Mr. JOSÉ REGIDOR GARCÍA, Rector of the UNIVERSIDAD DELAS PALMAS DE GRAN CANARIA (ULPGC), with the fiscal identification number Q3518001 G and established in C/ Juan de Quesada, 30 inLas Palmas de Gran Canaria, Spain, by virtue of the power bestowed upon him by the articles 81, 84 a) and 149 of the statutes of the ULPGC as approved by the Decreto 30/2003, issued by the Government of the Canary Islands on the 10th of March,

AND

Mr./Ms.…………………… in his/her capacity as …(position)… of the……(University of)……with fiscal identification code ………… and registered office in ………………, acting on behalf of the aforementioned institution, declares to be duly empowered by……(indicate the corresponding legal instrument)…. to formally grant the present Agreement.

The parties, acting in accordance with their position, mutually and reciprocally acknowledge that they are legally empowered to formally grant the present Agreement and, to such effect

HEREBY AGREE

  1. The parties desire to enrich their respective teaching and research programmes and to strengthen and expand the mutual contacts between both universities. In order to achieve these goals the parties wish to promote the exchange of students between both universities.
  1. The parties signed a Framework Agreement on (date) for the development of mutual academic and research programmes.
  1. Taking into account the aforementioned, the parties manifest their will to execute the present Student ExchangeAgreement and

IT IS HEREBY AGREED

FIRST: The objectives

The present agreement aims to establish the framework for the cooperation between (Name of the institution, body or organization)and the ULPGCto regulate and enhance the exchange of students.

SECOND: Terms and conditions of the student exchange

  1. Within the framework of this exchange agreement, “home university” will refer to the institution in which a student is formally enrolled as a degree candidate, and “host university” will refer to the institution that has agreed to receive students from the home institution for a period of study on a non-degree basis.
  1. The purpose of each student exchange will be to enable students to take lessons but not with the aim of obtaining a degree at the host institution. Courses passed at the host institution will be accepted by the home institutionand will be granted academic recognition by the candidate’s home institution. It will be the responsibility of each participant in the student exchange programme to establish the terms of such academic recognition according to the rules applicable to such procedure.

An exchange student shall not change his/her status to that of a regular student at the host institution, nor will he/she be allowed to obtain a diploma, or any other academic certificate issued by the host institution.

  1. Both institutions agree to accept up to a maximum of (number of students) students from the other institution per academic year, except when expressly agreed otherwise. The period of exchange will be from … to … and the areas of study concerned will be (specify areas of study).

The number of students involved, theduration of exchange and areas of study concerned may be subject to yearly modifications depending on the parties’ interests.

Parity in number of exchange students is the objective of the agreement.

  1. The Academic year at the ULPGC extends from September to January(semester 1), andFebruary to June (semester 2).

Exams periods are: January-February for semester 1 / June-July for Semester 2.

The Academic year at the University of … extends from … to … (semester 1) … and … to … (semester 2).

  1. The host institution reserves the right to exclude students from restricted enrolment programmes including programmes at masters´ level.
  1. The home institution will provide the host institution with the learning agreement of the exchange students prior to their enrolment at the host institution and not later thantwo months before the beginning of the exchange period.
  1. Both institutions agree to provide each other and to the student involved, a transcript of records at the end of the period of study, giving details of the courses studied, grades and credits awarded. Successive transcriptions will be provided after the payment of the corresponding fee.
  1. Under this agreement the enrolment of students at the host institution is limited to one academic year. This does not preclude that a student may later apply to the host institution for admission outside this exchange programme (i.e., under the general and regular conditionsdetermined in the 7thclause of the present Agreement).
  1. The parties shall exchange regularly and punctually their respective college bulletins and other information pertaining to courses/programmes and registration.
  1. The obligations of each institution under this agreement are limited to the exchange of students and do not extend to partners or subordinate institutions.
  1. Participants in the exchange programmes will be governed by the same regulations and performance standards that pertain to other students at the host university.
  1. The home institution will determine and guarantee sufficient language skillsrequiredfromits students.

THIRD: Students responsibilities and expenses

  1. The exchange students will be responsible for the following:

- To return to the home University after 1 semester or 1 academic year of study,unless both universities approve an extended stay.

-To cover incidental expenses as may be required by the study programme.

-To cover the costs of transportation to and from the host institution:

-To cover accommodation and maintenance expenses (including application fee for accommodation where appropriate).

-Medical/Accident insurance.

-Textbooks, clothing and other daily personal expenses

-To cover Passport and visa costs.

-To cover any other expenses incurred during the exchange period.

  1. The parties will require participating students to register at their home institution and pay all academic fees and tuition to their home institution. No tuition payments will be required of exchange students at the host institution, nor will they be required to pay for administrative costs.
  1. Participants will be required to meet any necessary requirements to obtain a student visa in the host country. Students hosted by ULPGC coming fromUniversity (Name of International University)will need to provide documentationwhich proves they have sufficient financial resources to cover the costs derived from the period of stay, as stipulated in therelevant Spanish legislation.
  1. The host institution agrees to provide assistance in arranging accommodation in the residence halls or off campus, as appropriate.
  1. Before registering for courses, all participating exchange students will be required to apply for adequate health/medical and accident insurance with minimum coverage standards and to provide proof to the host institution that their insurance will cover the costs of healthcare and accidents during the period of exchange,In the event that students are unable to provide such proof, they will be required to pay for the student health/medical and accident insurance available at the host institution since neither host institution is able nor bound to provide such coverage.

FOURTH: Legal indemnities and policies

  1. No monetary considerationwill be exchanged between the two institutions, nor will there be any indemnities, reimbursements for expenses, or sharing of fees or profits arising from the exchange.
  1. The relationship between the ULPGC and the (University of…..) under this agreement shall be that of independent contractors, and neither party shall be deemed, nor promote itself as being, a partner or agent of the other. Neither the ULPGC nor the(University of…..)shall be liable for acts of the other, nor shall they be liable for the acts of the students participating in the exchange.
  1. The parties agree that no person will be excluded from participating under the terms of this Agreement on grounds of race, colour, national origin, sex or religion.
  1. The parties may change or modify the terms of this Agreement only by written amendment signed by the parties.

FIFTH: The duration of the Agreement

The duration of this agreement will be five years,
and it shall be automatically extended for additional consecutive terms of one year at a time unless one of the participating universities withdraws from the
agreement upon 90 days prior written notice to the other party.

Under all circumstances, when a party wishes to withdraw from this
agreement it will have to submit a written declarationof
withdrawal at least three months before the date on which it intends to make its withdrawal effective. In such cases, both institutions will exchange a
brief report indicating any imbalances in the number of students exchanged and /or reporting on any other issues or problems.

If one party desires to balance the number of students exchanged before
the termination of the agreement, the other party will cooperate in that effort by amending and/or extending this agreement for a period beyond its original date of expiration given mutual consent of both institutions. Termination shall
not affect students already engaged in the programme subject to the present Agreement.

SIXTH: Coordination and administration

Each party to the agreement will appoint an officer who will be responsible for the coordination and administration of the exchange programme.

For the (Name of University), FIRST NAME, LAST NAMEwill serve as Exchange Coordinator.

For the ULPGC, that role will be fulfilled by the Directorsof the International and Institutional Relations Office or the equivalent person in charge.

SEVENTH: Studentsoutside this exchange programme

Any student of both institutions will be able to apply for enrolmentas aninternational student outside this exchange programme. These “Free Mover” students will pay tuition and all fees that are applied to all international students outside this exchange programme. All other academic and non academic rules and regulations that govern exchange students in the host institution will also be applied to “Free Mover” students.

EIGHT: Personal information

Both institutions agree that they will ensure that all student records and personal information are held securely and confidentially and undertake to further ensure that the aforementioned data is not used or disclosed for any purpose other than the administration of the student exchange programme. Both, the ULPGC and the University of …, acknowledge that personal information relating to participating students supplied by their home institution is to be processed by the host institution only in accordance with the terms of this Agreement and otherwise of the express instructions of the home institution and agree that they will take appropriate technical and organisational measures against unlawful or unauthorised processing and accidental loss, destruction or damage of such personal information.

NINTH: Faculty and staff exchange

The exchange of academic and other staff will also bepossiblethrough this agreement. The details of such arrangements will be negotiated at the appropriate time. Furthermore both institutions will strive to develop links between faculties that will lead to the sharing of ideas and, where feasible, research collaboration.

TENTH:Jurisdiction

The undersigning parties agree to refuse to any jurisdiction orfora they may be entitled to and acceptthat any dispute, disagreement, controversy or claim arising from the interpretation, application or execution of this agreementshall be settled by final and binding arbitration by one or more arbitrators appointed by the parties. The parties hereby declare their commitment to abide the arbitraldecision.

ELEVENTH: With respect to collaboration between the parties

The undersigning parties hereby agree to collaborate at all times, in accordance with the principles of good faith and efficiency, to ensure the correct execution of the agreement.

IN WITNESS WHEREOF, in accordance with the provisions established above, the parties have signed this Student ExchangeAgreement inSpanish and English duplicate originals,identical in content and purpose, as of the day, month and year set forthabove.
