TERMS AND CONDITIONS OF SALE

  1. The General Manager, Rifle Factory, Ishapore, P.O. Ichapur-Nawabganj, Dist. 24-Parganas(N), West Bengal, PIN- 743144, India herein after referred as the ‘Seller’ will accept orders from persons holding valid Arms License under Arms’ Act 1959 and intending to purchase non prohibited Arms manufactured by the seller according to seller’s design and specifications.
  2. Intending purchasers are required to make an application in the format prescribed by the seller and forward the same alongwith a Bank Draft of an amount of Rs. Three Thousand Five Hundred only in favour of ‘The General Manager, Rifle Factory, Ishapore’ drawn on any Scheduled Bank payable at its Kolkata Branch. An attested copy of Arms License indicating N.P.Bore Revolver / 0.22 Inch Revolver in the specified column is also required to be enclosed with the application.
  3. The seller will scrutinise the filled application form on receipt and will intimate the intending purchaser about order acceptance or otherwise. The seller reserves the right to refuse to accept any order without assigning any reason whatsoever without giving any notice. On acceptance of order a serial number of registration will be intimated.
  4. The seller will issue Invoice (Money Advice Letter) to the purchaser, to the extent possible on maturity of his turn, as per registration serial number. The seller however will not have any liability on account of failure to supply in sequence of the serial number of registration.
  5. The initial deposit will be adjusted in the final bills on maturity of the order. In case an individual fails to respond to the Money Advice Letter, a cancellation fee of Rs. 500/- will be charged for cancellation of Order.
  6. The seller reserves the right to sale the Arms out of turn to any Govt. Department/Autonomous Body/Individual as per directives given from time to time by the Chairman, Ordnance Factory Board, Ministry of Defence, Govt. of India at his discretion.
  7. The purchaser is required to effect payment to the seller through crossed Bank Draft in favour of ‘The General Manager, Rifle factory, Ishapore’ drawn on any Nationalised/ scheduled Bank payable at Kolkata for the amount as indicated in Money Advice Letter.
  8. The purchaser has to submit the following documents to the seller before taking delivery of the Arms (i) Original Arms License for 0.22 Inch Revolver / N.P.Bore Revolver valid at the time of delivery of the Revolver and (ii) any other documents as required under the Arms Act 1959 and the Arms Rules 1962.
  9. The purchaser has to return the acceptance note duly filled in, alongwith payment & other specified documents within the period mentioned in Money Advice Letter. Otherwise the order would stand automatically cancelled. However, the seller reserves the right to extend or refuse to extend the above time limit at his discretion.
  10. Price/Duties/Taxes applicable on the date of actual supply will be chargeable. Any increase in Taxes/Duties on fresh imposition effective from a date prior to the date of supply but coming to the notice of the seller at a later date will also be payable by the purchaser within one month of demand.
  11. The place of delivery of the Arms will be at the premises of the Rifle Factory at Ishapore - a suburb of Kolkata situated at a distance of approx. 27 kms from the Sealdah Railway Station. The purchaser will take delivery of the weapon personally from the premises of the factory.
  12. The purchaser will have no claims for any loss or damage purportedly suffered by him due to delay in execution of order.
  13. The seller will have no responsibility or liability for postal delays.
  14. The seller reserves the right to cancel any order without informing the reason to the purchaser and without giving any prior notice. In such event, payment received against the particular order shall be refunded by the seller without any interest thereon.
  15. The seller will not have any liability for compensation/interest on advance or full payment received against the order booked for any reason whatsoever.
  16. If the purchaser finds any defect in the Arms purchased which according to his opinion is due to faulty manufacturing, he should submit the Arms within twelve months of sale to the seller at the factory premises for technical assessment/examination to determine the cause of the defect.
  17. In case the defect according to such assessment is found to be due to manufacturing, seller’s liability will be limited for carrying out necessary repair/ replacement free of cost. Cost of travel/transportation etc. will have to be borne by the purchaser.
  18. If however, the defect is found to be not due to manufacturing, the seller will not have any liability. The purchaser, if he wishes to get the repairs done by the seller, may do so on payment of the cost of such repair.
  19. The purchaser and seller agree to refer all questions and disputes arising in connection with this sale to the sole Arbitrator to be appointed by the Chairman, Ordnance Factory Board, Ministry of Defence, Govt. of India. There shall be no objection even if the Arbitrator, so appointed, is a Govt. Servant. The award of the Arbitrator shall be final and binding on the parties to this order.
  20. Subject as aforesaid, the Arbitration & Conciliation Act 1996 and Rules made thereunder in force shall be deemed to apply to the arbitration proceedings under this clause. The place of arbitration, if any, shall be Kolkata.
  21. However, in case of any dispute through courts, the same will be through Courts at Kolkata only.
  22. The seller reserves the right to alter or modify the above Terms and Conditions/ Procedure at any time without any notice. The purchaser should therefore rely upon the Terms and Conditions actually sent to him with the money advice letter for acceptance.
