AGREEMENT TO HOLD

In consideration of a holding fee, the undersigned property owner ______hereby agrees to hold apartment located at______for prospective tenant(s)______. The amount of the holding fee is based upon the amount of days the unit will be held at the prorated monthly rental rate per day. A non-refundable background check fee of $20 per person will also be collected upon execution of this agreement.

Sample calculation: Total rent for 2 occupants of $600 per month ($20 per day) holding apartment for 5 days equals $100. Non-refundable background check fee equals $40.

Contingent upon the passing of a background check by the prospective tenant(s), the undersigned prospective tenants(s) agree(s) to execute a lease with a tenancy date for the said apartment beginning on the date of this agreement at a rental rate of ______per month and pay the first month's rent and security deposit, less the amount of the holding fee, and sign the property owner's lease on or before the lease-signing date stipulated below at which time keys to the unit will be provided for move in.

It is further agreed:

  1. The prospective tenancy is subject the prospective tenant’s passing the background check. Violent felonies, felonies involving a firearm, registered sex offender (all units are within the prohibited distance from the school and public park) are an automatic fail. Property owner will use their legal discretion in maintaining the safety of the other tenants when determining an acceptable level of risk in evaluating criminal history. All rental history, income information, credit and character references provided by the prospective tenant have already been reasonably evaluated by the property owner, and are being presumed totally accurate, and contingent approval has been given being contingent upon the background check and the continued accuracy of information submitted by the applicant(s). If any of the prospective tenants are found to have falsified, failed to disclose, or misrepresented any information, or change their mind and break this agreement at any time during this evaluation and approval process or holding period, any approval given will be retracted, and the fee to hold the said apartment shall be forfeited to the property owner in proportion to the number of days that the apartment has been held plus a $25 fee for time spent. If all the information provided by the prospective holds true and the tenant(s) simply does not pass the background check(s), the holding fee will be refunded within seven (7) days. The background check fee is non-refundable. The result of the background check will be given to the prospective tenant(s) within 24 hours. The lease-signing date can be expedited at the prospective tenant's request to an earlier date if the property owner is available.
