The Franklin County Commissioners’ Court met in Regular Session March 26, 2012 at 9:00 AM at City Hall located at 109 North Kaufman Street, Mount Vernon, Texas

Judge Lovier called the meeting to order and offered prayer.

APPROVE THE MINUTES FROM THE FEBRUARY 27 AND MARCH 12, 2012 REGULAR SESSION AND MARCH 16, 2012 SPECIAL SESSION – COUNTY CLERK Commissioner Surratt made a motion to approve the minutes from the February 27 and March 12, 2012 Regular Sessions and the March 16, 2012 Special Session and Commissioner Chitsey seconded the motion. Motion carried.

AUDIT CLAIMS AGAINST THE COUNTY AND AUTHORIZE THEIR PAYMENT – TREASURER - Commissioner Carr made a motion to approve all the claims against the county including claims from Bogue Electric ($) and Contech ($) and Commissioner Young seconded the motion and the motion carried. See Vol. 1R Page ______

PRESENTATION BY BOY SCOUTS CONCERNING PROJECTS AT THE FRANKLIN COUNTY SPORTS COMPLEX – PRECINCT 1 – Morgan Taylor from Boy Scout Troup 271 from Mount Vernon made a presentation of his Eagle Scout project of the Memorial Park at the Franklin County Sports Complex. He displayed a map with the project information and explained what he plans do to create the Memorial Park.

CONSIDER AND TAKE ACTION ON RECORDING CONTINUING EDUCATION CERTIFICATES FOR COMMISSIONER DANNY CHITSEY, COMMISSIONER DONNIE SURRATT AND COMMISSIONER SAM YOUNG - TREASURER – Treasurer Betty Sue Allen presented Commissioner Chitsey and Commissioner Surratt’s 2011 continuing education certificates of completion. Commissioner Young made a motion to accept Commissioner Chitsey and Surratt’s Continuing Education Certificates of completion for 2011 and Commissioner Surratt seconded the motion. Motion carried.

CONSIDER AND TAKE ACTION ON APROVING MRS. KAY BOLIN AS DEMOCRATIC PRECINCT 201 JUDGE AND MS. STACY CORRY AS DEMOCRATIC PRECINCT 402 JUDGE – COUNTY CLERK – County Clerk Betty Crane presented a list of election judges to the Commissioners and noted two new democratic election judges for precincts 201 and 402. Mrs. Kay Bolin has accepted the Democratic Judge position in Precinct 201 and Stacy Corry had accepted the position in Precinct 402. Commissioner Surratt made a motion to approve Kay Bolin as Precinct 201 Democratic Election Judge and Stacy Correy as Precinct 402 Democratic Election Judge. Commissioner Chitsey seconded the motion and the motion carried.

CONSIDER AND TAKE ACTION ON APPROVING PETITION FOR DEDICATION AND ACCEPTANCE OF PLEASANT VIEW ROAD AS FRANKLIN COUNTY PUBLIC ROAD – B. F. HICKS – After much discussion, Commissioner Carr made a motion to table approving the petition for the dedication and acceptance of Pleasant View Road as a Franklin County road until 50% of the homes were built and sold on the road and Commissioner Surratt seconded the motion. Motion carried.

CONSIDER AND TAKE ACTION ON ADOPTING AGREEMENT WITH FRANKLIN COUNTY BASEBALL ASSOCIATION FOR USE OF FRANKLIN COUNTY SPORTS COMPLES – PRECINCT 3 – Commissioner Carr made a motion to table this item and schedule a workshop to be held on April 2, 2012 at 8AM at the East Annex and Commissioner Chitsey seconded the motion. CONSIDER AND TAKE ACTION ON RULES AND REGULATIONS OF FRANKLIN COUNTY SPORTS COMPLEX – PRECINCT 3 - Commissioner Carr made a motion to table this item and schedule a workshop to be held on April 2, 2012 at 8AM at the East Annex and Commissioner Chitsey seconded the motion. Motion carried.

CONSIDER AND TAKE ACTION ON APPROVING RESOLUTION ACKNOWLEDGING SWANNERLAND DRIVE AS PRIVATE ROAD IN FRANKLIN COUNTY, TEXAS – PRECINCT 4 – Commissioner Young explained the reason we need to acknowledge Swannerland Drive as a private road in a private development is for an emergency sign. Commissioner Young made a motion to approve the Resolution acknowledging Swannerland Drive as a private road in Franklin County and Commissioner Surratt seconded the motion. Motion carried.

CONSIDER AND TAKE ACTION ON ADVERTISING FOR BIDS PRIOR TO APPROVING OIL, GAS, AND MINERAL LEASE FROM FRANKLIN COUNTY TO FAIR OIL, LTD – COUNTY ATTORNEY – Commissioner Carr made a motion to approve advertising for bids prior to approving an Oil, Gas and Mineral Lease on Dunlap Street containing 0.331 acres from Franklin County To Fair Oil, LTD and Commissioner Young seconded the motion. CONSIDER AND TAKE ACTION ON APPROVING CONSTABLE’S SALE OF DRUG DOG TO THE CITY OF NAPLES FOR $3,500.00 AND ENTERING INTO ONE YEAR PROMISSORY NOTE WITH PROCEEDS TO BE DEPOSITED BACK INTO THE CONSTABLE’S FORFEITURE FUND – COUNTY ATTORNEY – Commissioner Young made a motion to approve the Constable’s sale of a drug dog to the City of Naples in the amount of $3,500.00 and enter into a one year promissory note with the proceeds to be deposited back into the Constable’s Forfeiture Fund and Commissioner Chitsey seconded the motion. Motion carried.

CONSIDER AND TAKE ACTION ON APPROVING CONSTABLE’S SALE OF DRUG DOG TO THE CITY OF WINFIELD FOR $4,500.00 WITH PROCEEDS TO BE DEPOSITED BACK INTO CONSTABLE’S FORFEITURE FUND – COUNTY ATTORNEY – Commissioner Young made a motion to approve the Constable’ sale of a drug dog to the City of Winfield for $4,500.00 with the proceeds to be deposited back into the Constable’s Forfeiture Fund and Commissioner Chitsey seconded the motion. Motion carried.

DISCUSSION ITEMS: Commissioner Surratt reported County Line Road (2130) was closed because a culvert was out. The Commissioners reported the electrical work had been done in preparation for KiteFest and Commissioner Carr questioned if there was a policy with the Airport Board who mows around the hangers. It was suggested to contact the Airport Board and ask if they had someone in charge. Bob Stinson gave an update on the NETO building. Gerry Allen reminded everyone effective January 1, 2013 all county radios have to be narrow band compliant. He reported he had applied for the frequency.

Commissioner Surratt made a motion to adjourn the meeting and Commissioner Young seconded the motion. Motion carried.
