Sealed tenders are invited on prescribed Tender Form alongwith EMD of Rs.10,00,000/- (Rs.Tenlac) in the shape of Bank Draft in favour of Punjab State Civil Supplies Corporation Ltd., payable at Chandigarh, from reputed Firms / Companies for Lifting, Processing, Packaging & Transportation of Imported Urd wholefrom any Port in India to the specified godowns of PUNSUP in the State of Punjab.

The Tender Form containing detailed terms & conditions can be had from 'Atta Dal Scheme Branch' of PUNSUP, Regd. Office at Chandigarh or PUNSUP Office at E-4/24, G-2, East Patel Nagar, New Delhi, at a cost of Rs.500/- per Tender Form (non-refundable/non-transferrable)

The tenders will be received on 16.08.2011 at Registered Office of PUNSUP, Chandigarh upto2.30PM to be opened on the same day at 3.00PM by a Departmental Committee in the presence of tenderer(s) who may wish to be present. If 16.08.2011 happens to be a holiday, tenders will be opened on the next working day at the same time. Offers without EMD will be rejected outrightly.

The undersigned reserves the right to reject or accept any or all the tenders without assigning any reasons thereof.

Sir,

  1. I/We hereby submit an EMD of Rs.10 Lac (Rs.Ten Lac) vide Bank Draft No.______Dated______drawn on ______(Bank) in favour of Punjab State Civil Supplies Corporation Ltd., payable at Chandigarh, which will be converted into security deposit without bearing any interest till it is refunded after successful completion of the Contract.
  1. Certified that I/We have my/our own processing / packaging plant/unit.
  1. I/We further undertake to furnish an amount of Rs.10,00,000/- (Rupees Ten Lac Only) as interest free security in favour of PUNSUP, in addition to EMD.
  1. I/We undertake to execute an agreement with PUNSUP within ten working days, failing which PUNSUP can forfeit my/our EMD.
  1. I/We further undertake that in case of any default, PUNSUP can forfeit my/our EMD/Security and can take any legal course of action it deems fit.
  1. I/We have further enclosed self attested copies of Certificates of Sales Tax/VAT Number, CST Number, Service Tax Number, PAN Card, Audited Balance-Sheets for the years 2008-09, 2009-10 and 2010-11 with minimum annual turn-over of Rs.30 Crores for atleast two years in last three years in processing of Pulses & related products. Copies of Income Tax Returns for these years & Food Grain License, if applicable, be also enclosed.
  1. I/We undertake that our firm has not been blacklisted and no proceedings against our firm regarding blacklisting are pending for irregularities anywhere. No FIR/Criminal case has been registered against me/us for any irregularity anywhere.
  1. I/We hereby undertake that I/We will strictly abide by all terms & conditions of tender and I/We shall submit an affidavit to this effect, duly attested.

TENDER TERMS & CONDITIONS OF IMPORTED PULSES

  1. Tenders are to be submitted in sealed cover superscribed "Tender for lifting, processing, packaging & transportation of Imported Pulses" having two sealed envelopes, one for 'Financial Bid' and the other for 'Technical Bid'. Rates shall be mentioned from any Port in India to the specified godowns of PUNSUP in the State of Punjab including lifting, processing, packaging in 1 Kg pack inclusive of all taxes & levies in the "Financial Bid". Other tender documents including EMD shall be submitted in the "Technical Bid". Financial Bids of only those tenderers shall be opened & considered who qualify in the Technical Bid.
  1. Tender must be accompanied by an earnest money of Rs.10.00 lac (Rs.Ten Lac) in the shape of Demand Draft drawn on any Scheduled Bank in favour of PUNJAB STATE CIVIL SUPPLIES CORPORATION LIMITED payable at Chandigarh, which will be converted into security deposit. Tenders without earnest money and conditional tenders will not be entertained and rejected straightway.
  1. The Contractor shall lift the imported Urd Whole from any Port in India from a specified Public Sector Undertakings such as MMTC, STC, NAFED, NCCF, PEC etc and to process the same, as per PFA Act specifications. Contractor shall pack it in 1 Kg. packs of Low Density Polyster Laminated Pack and transport it with master packing of HDPE Bags containing 25 packets each to the specified godowns/ PD Centres of PUNSUP in the entire State of Punjab.
  1. Tenderers / Contractors must have their own processing / packaging plants / units.
  1. The tenderers must have prior experience in processing, packaging & transportation of pulses and their further supplies to Central Government/State Government Departments or Public Sector Undertakings and the total business conducted with Govt./PSUs must not be less than Rs. 10 Crore per annum. A proof in support of this must be submitted with the tender document.
  1. The moisture content should not exceed more than 12% in Urd Whole.
  1. The Contractor shall be responsible for any legal consequences, which might arise later due to failure of samples of pulses under PFA Act/Rules.
  1. The tenderers should be Income Tax & Service Tax Payees and should attach self attested copies of the PAN Card, VAT Number, CST Number, Service Tax Number, allotted to him/them. The tenderers should also submit copies of Audited Balance-Sheets for the years 2008-09, 2009-10 and 2010-11 with minimum annual turnover of Rs.30 Crores for atleast two years in the last three years in processing of Pulses & related products. Copies of Income Tax Returns & Food Grain License, if applicable, shall also be enclosed.

  1. The rates for Lifting, Processing, Packing & Transportation of Pulses should be quoted on per quintal basis for total lifted quantity from any Port in India to specified Public Distribution Centres/Godowns of PUNSUP in the State of Punjab, inclusive of all levies & taxes.
  1. The Contractor shall deposit the amount of Entry Tax @ 1.1% levied on pulses at entry points of Punjab on behalf of PUNSUP, which will be reimbursed to the Contractor alongwith payment of job work/handling charges.
  1. PUNSUP shall provide Imported Urd Whole to the Contractor at the warehouses / godowns of the specified Public Sector Undertaking or at specified port and shall recover 97% OTR ofUrd Whole. The residual after processing of Urd Whole & empty bags of Imported Pulses will be the property of tenderer. All transit / moisture losses would be borne by tenderer. PUNSUP shall make payment for the total lifted quantity from specified godown / warehouse of PSU from any port in India.The payment for the job work i.e. lifting from any port in India, processing, packaging & transportation shall be made to the Contractor after proper receipt of pulses at specified destinations in Punjab. The unloading charges at godowns shall be paid by PUNSUP.
  1. During the contractual period, the Contractor shall not be allowed any increase in the rates for the lifting, processing, packing and transportation over and above the rates once quoted / negotiated by him/them.
  1. The successful tenderer shall have to execute an agreement with PUNSUP within four working days of finalization of tender.
  1. The Contractor or any person/persons authorized by him/them shall have to take delivery of Pulses from the Port / specified PSU godown on behalf of PUNSUP.
  1. The Contractor shall have to furnish an interest free security of Rs.10,00,000/- (Rs.Tenlac only) in favour of Punjab State Civil Supplies Corporation Ltd., in addition to EMD, which would be returned on successful completion of the Contract.
  1. The delivery of the Pulses would be taken by the Contractor from the specified PSUs; such as MMTC, STC, NAFED, NCCF, PEC etc or any other source chosen by PUNSUP and shall further process & pack it in 1 Kg low density plastic bags, further packed in HDPE bag of 25 packets. The stocks shall then be delivered, to the Incharge(s) of specified PD Centres / godowns of PUNSUP in the State of Punjab against a proper receipt duly signed & stamped by the godownincharge of PUNSUP, as per Districtwise/Centrewise allocation.
  1. The Contractor shall be bound to supply the stocks to the specified centres / godowns of PUNSUP within 18 days of placement of order by PUNSUP.

  1. In case of delay in receipt of pulses beyond 18 days, the liquidity damage @ 2% of the landed cost of unsupplied Pulses will be levied upto one week only and thereafter the security of the Contractor will be forfeited and risk & cost clause will be invoked.
  1. The Contractor shall be responsible for safe and intact delivery of Pulses at the destinations. If any shortage in transit occurs, the recovery on this account will be made from his/their payment at the prevailing market rates or the landed cost of pulses whichever is higher.
  1. The Contractor shall obtain Transit Insurance Policy of pulses from a reputed Insurance Company in favour of PUNSUP. In case of any claim filed under the said policy is not settled by the Insurance Company, the liability thereof shall be that of the Contractor.
  1. In case of non delivery of consignment, either in full or in part, the Contractor shall be liable for making good the loss at the prevailing open market rate. The loss shall be made good from his/their bills/security deposited with PUNSUP. If such bills or security fall short of any loss incurred, the same shall be made good by the contractor within a period of 15 days on demand by PUNSUP failing which the Contractor shall be liable for recovery through legal course.
  1. The Contractor shall furnish the details of dispatches on day-to-day basis indicating quantity dispatched and name of the godown of PUNSUP.
  1. In case of non-availability of the stocks of Pulses with the PSUs, the Contractor shall obtain a Certificate regarding Non-availability of stocks from the specified PSUs i.e. MMTC, STC, NAFED, NCCF, PEC etc. and submit the same to PUNSUP through Fax/E-mail immediately.
  1. Any party, blacklisted or against whom the proceedings regarding blacklisting have been initiated by any Government Department / Organization or a Criminal Case/FIR is registered regarding irregularities or misappropriation or violation is not eligible to participate in the tender process.
  1. The payment to the Contractor for lifting, processing, packaging & transportation will be centralized and shall be released at the approved rate from the Registered Office of PUNSUP on submitting the complete documents/receipts of the consignment from the destinations/godowns of PUNSUP.
  1. The Contractor shall arrange the bills viz. Invoice / Challan / Release Order / Bills issued by the Public Sector Undertaking alongwith their own Challan and lorry/goods receipts while claiming the payment from PUNSUP.
  1. Income tax, TDS and other statutory levies relating to job work shall be on account of Contractor and will be deducted from his/their bills at the time of making payment. All issues connected with Service Tax, if any, shall be the sole responsibility

of the Contractor. VAT shall be paid by the Contractor on behalf of PUNSUP, levied by State Government at the entry points of Punjab, which will be reimbursed by PUNSUP while making payment of job work to the Contractor.

  1. The Contractor shall be responsible to transport all goods from the specified Port / PSU premises to the specified destinations allotted by PUNSUP in the State of Punjab on the approved rates during the contractual period. Any non performance will be treated as breach of contract and in such cases security will be forfeited.
  1. The Managing Director PUNSUP or any person authorized by him shall have the right to enter the office/premises of the Contractor for the purpose of inspecting the stocks and records being maintained for the lifting, processing, packaging & transportation of Urd Whole.
  1. Each tender shall be accompanied by a "Declaration Certificate" duly signed, as per enclosed specimen, without which no tender will be accepted. The person/persons signing the certificate of declaration should produce written proof of having authority to sign the documents from Proprietor/ Firms/ Companies.
  1. The Managing Director, PUNSUP has the right to reject or accept any or all the tenders without assigning any reason thereof. Further, the Managing Director also has the right to cancel the existing contract or relax any terms and conditions of the contract at any time without assigning any reason in the interest of PUNSUP.
  1. The period of contract shall be for six months commencing from the date of award and shall be further extendable as per mutual consent of both the parties.
  1. The Contractor shall be responsible for any loss occurred to life or property during the course of operation which may arise under the vicarious liabilities like Workman Compensation Act etc. The Contractor shall also be responsible for all damages/losses, direct or indirect for the performance of contract during the contractual period.
  1. PUNSUP does not guarantee any volume of work under contract. It shall be the sole prerogative of the Managing Director, PUNSUP to increase / decrease the quantity of Pulses as may be deemed necessary in the interest of PUNSUP.
  1. In case the Contractor declines or neglects to perform the contract or delays the dispatches or furnishes incorrect information, without prejudice to any action that may be taken under the foregoing clauses, the Managing Director has the right to :-

(i)Get the work done from any other source at the risk and cost of the Contractor

(ii)Forfeit the Security in part or full as deemed fit.

(iii)Cancel the Contract.

  1. In case of any dispute or difference arising out of this tender, the same will be referred for arbitration of the Managing Director, PUNSUP or any person nominated by him, whose decision shall be final and binding on both the parties.
  1. For all issues of law or suits arising out from this contract or the subject matter thereof, the jurisdiction of Chandigarh Courts shall prevail.
  1. Force Majeure Clause shall apply to the provisions of this Contract.
  1. Declaration/Acceptance
