PROPOSED CONSENT USE ON PORTION 4 OF FARM NIEUWE POST EAST NO. 706, DIVISION MALMESBURY

Your application dated 1 August 2017, with reference MAL/10220/AC/RB, regarding the subject refers.

By virtue of the authority that is delegated to the Director: Development Services in terms of Council Decision No. 7.25, dated 13 May 2015, as determined in Section 79(1) of the Swartland Municipal Land Use Planning By-Law (PG 7741 of 3 March 2017), the application for a consent use on a portion of portion 4 of farm Nieuwe Post East no. 706, Division Malmesbury, is approved in terms of Section 70 of the abovementioned By-law, subject to the conditions that:

  1. TOWN PLANNING AND BUILDING CONTROL

a)The consent use authorise a service trade and is restricted to an area of ±14,3ha which entails the buying, storage and selling of bales as presented in this application;

b)Building plans for all new structures and alterations to existing buildingshas to be submitted to the Director: Development Services for consideration and approval;

c)This approval is in terms of section 76(2)(w) of the By-Law valid for a period of 5 years. All conditions of approval must be complied with within the 5 year period and failing to do so will result in this approval expiring;

  1. WATER

a)No municipal drinking water can be provided;

  1. SEWERAGE

a)Sewerage services can only be provided for household sewerage by means of the services vacuum truck;

  1. REFUSE REMOVAL

a)If any of the municipal dumpsites are to be used, prepaid coupons must be obtained from a municipal office and handed in at the dumpsite, prior to the dumping of refuse;

  1. GENERAL

a)It should be noted that this approval does not exempt the applicant from adherence to any and all other legal procedures, applications and/or approvals related to the intended land use, as required by provincial, state, parastatal and other statutory bodies;

b)Cognisance be taken of comments, approvals and conditions issued by the following authorities. The monitoring and enforcement of all conditions imposed remain the responsibility of the competent authority:

  • Western Cape Department : Water & Sanitation, dated 30 August 2017, reference number 16/2/7/G10L/A/8;Telkom, dated 6 March 2017, reference number WWIP_WMY+0558_17;
  • West Coast District Municipality, dated 22 September 2017, reference number 13/2/12/1/4.

Reasons for approval:

  1. The farm is currently utilised for mainly livestock farming and composting. The proposed service trade allows for further diversification of agricultural activities on the farm, optimising on the economic opportunities provided by the farm’s setting. This initiative is supported by the SDF.
  2. No objections were received during the public participation process.
