Conditions of Use

Application Submissions All Exhibitors will complete a Submission Form to exhibit and sign the agreement, thus acknowledging acceptance of all the Conditions of Use outlined in this document.

Breach of Agreement The Melbourne Library Service reserves the right to cancel the agreement at any time for any breach to policy or procedure.

Cancellation of bookings Use of the Gallery requires full payment 3 months prior to exhibition opening. The Gallery will invoice the Exhibitor for this payment. Cancellations will incur the following charges: $400 deposit will not be refunded once the exhibition date has been confirmed and payment received.

Cleaning and Departure from the Venue The Exhibitor shall leave the venue and its environment, facilities, goods, equipment and services in a clean, safe and proper condition, as at the commencement of the hiring, in all respects to the satisfaction of the Exhibition Team. The Exhibitor will remove all goods and equipment brought in by the Exhibitor, in accordance with any direction of the Exhibition Team. Should the Exhibition Team determine that the Gallery is not left to the standard required, then an external company will be contracted to clean the hired space. This cost will be at the Exhibitor’s cost and the Exhibitor will be invoiced.

Complying with Conditions of Use The Exhibitor agrees that all persons engaged or employed by the Exhibitor in connection with the gallery hiring shall comply with the provisions of these Conditions of Use, and theExhibitor agrees to accept responsibility for any failure on the part of their agents, employees and contractors to observe and comply with these provisions.

Copyright The Exhibitor will not infringe or breach any copyright, performing right or other protectedright involved in the hiring and shall indemnify the Gallery against all claims, demands oractions arising from any such infringement or breach.

Damage/Repairs Restoring the gallery space to the original condition is the responsibility of the Exhibitor. Melbourne Library Service is responsible for supplying equipment and materials to enable the space to be returned to the original condition. The Exhibitor is responsible for any damages suffered to the gallery by their associated agents, employees, contractors and invitees and will be required to report and repair all damage. Costs incurred by the Gallery to repair damages will be invoiced to the Exhibitor.

Deposit In order to secure your booking a deposit of $400 must be paid. This deposit is non-refundable. Once this deposit has been received exhibition dates will be considered final and no change of date will be possible.

Display of Material Material may only be displayed in the Gallery space, on the projection wall and in the display niches throughout the library. The Exhibition Team can offer advice on the best way to display material.

General (G) Classification The gallery is in the public arena and there is no barrier between artworks and library patrons. Because of this, artworks must fit into a General (G) Classification as per the Australian Classification system which defines this as: ‘The content is very mild in impact. The G classification is suitable for everyone. G products may contain classifiable elements such as language and themes that are very mild in impact.’ The Exhibition Team reserves the right to remove material which does not fit this definition.

Hours of Use The gallery hours of use are the same as those of City Library. The gallery’s advertised hours of opening are:
Monday to Thursday 8am to 8pm
Friday 8am to 6pm
Saturday 10am to 5pm
Sunday 12pm to 5pm

Installation/de-installation Dates for installation and de-installation are to be established by the Exhibitor in consultation with the Exhibition Team. Installations and de-installations are to be completed during working hours. Exhibitors are given one (1) day to install and de-install unless otherwise stipulated.

Insurance The Exhibitor will be responsible for all insurance requirements. Whilst all care will be taken, Melbourne Library Service will not be responsible for any loss or damage sustained to any item/s during the time they are on display at City Library. Melbourne Library Service will not accept any responsibility for items while they are in transit to or from the City Library building.

Occupation Health and Safety Exhibitors are responsible for ensuring that they abide by Occupational Health & Safety guidelines at all times in the gallery. Exhibitors are responsible for ensuring that the installation/de-installation is not hazardous to members of the public, themselves or staff. Any hazard, incident or injury to people should be reported to City Library staff immediately. Any hazard or damage to property should be reported to City Library staff immediately.

Official Opening Exhibitors are encouraged to host an official opening. Opening events must be held on a Thursday evening when a member of the Exhibition Team can provide technical support. The library service will provide microphone, amplifier, glasses and tables for the event. Exhibitors must supply catering and be responsible for serving food and liquor. Musical entertainment can be included in the program, however it cannot be amplified beyond 4.

Open Flame and Prohibited Substances The Exhibitor will not bring or permit any open flame (including lit candles), explosive, ammunition, firearm or flammable liquid or substance or any dangerous weapon to be brought into or used in the gallery.

Photography, Broadcasting, Film and Television Recording Any intention to photograph, broadcast, televise or record any activity within the Gallerythat is used in a public domain will be entirely at the discretion of the Melbourne Library Service staff.

Product Sales Melbourne Library Service will not act as an agent of sale for artworks nor will it charge commission from the sale of artworks. Any transactions must be handled directly between the exhibitor and buyer. Exhibitors are asked to provide a price list, complete with contact details. These will be made available to interested parties.

Prohibition of Assignment The Exhibitor shall not transfer, assign, sub-let or sub-hire their rights under the Hire of Gallery Space Agreement.

Publicity Please note that any publicity produced or distributed by the Exhibitor, must not state or imply that Melbourne Library Service is responsible for the Exhibitor’s event or program - other than as the location and provider of the venue for these external activities, unless by specific agreement with Melbourne Library Service. All advertising materials produced by the Exhibitor to promote their function at the Gallery must be approved by the Exhibition Team prior to publication.
