The Faribault County Board of Commissioners met in regular session at the Courthouse in the City of Blue Earth at 9:00 a.m. on January 8, 2008. The following members were present: Butch Erichsrud, Bill Groskreutz, Tom Loveall, Barb Steier, and Tom Warmka Commissioners. Auditor John Thompson and County Attorney Brian Roverud also attended.

Auditor Thompson called for nominations for Chair for the year 2008.

Groskreutz/Loveall motion carried unanimously to nominate Commissioner Steier as Chair for 2008.

Groskreutz/Warmka motion carried unanimously to replace the Faribault County Local Redevelopment Agency board with the Faribault County Economic Development Agency board.

Groskreutz/Warmka motion carried unanimously to approve Resolution 08-CB-01 setting gopher bounty for 2008 at two dollars for each pocket gopher and fifty cents for each striped and grey gopher. Commissioners Erichsrud, Groskreutz, Loveall, Steier, and Warmka voted yes.

R E S O L U T I O N

WHEREAS, Minnesota Statutes, Section 348.12, provides that the County Board of Commissioners may by resolution offer a bounty for the destruction of certain animals;

NOW, THEREFORE, BE IT RESOLVED, that pursuant to said statute, there is paid a bounty of two dollars ($2.00) for each pocket gopher destroyed and fifty cents ($.50) to be paid for each striped and grey gopher destroyed in Faribault County during the year 2008.

Groskreutz/Warmka motion carried unanimously authorizing commissioners, other officials, and the central services director to attend association, region, and district meetings and the NACO conference.

Warmka/Erichsrud motion carried to appropriate $1,000 from general revenue to the agricultural society for 2008 per Minnesota Statute 375.79. Commissioner Loveall abstained because of a conflict of interest.

Warmka/Groskreutz motion carried unanimously to appoint the full board, auditor, assessor, and as voting delegates to the Association of Minnesota Counties with the engineer as alternate.

Loveall/Erichsrud motion carried unanimously to set $30/day per diems for lay committee members and set mileage for employees per the IRS guidelines.

Groskreutz/Warmka motion carried unanimously to approve the following committee appointments:

Don Amundson of Blue Earth and Eugene Paul of Delavan to the Board of Adjustment for a three year terms expiring December 31, 2010.

Robert Wegner of Elmore and Steve Fredrickson of Blue Earth to the Corrections Advisory for a two year terms expiring December 31, 2009.

Vic Blomgren of Winnebago and Clarann Sayre of Blue Earth to the Extension for a three year terms expiring December 31, 2010.

Don Nichol of Kiester to the Housing and Redevelopment Agency for a five year term expiring December 2012.

Maureen Mittelstadt of Blue Earth, Sherwood Krosch of Elmore, and Harold Grabouski, Jr. of Winnebago to the Planning Commission for a three year terms expiring December 31, 2010.

Erichsrud/Loveall motion carried to approve request from M. Purvis to attend a 10-day DARE Officer training in St. Paul; P. Siem to attend a 2-day Public Library convention in Minneapolis. Commissioner Groskreutz voted no.

Loveall/Warmka motion carried unanimously to adopt Resolution 08-CB-02 setting the date of tax forfeited land public sale to January 31, 2008 at 9:00 a.m. Commissioners Erichsrud, Groskreutz, Loveall, Steier, and Warmka voted yes.

R E S O L U T I O N

SETTING DATE OF TAX FORFEITED LAND PUBLIC SALE

BE IT RESOLVED, that all parcels of tax-forfeited land listed on the List of Tax Forfeited Land 2007-1, that is on file with the Faribault County Auditor, be approved and authorization for a public sale of this land be granted, pursuant to M.S. 282.01; that the sale will be held at 9:00 a.m., Wednesday, January 31, 2008, by the Faribault County Auditor in the County Board Room, Faribault County Courthouse, 415 North Main, Blue Earth, MN, for not less than the basic sale price; and that all sales shall be paid in full on that day.

BE IT FURTHER RESOLVED That the conditions and terms of the public sale shall be described in the list contained here-in and approved by the Faribault County Board of Commissioners.

TERMS FOR THE SALE OF TAX-FORFEITED LAND

IN FARIBAULT COUNTY

Public Sales: Basic Sale Price

All parcels are offered at public auction and sold to the highest bidder. The minimum bid acceptable is the basic sale price that is shown on the list of tax-forfeited land. The basic sale price is equal to the appraised value or the appraised value plus any extra charges for special assessments levied after forfeiture and for hazardous waste control. The basic sale price is set to encourage the purchase of parcels and to return them to the tax rolls. Sale prices on forfeited tax parcels are not used to assess the taxable market value of these parcels.

Extra Fees and Costs: In addition to the Basic Sale Price

A 3% surcharge for the state assurance fund, a state deed fee of $25.00, a filing fee of $46.00, and a state deed tax of $1.65 per $500 of the basic sale price or a fraction thereof will be collected at the time of the sale for all parcels sold.

Payment Terms: Cash or good check on day of sale.

Special Assessments: Levied Before Forfeiture

The balance of any special assessments that were levied and canceled at forfeiture and that exceed the amount of the basic sale price may be reassessed by the municipality. These special assessments are shown on the list of tax-forfeited land with a special line entitled “Assessments before Forfeiture”.

Conditions: Restrictions on the Use of Properties

Sales are subject to the following restrictions on the use of the properties:

1.  existing leases,

2.  easements obtained by a governmental subdivision or state agency for a public purpose,

3.  building codes and zoning laws

4.  all sales are final with no refunds or exchanges allowed,

5.  the appraised value does not represent a basis for future taxes.

Title – The buyer will receive a receipt at the time of sale. The Department of Revenue will issue a state quitclaim deed after full payment is made. A state deed has the characteristics of a patent from the State of Minnesota. Questions on a state deed should be addressed to the prospective buyers attorney. All property is sold in “as is” condition.

Public Works Director John McDonald met to discuss office business.

Groskreutz/Erichsrud motion carried unanimously to approve Resolution 08-RB1-03 final payment to Mathiowetz Construction of Sleepy Eye in the amount of $6,337 for project 22-599-96. Commissioners Erichsrud, Groskreutz, Loveall, Steier, and Warmka voted yes.

R E S O L U T I O N

WHEREAS, CP 22-599-96 has in all things been completed, and the County Board being fully advised in the premises,

NOW THEN, BE IT RESOLVED that we do hereby accept said completed project for and in behalf of the County of Faribault and authorize final payment of $6,337 to Mathiowetz Construction of Sleepy Eye.

Warmka/Loveall motion carried unanimously to seek bids for seal coating material.

A construction update was given.

Warmka/Erichsrud motion carried unanimously to set a bid letting for a motor grader on February 13, 2008 at 11:00 a.m.

Pictures of snow plow/truck accident were shown. McDonald asked that the public be made aware of the safety issues when following snow plows.

Erichsrud/Groskreutz motion carried to approve a use deed to the City of Blue Earth for Parcel No. 21.200.7470 for use as a parking lot area. Commissioner Loveall voted no.

Mike Gormley met regarding sheriff business.

Loveall/Warmka motion carried unanimously to approve the purchase of a recorder for the 911 system from MACTEK, Inc. of Apple Valley for $16,764 with additional options of $2,478 for Ani/Ali integration and annual maintenance agreement of $1.900 per year.

Warmka/Loveall motion carried unanimously to approve the Faribault County Law Enforcement Mutual Aid Agreement.

Groskreutz/Warmka motion carried unanimously to approve System Integrator agreement with Alpha Wireless Communications Co. for the acquisition and installation of updated equipment for the Law Enforcement Center.

Discussion was held regarding the DARE program and the need for training.

Mike Kearns of CAM Inc, met with the board to discuss the bid openings for the Law Enforcement Center. Roger Peterson of CAM, Steve Johnson of Vetter-Johnson, and Sheriff Mike Gormley also attended.

Kearns reviewed the bids that were received. Three categories had low bidders that were disqualified due to errors in their bids. The overhead doors and access flooring categories received no bids and will need to be re-let.

Discussion was held on the kitchen equipment bid.

Loveall/Warmka motion carried to accept bids on categories 1 through 28 except category 9 and to re-let categories 10 and 16. Commissioner Groskreutz voted no.

Warmka/Loveall motion carried unanimously to direct the architect to redesign the kitchen equipment category for basic equipment only and to re-let bids.

Groskreutz/Loveall motion carried unanimously to request a 60 day contract extension from Boelter Contract & Design.

Loveall/Groskreutz motion carried unanimously to appoint Don Selvig to Huntly Sewer Service District Board to complete Don Wishman’s term ending December 31, 2010.

Loveall/Erichsrud motion carried unanimously to approve a change order to reduce the amount of the contracts to Gaub, Inc in the amount of $15,000 for liquidated damages for missing contract deadlines.

Warmka/Erichsrud motion carried unanimously to pay bills totaling $285,083.89, which includes the bills paid in the last week of December 2007 as follows:
