradjudicators.AdditionaldetailsareprovidedinSectionVIbelow.

TheNeighborhoodCourtandCivilAlternativeDisputeResolutionVolunteerTrainingprogramsarefundedthrougha combinationofSanFranciscoGeneralFunddollarsandtheCaliforniaDisputeResolutionsProgramAct(DRPA)fund(BusinessProfessionalCodeSections465etseq.).

IV.TERMSOFQUALIFICATION

TheSanFranciscoDistrictAttorney(SFDA)seekstoidentifyanorganizationororganizationstoprovidecivilandcriminalalternativedisputeresolutionservicesfortheperiodofJuly1,2018-June30,2019,assetforthinSectionVI,ScopeofWork,below.Whiletheoriginaltermofthisagreementisproposed fortheperiod of 12 months,theSan FranciscoDistrict Attorney’sOffice/City CountyofSanFranciscomayexerciseinitssole,absolutediscretiontoextendthetermforaperiodofup to twoyears(throughJune30,2021).

ThepurposeofthisRFQistoselecttheorganization(s)thatwillserveasSFDA’salternativedisputeresolutionpartner(s).Theselectedagency,collaborative,oragenciesmustmaintain continuityofservicesforexistingparticipantsandseamlesslytransitioncurrentparticipantsintotheirprogram.

Collaborations:Collaborativeconsortia,jointventures,orateamofagencieswithcomplementaryskillsandexperiencearepermittedandhighlyencouragedto submitjointresponsestothisRFQ.

LeadAgencies:Proposalsfromcollaborativeconsortia,jointventures,orteamsmustdesignatealeadagencywhichwillserveasthefiscalsponsorforthepartners.Thisleadagencywillberesponsibleandaccountableforeffectivelyandefficientlyplanning,managing,anddeliveringtheservicesandactivitiesdescribedinthisRFQ.Theleadagencymustalsodemonstratethemanagementandfinancialcapabilityneededtoeffectivelyandefficientlydelivertheprogramproposedandaccountforthegrantfunds.

Subcontracting:Applicantsmayincludesubcontractingarrangementswithotheragencies;however,thesearrangementsmustbemadepriortosubmissionoftheproposal.Confirmationofa

memorandumofunderstandingorotherformalagreementbetweentheapplicantandsubcontractorisrequiredforanycollaborativesubmissionstothis RFQ.

RightNottoFund:IfthesubmittedapplicationstothisRFQarenotdeemedresponsive,SFDAreservestherightnottoissuegrantagreements.SFDAmaynegotiateaseparateprocesstoprovidetheservicesidentifiedinthisRFQ.SFDAwillnegotiatethescopeofservices,budget,deliverables,andtimelineforeachprojectitdecidestopursue.ThereisnoguaranteeofaminimumamountofworkorcompensationforanyoftheRespondentsselectedforpre-qualification.SFDAmayselectContractorsfromthepre-qualifiedlistinitssoleandabsolutediscretion.

V.REQUIREMENTS

SFDAseekstofundapplicantsthatshareavision,mission,goals,values,andcommitmenttopartnershipandcollaborationtopartnerwithusinprovidingalternativedisputeresolutionmodelsinboththecriminalandcivilcontexts. ThisRFQseeksactivepartnersinforginga responsiveanddynamicsystemtoprovidethehighestqualityofservicespossible.Organizationsreceiving fundsthroughthisRFQmustbeaSanFranciscocity-approvedvendor,meetspecificeligibilityandcontractualrequirements,andoperateinaspiritofcommunitypartnership.

A.MinimumQualifications(PleasealsorefertoSectionVI,ScopeofWork)

AnyresponsethatdoesnotdemonstratethattheRespondentmeetstheseminimumqualificationsbytheresponsedeadlinewillbeconsiderednon-responsiveandwillnotbeevaluatedoreligibleforawardofanysubsequentgrant(s).

B.VendorStatus

AllorganizationsfundedviathisRFQmustbeaCity-approvedvendoratthetimethatRFQresultsareannounced,andnotbeontheCityVendorDebarredlistbeforereceivingfunds.

C.SFDAEligibilityRequirements

AllapplicantsmustmeetalleligibilityrequirementsinordertobeconsideredforSFDAfunding.

Anyproposalthatdoesnotdemonstratethattheapplicantmeetstheseminimumrequirementsbythedeadlineforsubmittalofproposalswillbeconsiderednon-responsiveandwillnotbeeligibleforawardofthegrant.

Fundedorganizationsmustcomplywithallrequirementsoutlinedinthegrantagreement.Inaddition,SFDAhasspecificgrantagreementrequirementsthatmustbemet:

Sunshine:UnderChapter 12LoftheSanFranciscoAdministrativeCode,non-profitsthatreceiveinexcessof$250,000incityfundsmustcomplywithspecificopengovernmentrequirementsandrespondtorequestsforfinancialandmeetinginformationfrommembersofthepublic.Thisiscommonlycalledthe“Sunshine Act.”

Accessibility:All programsandservicesmustbeaccessibletopersonswithdisabilities.Programaccesscanbeachievedinmanycaseswithouthavingtoaltertheexistingfacility.

E.GrantAward

TheselectionprocesswillincludeanevaluationoftheminimumqualificationsandwrittenresponsesevaluatedbySFDAstaffandindependentreviewersselectedbySFDA.Theselectionofany proposalshallnotimplyacceptancebytheCity ofalltermsoftheproposal,whichmaybesubjecttofurthernegotiationandapprovalsbeforetheCitymaybelegallyboundthereby.IfasatisfactorygrantagreementcannotbenegotiatedinareasonabletimetheSFDA,initssolediscretion,mayterminatenegotiationswiththeselectedproposer.

ii.Conduct3-5in-courtpanelistobservationspermonthtoevaluatetrainingefficacyandadjusttrainingcontentorcurriculum asneededtostrengthentheimpactandinstructionofthetrainings.

VII.EVALUATIONCRITERIATERMSOFRFQ

ThissectiondescribestheguidelinesusedforanalyzingandevaluatingtheresponsesandforRespondentpre-qualification.ItistheSFDA’sintentto pre-qualifyRespondent(s) thatprovide thebestoverallqualificationstotheSFDAinclusiveoffeeconsiderations.Consultantfirmsselectedforpre-qualificationare notguaranteeda contract. ThisRFQdoesnotinany way limittheSFDA’s rightto solicitcontractsfor similaroridenticalservicesif,intheSFDA’ssole andabsolutediscretion,itdeterminesthepre-qualifiedlistisinadequatetosatisfyitsneeds.

A.ErrorsandOmissionsinRFQ

ProposersareresponsibleforreviewingallportionsofthisRFQ.ProposersaretopromptlynotifytheSFDA,inwriting,iftheproposerdiscoversanyambiguity,discrepancy,omission,orothererror

intheRFQ.AnysuchnotificationshouldbedirectedtotheSFDApromptlyafterdiscovery,butinnoeventlaterthanfiveworkingdayspriortothedateforreceiptofproposals.Modificationsandclarificationswillbemadebyaddendaasprovidedbelow.

B.AddendatoRFQ

TheSFDAmaymodifytheRFQ,priortotheproposalduedate,byissuingwrittenaddenda.AddendawillbepostedonSFDAwebsiteat forensuringthatitsproposalreflectsanyandalladdendaissuedbytheSFDApriortotheproposalduedateregardlessofwhentheproposalissubmitted.Therefore,theCityrecommendsthattheproposervisittheSFDAwebsitebeforesubmittingitsproposaltodetermineiftheproposer hasreceivedalladdenda.

C.RevisionofProposal

Aproposermayrevisea proposalontheproposer’s owninitiative atany timebeforethedeadlineforsubmissionofproposals.Theproposermustsubmittherevisedproposalinthesame mannerastheoriginal.Arevisedproposalmustbereceivedonorbeforetheproposal duedate.

Innocasewillastatementofintenttosubmitarevisedproposal,orcommencementofarevisionprocess,extendtheproposalduedateforanyproposer.

Atanytimeduringtheproposalevaluationprocess, theSFDAmayrequireaproposertoprovideoralorwrittenclarificationofitsproposal.TheSFDA reservestherighttomakeanawardwithoutfurtherclarificationsofproposalsreceived.

D.LateorConditionalProposals

AnyproposalreceivedbytheofficedesignatedinthisRFQaftertheexacttimespecifiedforreceiptwillnotbeconsidered.Proposalsmustbesubmittedasapdfbyemailto y5PMonMay11,2018.

IX.PROTESTPROCEDURES

ProtestofNon-ResponsivenessDetermination

Withinfive(5)workingdaysoftheCity'sissuanceofanoticeofnon-responsiveness,anyproposerthathassubmittedaresponseandbelievesthattheCityhasincorrectlydeterminedthatitsresponseisnon-responsivemaysubmitawrittennoticeofprotest.SuchnoticeofprotestmustbereceivedbytheCityonorbeforethefifth(5th)workingdayfollowingtheCity'sissuanceofthenoticeofnon-responsiveness.Thenoticeofprotest mustincludeawrittenstatementspecifyingindetaileachandeveryoneofthegroundsassertedfortheprotest.Theprotestmustbesignedbyanindividualauthorizedto representtheRespondent,andmustcitethelaw,rule,localordinance,procedureorRFQprovisiononwhich the protestisbased.Inaddition,theprotestormustspecifyfactsandevidencesufficientfortheCitytodeterminethevalidityoftheprotest.

DeliveryofProtests

TheController’sOffice willconfirm receiptofnoticeofprotestbyProposer.

If a Proposersubmits a complete and timely protest, theController’sOffice will reviewnoticeofprotestsoonafterreceiptoftheprotesttodeterminevalidityofnotice,including,butnotlimitedto:(a)receiptbyduedate; (b)inclusionofawrittenstatementspecifyingindetaileachandeveryoneofthegroundsassertedforthe protest;(c)signedbyanindividualauthorizedtorepresenttheProposer;(d)citationofthelaw,rule,localordinance,procedureorRFPprovisiononwhichtheprotestisbased;and(e)specificationof factsandevidencesufficientfortheCitytodeterminethevalidityoftheprotest.TheCity,atitsdiscretion, maymakeadeterminationregardingaprotestwithoutrequestingfurtherdocumentsorinformationfromtheProposerwhosubmittedtheprotest.Accordingly,theinitialprotestmustincludeallgroundsofprotestandallsupportingdocumentationorevidencereasonablyavailabletotheprospectiveProposeratthetimetheprotestissubmitted.IftheProposerlaterraisesnewgroundsorevidencethatwerenotincludedintheinitialprotest,butwhichcouldhavebeenraisedatthattime,thentheCitymaynotconsidersuchnewgroundsor newevidence.ThereviewshallbeaninformalprocessconductedbytheController’s Office or itsdesignee andwill be based uponthe information submittedby theRespondent in its protest letter. Protestsnotreceivedwithinthetimeandmannerspecifiedwillnotbe considered.AProposer'sfailuretoprotestasspecifiedaboveonorbeforethetimespecifiedaboveshallconstituteacompleteandirrevocablewaiveroftheground(s)ofprotestandforfeittheProposer'srighttoraisesuchground(s)ofprotestlaterintheprocurementprocess,inaGovernmentCodeClaim,orinotherlegalproceeding.
