SUBJECT:CERTIFICATE OF INSURANCE

To Whom It May Concern:

Please be advised that relative to your services at 550 Madison Avenue, we require a certificate of insurance from your company evidencing the following coverage:

Provider shall maintain the following coverages with insurance carriers having a Best’s rating of A- or above:

A) Worker’s Compensation - Statutory Amount

B) Employer’s Liability - $1,000,000 minimum

C) Commercial Liability Insurance including Contractual Liability with the following minimum limits:

General Aggregate $2,000,000

Property Damage $1,000,000

Each Occurrence $1,000,000

Personal & Advertising Injury $1,000,000

Medical Payments $5,000 per person

D) Umbrella/Excess Liability (on a following form basis with the following minimum):

General Aggregate$4,000,000

Each Occurrence $4,000,000

E) Automobile Liability insurance is a combined single limit of $1,000,000 covering owned, non-owned, leased, or hired vehicles for each occurrence for bodily injury or death or persons and/or loss or damage to property.

F) “Dram Shop” or Liquor Law Liability” Insurance (if applicable) – General Aggregate limit as may be required by law but in no event less than $1 Million.

G) Professional Liability/Errors & Omissions/Production Errors & Omissions insurance (if applicable). This is required if there will be filming activities done on the premises.

Please produce the following endorsements:

  • 30 Day Notice of Cancellation all policies
  • The Commercial General Liability and Business Automobile Liability policies shall designate:
  • 550 Madison Fifth, LLC (Landlord), Bank of China, New York Branch, As Administrative Agent on Behalf of All Lenders, its successors and/or assigns, ATIMA, 410 Madison Avenue, New York, NY 10017, 550 MEZZ FUNDING

LLC, as Administrative Agent on behalf of All Lenders under the First Mezzanine Loan Agreement, together with

their respective successors and assigns, and 550 MEZZ FUNDING LLC, as Administrative Agent on behalf of all Lenders under the Second Mezzanine Loan Agreement, together with their respective successors and assigns

and Apollo Global Management are included as additional insured as respects premises located at 550 Madison

Avenue, New York, NY 10022.

  • Sony Corporation of America, and its parents, subsidiaries, divisions and associated and affiliated companies and their respective directors, officers, shareholders, partners, agents, employees, successors, assigns and joint ventures as respects 550 Madison Avenue and GE Management Services Inc. DBA Newmark, Grubb, Knight Frank, as Agent for Sony Corporation of America, as additional insured.

The certificate holder shall be listed as follows:

If there is a separate agreement between a vendor and a Sony Group Company, these building requirements do not reduce the limits stipulated in the contract.

Please note that performances will not be permitted at 550 Madison Avenue until appropriate certificates are received and approved.
