The personal data exemption
In respect of the request, exempt under section 40 of the Act, by virtue of Section 40(5)(b)(i) the duty to confirm or deny,
(a) does not arise in relation to information which is (or if it were held by the public authority would be) exempt information by virtue of subsection (1), and
(b) does not arise in relation to other information which is exempt information by virtue of subsection (2), namely if or to the extent that either: - (i) the giving to a member of the public of the confirmation or denial that would have to be given to comply with section 1(1)(a) would (apart from this Act) contravene any of the data protection principles or section 10 data Protection Act 1998 or would do so if the exemptions in section 33A of the Act were disregarded, or (ii) by virtue of any provision of Part IV of the Data Protection Act 1998 the information is exempt from section 7(1)(a) of that Act (subject access provisions). / Merseyside Police came into existence on 1st April 1974.

Section 31(1)
Law Enforcement / The public will clearly be interested in cases of homicide and will be keen to know as much details as they can find.
Police Forces nationally will provide some information at the time the offence comes to attention in order to locate as many witness who can assist in the investigation. / Information recorded in respect of crime is of a type that will generally not be made public in any great detail until the investigation is concluded. In cases of homicide and other serious crime, the senior investigating officer will make appropriate releases of information to the media in order that potential witness can contact police with what they know. Equally provision of information can act as reassurance to the public, both aspects being in the public interest as regards disclosure of information.
It is not however in the public interest that detailed information is disclosed as to do so undermines the ability of the investigator to test evidence which comes to police attention either from person stating that they are witnesses or from persons dealt with as potential suspects. Where what might appear to be insignificant information, but is actually a detailed piece of information known only to a limited number of people is given wide public disclosure through an FOI application, the ability to properly test and assess the information together with the reason why the person knows that information is frustrated. This is now likely to be the case with the current investigation in relation to the murders caused in the explosion in the Greater Manchester Police area, where scene information has been disclosed in foreign media outlets and then reproduced by U.K. media sources. In any live and current investigation it is of great importance that such detailed information is not broadcast. Where the case is older and has been classified as a cold case, it is of equal importance that investigators are still able to similarly test detailed evidence. Over time most people will forget information that they have not had personal involvement with and has only come to their attention via a media report or a Freedom of Information application published to the ‘world at large’. It is not therefore appropriate to make detailed disclosures, just because the case is not a new case. All cold cases are subject to review and therefore it is contrary to the public and the effective use of police resources to provide detailed information that the public at large would not know, which can include previous address and the other information requested at application about arrests.
Section 40(5)
Personal Data / This exemption does not require a public interest test. / The neither confirm nor deny response supports the policing function for the reason outlined above and this response is made in accordance with the Information Commissioners advice in Decision Notice 50169737

Decision: / When balancing the public interest it is necessary to consider the release of the requested information into the public domain. The public interest is not what interests the public, but what would be of tangible benefit to the public as a whole.
As indicated above, all undetected cases of homicide are subject to review and are never just filed away and forgotten. It is therefore important that the ability of investigators to be able to appropriately review the case evidence and deal with new evidence is not compromised by inappropriate disclosures under the Freedom of Information Act. Media disclosures are managed by the Senior Investigating Officer in a manner that assists the particular investigation.
Individuals who have been interviewed or arrested in connection with criminal matters, especially as serious as murder would not expect their personal data to be placed in the public domain by means of an FOI response. A disclosure which either stated that a person had been arrest or that no persons had been arrested are both disclosures of information and the Information Commissioner’s guidance requires that such case be exempt under section 40(5).
It is the view of Merseyside Police that the information exempt under the provisions of section 31 will not be disclosed by means of a Freedom of Information application. Where disclosure in respect of more recent cases of homicide have occurred appropriate media releases have been made and with recent cases, members of the media are entitled to seek any further information which can be disclosed, by use of established media contact with the Force.
The decision therefore is that the information exempt which relates to a description of the offence and whether any person had been arrested, in this application, will not be disclosed by means of a Freedom of Information application. .
