Fakes of toys amounting to million CZK at marketplace in Brno

(Brno, August 12, 2015)An extraordinary inspection actionaimed at compliance with the Act on Consumer Protection, sale, offer and storage of goods infringing certain intellectual property rights and inspection of toys was carried out on August 6, 2015, in the marketplace Olomoucká 61 in Brno. CTIA officers inspected 11 stalls and detected 2,960 pieces of counterfeits of toys. The fakes oftoys were labelled especially with the trademarks SpongeBob, My little Pony, Angry birds, Shaun the Sheep, and Ice Age while their price amounted to more than one million CZK calculated in the prices of originals. 23 violations of the Act on Consumer Protection and 3 breaches of the Act No. 22/1997 Coll. were detected.

On Thursday August 6, an extraordinary inspection action was carried out at the market place Olomoucká 61 in Brno. The CTIA focused on compliance with the Act on Consumer Protection, counterfeits and inspection of toys. 11 stalls were inspected at the marketplace and in total 26 violations of the Act on Consumer Protection and other generally binding legal regulations in the surveillance competence of the Czech Trade Inspection Authority were detected.

In total 2,960 pieces of fakes of toys were discovered, namely of the following brands: SpongeBob, My little Pony, Angry birds, Shaun the Sheep, and Ice Age. The total value of the collected goods was 1,024,201 CZK.

Violations of the Act on Consumer Protection were detected most frequently (Act. No. 634/1992 Coll.), namely in 23 cases, including:

Violations of information obligations concerning products were detected within inspections of 3 point of sale;

Consumer was not properly informed about price in 9 cases;

Violations of principles of honest sale was proven in 1 case;

Bill of purchase with all requirements wasn’t issued on consumer’s request in 5 cases;

In 2 cases rights of owners of intellectual property rights were violated.

Inspectors detected three cases of violations of obligations stipulated by the Act on Technical Requirements for Products (Act No. 22/1997 Coll.). In one case, sale of a dangerous product which fails requirements of the above mentioned law was discovered. Further, sale of products that were not equipped with information required by applicable implementing regulations was discovered, respectively they were illegally labelled with the CE marking of conformity.

Children’s umbrella with a whistle was evaluated as dangerous as it didn’t comply with safety requirements of the applicable technical standard (ČSN EN 71-1+A6:2008).It was an automatically opening children’s plastic umbrella with a whistle equipped with a plastic eye through which a string connected the whistle with the umbrella. Expert assessment proved that tips of wire ribs could be easily uncovered, so child’s face could be injured, especially the eyes. Automatic opening increased the risk.

Other flaws included sale of goods without clearly displayed prices, failure to issue bill of purchase and sale of products without obligatory information. Misuse of CE marking was detected concerning the following kitchen equipment: 3 types of trays, reflexive tapes, graters, potato shredders, two types of razor blades and scrapers.

After inspected persons are identified and expert opinions on collected counterfeits are elaborated, administrative proceedings will start concerning amounts of fines as well as confiscation of the goods and their subsequent liquidation.

Inspections of similar focus will continue with regard to the detected flaws.
