FREEDOM OF INFORMATION REQUEST 267997
Thank you for your recent request received24 July 2013and actioned under the Freedom of Information Act 2000 (FOIA) in which you requested the following information:
- Can you please supply details of any and all reports of fly tipping (or similar incidents) reported for the area surrounding the junction of Caryl Street and Grafton Grove in Liverpool. In this information I would like the location of the material in question, the date it was first reported, the date it was cleared, any information relating to health hazards or problems, and any information relating to the person/organisation tipping the material, if it is known.
Ideally I would like information for any such reports in an area bounded by Park Street (between Sefton Street and Mill Street), Mill Street, Sefton Street, and Harlow Street (and continuing along the line of Harlow Street until it reaches Sefton Street). For the avoidance of doubt, this area is to the south of Liverpool city centre.
Please supply information running back as far as possible while remaining within the statutory cost limit for such a request. I am aware that some information may need to be redacted, such as information that would allow the identification of a specific individual or company that was suspected but not proven to have tipped material - in this event please redact the information and supply it in such a format.
Please supply information for the last 12 months. I understand that this information will be held in a spreadsheet with a number of headings - I do not wish to know the reporting person/organisations name, address, postcode, telephone number or other information, a breakdown of private individual and other as the reporter would be sufficient.
RESPONSE:
I can confirm that Liverpool City Council holds the requested information but is unable to provide all of it in accordance with the following:
Please see the attached table which lists all fly tipping type enquiries received between 26 July 2012 and 25 July 2013.
Note that we have redacted from the attachedthe names, addressesand any personal data of specific individuals as this is personal identifiable information as defined by the Data Protection Act 1998 and as such is exempt from disclosure by virtue of sections 40(2)(b) and 40(3)(a)(i) of the Freedom of Information Act.
The release of the information into the public domain would constitute an actionable breach of the Data Protection Act 1998, and has therefore been redacted.
As we have not provided all of the information you have requested under sections 40(2)(b) and 40(3)(a)(i) we are required to serve you with a section 17 notice, please treat this letter as notice.
Section 17:
The City Council will consider appeals, referrals or complaints in respect of your Freedom of Information Act 2000 requests and you must submit these in writing to within 28 days of receiving your response.
The matter will be dealt with by an officer who was not previously involved with the response and we will look to provide a response within 28 working days.
If you remain dissatisfied you may also apply to the Information Commissioner for a decision about whether the request for information has been dealt with in accordance with the Freedom of Information Act 2000.
