The Commission approved the following Pretrial standards revisionat itsJune 30, 2009 meeting. These changes are effective as of that date. The actual revisions in table format are available on an updated Standards Manual on the Florida Accreditation website:

STANDARD CHANGES:

3.08– New Standard - The standard statement is as follows: “A directive establishes procedures for obtaining the services of qualified interpreter(s).” The first Proof of Compliance is “Written directive addressing elements of the standard”. The quantity for initial is “1” and the quantity for Reaccreditation is “1”. The second Proof of Compliance is “Staff interviews”. The quantity for initial is “Sampling” and the quantity for Reaccreditation is “Sampling”.

3.09 – New Standard – The standard statement is as follows: “A directive governs the use of text telephone(s) (TTY) or Telecommunications Relay Services (TRS) telephone and requires staff to utilize whenever there is a need to communicate with a hearing impaired defendant or contact a person for a defendant needing the services of Pretrial.” The first Proof of Compliance is “Written directive addressing elements of the standard”. The quantity for initial is “1” and the quantity for Reaccreditation is “1”. The second Proof of Compliance is “Observation of TTYs”. The quantity for initial is “Obs.” and the quantity for Reaccreditation is “Obs.”.

3.10 – New Standard – The standard statement is as follows: “If the agency uses audiovisual media to communicate required information, closed-captioning or an alternative means of providing the information is available.” The first Proof of Compliance is “Observation of audiovisual media”. The quantity for initial is “Obs.” and the quantity for Reaccreditation is “Obs.”. The second Proof of Compliance is “Observation of closed captioning or alternative means.”. The quantity for initial is “Obs.” and the quantity for Reaccreditation is “Obs.”

3.11 – New Standard – The standard statement is as follows: “If the parent agency has 50 or more employees, an ADA coordinator is designated in accordance with 28 C.F.R. 35.107. The coordinator receives annual training addressing accessibility requirements.” The first Proof of Compliance is “28 C.F.R. 35.107”. The quantity for initial is “1” and the quantity for Reaccreditation is “1”. The second Proof of Compliance is “ADA Coordinator interview”. The third Proof of Compliance is “Documentation of training”. The quantity for initial is “1” and the quantity for Reaccreditation is “3YD”.

New Glossary Term: Periodically: Occurring once within the reaccreditation cycle.

New Glossary Term:Qualified Interpreter: A professional who facilitates communication between deaf and hearing individuals. A qualified interpreter is able to interpret effectively, accurately and impartially both receptively and expressively, using any necessary specialized vocabulary. The qualified interpreter has specialized training in interpreting from one language to another for example, American Sign Language [ASL] to English and English to ASL. Simply knowing both sign language and English does not qualify a person as an interpreter. The role of an interpreter is to accurately convey all messages between the individuals involved in the communication setting.

New Glossary Term: TTY – Text Telephone. A special device that allows people who are deaf, hard of hearing, or speech-impaired to use the telephone to communicate, by allowing them to type messages back and forth to one another instead of talking and listening. A TTY is required at both ends of the conversation in order to communicate.

New Glossary Term: TRS – Telecommunications Relay Services. TRS permits persons with a hearing or speech disability to use the telephone system via a text telephone (TTY) or other device to call persons with or without such disabilities.
