DECISION

[1] On 20 December 2016, The Minister administeringthe State Service Act 2000(MASSA)lodgedwith theRegistrar,pursuanttoSection 23(1) oftheIndustrialRelationsAct 1984 (the Act),an applicationto vary the Facilities Attendants(Tasmanian StateService) Award.

[2] Atthehearing inHobarton22December 2016,MsAFarmerappeared onbehalf ofthe MASSAand MsArmstrongappeared on behalf of United Voice,Tasmanian Branch(UV).

[3] MsFarmersought thefollowing variationstotheAward:

a. Part VII -Leave and Holidays with pay - Delete existingclause 4 -bereavementleave- replace with anew Clause4 entitled CompassionateandBereavementLeave;

b. PartVII -LeaveandHolidays with pay -insert new clause8after DefenceForceLeaveclause-FamilyViolenceLeaveclauseto become clause8-incorporatesnew FamilyViolenceLeaveprovisions;

c. PartVII-LeaveandHolidays with pay- Clause2-delete existing clause-Insert new clause -Parental Leave - amendsto reflect new entitlementsforMaternity,Partner andAdoption leave;

d. PartVII -LeaveandHolidays with pay -Delete existingclause3personalleave -insert new clause -Personal Leave -removes references toFamilyViolenceLeave;

e. PartIIsalaries andRelatedMatters -insert new clause -new clause8-higher duties allowance-allows HDAs to be paid-exact wording oftheTSSAprovision.

[4] MsFarmer noted that the changes arose out of the negotiationsrelating to the

2016wageagreements.

[5] Essentially the clauses introduce Compassionate Leave as part of BereavementLeaveentitlementsexpanding the accessofpersons to leave where asignificant otherhasalife threateningillness orinjuryandfor whom the employee isprovidingcare,aseparate provision forFamily ViolenceLeave,anincrease inparental leaveentitlementstogether withancillary amendments toeffectthosevariations.

[6] Inaddition anewHigherDutiesAllowanceclauseincluded.

[7] MsArmstrong commended the variationsto me. In my view the variations areappropriate,especially in relation to the Family Violence clause and the inclusion ofCompassionateLeave

[8] Bothparties submittedthe variations sought donot offend the public interest,donot disadvantage those employees covered by the Award and recommended thevariationstotheCommission

[9]Iamsatisfied that thevariations areinthepublicinterest andthat noemployeesaredisadvantaged.

[10] Theapplication isgranted andpursuant to s24 and 36ofthe Actthe Award isvaried inaccordancewiththeapplication.Thevariations totheawardareoperative from

22December 2016.

[11] Anorderreflectingthisdecisionistofollow.
