Meeting

PresidentRick Berry called the FLCA Board ofDirectors meeting to order at6:00 pm andHelen Bradleycalled the roll. Greg Wells was present by phone. The meeting was held in the Community Association Clubhouse.

Member Comments Mr. Ben Joseph addressed the Board concerning the fact that Google Street View of Fawn Lake is now available. Rick Berry will check on opting out of Street View.

Minutes Bill Ross moved, Steve Gressseconded, and the Board unanimously approved the November 14, 2016 Annual Meeting Minutes as edited. Bill Ross motioned, Steve Gress seconded, and the Board unanimously approved the December 5, 2016 Board Meeting Minutes as written.

Committee Reports

ARC Committee. Steve Gress reported that the committee met January 17, 2017 and agreed to continue expanding its education role. Members will be asked to write articles for the Communicator and Broadcasts concerning problems in the community. Shelly Weaver-Phillips was nominated as Chairman and Joan Hamb was nominated as Vice Chairman.

The next meeting is scheduled for February 21, 2017.

Commons Committee.

Bill Ross reported that the committee met January 16, 2017. Phil Deutsch’s application to join the committee was approved.

The committee also recommended changes to the amenity rules and regulations.

The next meeting is scheduled forFebruary 20, 2017.

Community Safety Committee.

Bill Ross reported that the committee met January 16, 2017. Jerry Campane was selected to remain as Chairman and Alan Branfman was selected to remain as Vice Chairman.

Helen Bradley informed the Committee that John Buttner is no longer employed by FLCA and that Theresa Snyder has been appointed Acting Director of Community Safety. Helen Bradley and Theresa Snyder reviewed the incident reports for the past two months. There were no significant incidents that required immediate attention by the Committee.

Chairman Campane expressed a concern that additional lighting might be necessary between the back gate and Fawn Lake Parkway. Helen Bradley reported on traffic monitored on the outbound lane at the construction gate. No significant speeding issues were detected, but that will continue to be monitored.

The next meeting is scheduled for February 20, 2017.

Finance Committee. Bill McGrath reported that the Finance Committee has not met in 2017.

Lake Environment Committee. Bill McGrath reported that the committee met January 16, 2017. David Hammond applied as a new member. Two residents brought up the question of dredging and whether there is a plan to allow dredging. Mr. McGrath noted that no plan has been developed due to permitting problems. The Water Quality Program to monitor biologics and water clarity will continue as it did in 2016. The program to restore the aquatic ecosystem by installing fish habitats under individual docks is continuing. Again this year controlling the Canada geese population by oiling the eggs will be monitored.

Lake Usage Committee (LUC): Bill Gress reported that the committee met December 19, 2016. An update to Lake Usage Regulations will be submitted to the Board of Directors.

The process of boats entering via the Construction gate during off-hours was discussed regarding compliance with registration and quarantine regulations. FLCA staff will look into this process.

Violations Review Panel: Helen Bradley reported that four(4) citations were issued for the December 14, 2016 meeting. All four citations were paid and the meeting was cancelled.

Four (4) citations were issued for the January 11, 2017meeting – two (2) for speeding and two (2)violations to the Declaration: lot maintenance. The 2 for speeding were paid prior to the meeting and the 2 for violation of the Declaration were extended. Therefore, the meeting was cancelled.

For the next meeting on February 8, 2017 six (6) citations are on the agenda – three (3) for speeding,one (1) for reckless driving, and two (2) carried over from the January meeting. All 4 vehicle citations were paid. One Maintenance of Lot citation resident has provided a detailed Plan of Action, leaving one lot maintenance citation to be reviewed by the panel.

ARC New Construction: No report.

Development and Sales: No report.

Asset Management: Steve Gress thanked Greg Wells and NTS for their help in executing the contracts necessary for the FLCC expansion.

Fireworks Committee. No report.

Old Business

New Business:

1. 2017 Chair/Vice Chair election. Helen Bradley moved that the Board accept the committee recommendations as follows:

Safety Committee: Chairman – Jerome Campane and Vice Chairman – Alan Branfman

Compliance Committee: Chairman – Shelley Weaver-Phillips and Vice Chairman – Joan Hamb Commons Committee: Chairman – Skip Gee and Vice Chairman – Steve Schobel

Bill Ross seconded and the recommendations were unanimously approved.

2. Common Area Amenity Rule Changes. The Commons Committee recommended the following changes to the Amenities Rules:

Pool Facility

The pool is open Monday through Sunday, (hours as posted), but may be opened for weekends following Labor Day with limited hours of operation, weather permitting. Such pool openings will be announced on the Community broadcast email. <Delete last sentence in current rules>

Fitness and Weight Rooms

Tennis Courts

Revise heading to read Tennis and Pickleball Courts.

The Community offers two tennis courts adjacent to the beach area and six pickleball courts at the Sports Park.

Dog Park

The Community Dog Park is located at the Sports Park beyond the pavilion and soccer field. The PAWS group is responsible for the management of the Dog Park and membership is required for use. A membership fee is collected for new members and renewing members as well as for guests. Applications are available at the Community Association Clubhouse or by contacting Linda Westerhoff at or Sharilyn Watts at .

Wilderness Trails

The Fawn Lake Wilderness Trails consist of three trails totaling more than 12 miles.

The Board amended the rule to read “totaling more than 12 miles.”

Pole Barn and Fly Fishing Pond

<Replace 2nd sentence with> Garden plots are available to property owners at a cost of $25 per year. Plot maintenance is the responsibility of the owner requesting the plot including fences, stakes or other temporary additions to the plot. The requesting owner is responsible for plot cleanup by the end of the growing season but no later than the end of November. The Pole Barn is also……

Canoe/Kayak Storage

Community Clubhouse Rules and Regulations

<Replace sentence 3 with> Pets are not allowed in the Community Clubhouse or pool area except service animals.

Swimming Pool

Rule #2 All children under the age of 11 must be accompanied by a chaperone age 15 years or older.

Rule #3 Children at the Baby Pool must be supervised by a chaperone age 15 years or older at all times. The Baby Pool is open to children under 7 years of age and to persons with disabilities.

The Board amended this rule by adding the sentence “The Baby Pool is intended for use by persons under the age of 7 and by persons with disabilities.”

Rule #4 Food and drinks are permitted in the pool area provided they are kept out of the pool and away from the edge of the pool. Please help the lifeguards keep our pool area clean by cleaning up your personal litter. Glass containers are not permitted in the pool area at any time.

Rule #5 Alcoholic beverages are not permitted in the pool area.

Rule #7 Individuals requiring the use of personal flotation devices, e.g., water-wings, floaters, life preservers, etc., must be accompanied by and stay within an arms-length of a chaperone at all times.

Rule #8 Lap and exercise swim periods will be declared by the lifeguard staff up to 15 minutes per hour.

The Board amended the rule to read “Lap and exercise swim periods may be declared by the lifeguard staff up to 15 minutes per hour.

Rule #9 Individuals who are not potty trained or are incontinent must wear a swim diaper or appropriate protective swim clothing.

The Board amended the rule to add at the end of the sentence “in the swimming pool, baby pool and hot tub.”

Rule #12 No diving in water less than 6 feet deep except for swim team events.

Rule #15 Replace “30 minutes” with “… the length of time specified under the pool operating agreement after the last….”

Rule #16 Lifeguards have the right to refuse entry to or use of the pool area and pool to anyone who they observe to be intoxicated or otherwise impaired.

Rule #17 Smoking or the use of electronic cigarettes is not permitted within the fenced pool area.

Diving Board Rules

Rule # 2 Divers must dive forward from the front end of the board.

Rule #7 Diving board users must be able to swim to the ladder unassisted by a chaperone or flotation device.

Whirlpool Hot Tub

Rule #1 The whirlpool hot tub is reserved for adults 18 years of age or older for health reasons.

Motioned by Lori Herrera, Seconded by Steve Gress, Vote: Helen Bradley-Yay; others-Nay.

The Board amended the rule to read “The whirlpool hot tub is reserved for individuals 15 years or older for health reasons.”

Amendment was Motioned by Steve Gress, Seconded by Rick Berry, Unanimously approved.

Amended rule was Unanimously approved as amended.

Rule #5 Members assume all liabilities and risks when using the whirlpool hot tub. The whirlpool hot tub should not be used by people with heart conditions, are pregnant or have other medical conditions that preclude use.

Fitness/Weight Room

Rule #2 The rooms are reserved for individuals 16 years of age or older.

The Board amended the rule to read “15 years”.

Dog Park

Rule #2 Individuals 8 years and younger are not allowed for safety reasons. Individuals 9 years of age to 15 years of age must be accompanied by a person 18 years of age or older.

The Board amended the rule to read, “The Association discourages access to the dog park for anyone under the age of 8 years for safety reasons. Individuals under the age of 15 years of age must be accompanied by a person 18 years of age or older.”

Fawn Lake Beach and Pavilion

The beach is located adjacent to the Community Association Clubhouse.

Wilderness Trails – Paved and Natural <repair indentation>

1. Common courtesy should be used while on the trails. Powered vehicles and bicycles should respect the safety and space of pedestrians. Passing vehicles and bicycles should announce their intent to overtake a pedestrian or slower vehicle. Motorbikes are not permitted on the paved trails.

Community Association Clubhouse

<add 3rd paragraph> The main floor of the Community Association Clubhouse is the business center for the Association. Swimwear is not permitted on the main floor of the clubhouse.

The Board amended the rule to read “Swimwear is not permitted inside on the main level of the Clubhouse.”

Pool Facility

The pool area is available to recognized Association groups for private functions after normal pool hours, i.e., 9:00 P.M. – 12:00 mid., and the organizing group is responsible for the added cost of operation. Reservations are made through the Administrative offices to insure the safe operation of the pool during private functions. The organizing group is responsible for decorating, set-up and cleanup immediately after the event. The pool is available until 12:00 midnight on Fridays and Saturdays and 11:00 P.M. on all other nights. No amplification of sound of any type may be played in the general pool area after 10:00 P.M. on Friday and Saturday nights and after 9:00 P.M. on all other nights.

Fawn Lake Streets

<revise 1st sentence> All-terrain vehicles are NOT allowed on Fawn Lake Streets or Common Property.

Motioned by Bill Ross, Seconded by Lori Herrera, Unanimously approved.

3. Lake Usage Regulations Changes. The Lake Usage Committee recommended the following changes to the Lake Usage Regulations:

Section C.2.a(3) change initial registration to “annual registration”

Section C.2.a(4) eliminate entire paragraph (4) and renumber following paragraphs

After discussion centered on the need for yearly proof of liability insurance, Helen Bradley moved that the recommended changes be rejected and the items remain as written. Steve Gress seconded and the Board agreed unanimously.

Section C.2.b Operator Certificate - remove “Please see paragraph above for licensing requirements which may require additional certification documentation be provided to the FLCA office.” Helen Bradley motioned, Rick Berry seconded, and the Board unanimously approved.

Section C.2.b Operator Certificate – Helen Bradley moved that “by guest operator” be removed from the phrase “any penalties and fines incurred by guest operators will be assessed against the registered watercraft owner”because the regulations do not permit guest operators of watercraft. Bill Ross seconded and the changes were unanimously approved.

Section C.3.a Personal Flotation Devices (PFD) – add “current edition” and remove “2003”. Helen Bradley motioned, Rick Berry seconded and the Board unanimously approved the change.

Section C.3.c. Bell, Horn or Whistle – remove “motorized” from the rule, requiring all watercraft to have an effective sound producing device onboard. Helen Bradley motioned, Bill Ross seconded, and the Board unanimously approved.

Section C.3.d. Navigation Lights - remove "motorized" from the rule, requiring all watercraft to display navigation lights between sunset and sunrise and during periods of poor visibility. Helen Bradley motioned, Bill Ross seconded, and the Board unanimously approved.

Section C.5.c Distance – change “50” to “100” feet clearance when referring to a safe distance watercraft must maintain from other watercraft when exceeding five (5) mph. Helen Bradley motioned, Lori Herrera seconded, and the Board unanimously approved the change.

Section C.6.c Recreational Vehicle (RV) Boat Storage and Canoe/Kayak Storage Racks– correct spelling of “recreational” in second line. Helen Bradley motioned, Greg Wells seconded, and the Board unanimously approved the change.

Section C.6.c Canoe and Kayak StorageRacks – the committee recommended allowing waterfront property owners with a dock to store their canoes and kayaks year round on the dock. Helen Bradley motioned, Rick Berry seconded, and the Board voted 4 to 3 to leave the rule as it is, which states that canoes and kayaks may be stored on docks of waterfront properties when not in use between April 1 and November 1. “Yay” votes: Steve Gress, Bill Ross, Bill McGrath; “Nay” votes: Rick Berry, Helen Bradley, Lori Herrera, Greg Wells
