Thank you for your email of 13 March, to the Ministry of Justice about Judge Ian Gillespie’s interpretation of UK Law. The Justice Secretary’s Office has passed this matter to the Complaints, Correspondence and Litigation Team (CCLT) to deal with. I can assure that this is a normal practice and no discourtesy is intended by this approach.
First and foremost, please accept our sincere apologies for the delay in responding to your letter. I must also explain that the CCLT is responsible for dealing with complaints in relation to any maladministration, that is staff error, that has occurred in the courts and tribunals in England and Wales.
Having read your email, I believe the issues you have raised falls outside the remit of this team as it concerns matters relating to judicial decision. The position with regards to judicial decisions is that no Government Minister or civil servant can intervene in any case that has been the subject of judicial consideration. This because the judiciary are independent and for anyone to do so would be a breach of this fundamental principle.
You may wish to consider taking independent legal advice from your local Citizens Advice Bureau (CAB). The CAB gives free, confidential and impartial advice on a range of matters. Their contact details can be found in the telephone directory or on their website at
