Oracle Java EULA
TERMS AND CONDITIONS REGARDING USE OF ORACLE JAVA SOFTWAREThis end user license agreement (“EULA”)governs your use of Oracle Java software, which may include associated media, printed materials, and online or electronic documentation (“Java Software”)that is part of or incorporated into the solutions sold or licensed to you in your agreement withNCR Corporation (“NCR”). NCR does not own the Java Software and is required to inform of you certain limitations applicable to the use of the Java Software. Your right to use the Java Software is subject to following terms and conditions, which NCR does not have authority to vary, alter, or amend. You agree to this EULA by using the Java Software.
To the extent this EULA is inconsistent with the terms and conditions of your agreement with NCR, the terms of this EULA will prevail with respect to the subject matter described herein. These terms do not amend your agreement with NCR as it may apply to other matters.
Oracle Java EULA
1.Scope of Use. Your use of the Java Software will be restricted to the scope of the Application Package and your internal business operations and will be subject to this EULA. You are not permitted to modify the Java Software. You may allow your agents or contractors (including, without limitation, outsourcers) to use the Application Package on your behalf for your internal business operations as described above, subject to this EULA. You are responsible for your agents’, contractors’, outsourcers’, customers’, and suppliers’ use of the Application Package compliance with this EULA. You agree that Oracle will be deemed a third party beneficiary of this end user license agreement. For purposes of this EULA, “Application Package” means the NCR solution, coupled with the Java Software, sold and/or licensed to you under your agreement with NCR.
2.Java Technology Restrictions. You will not create, modify, or change the behavior of classes, interfaces, or subpackages that are in any way identified as “Java”, “Javax”, “Sun” or similar convention as specified by oracle in any naming convention designation.
3. Trademarks and Logos. You acknowledge that Oracle owns the Java trademark and all Java-related trademarks, logos and icons including the Coffee Cup and Duke (“Java Marks”) and you agree to: (a) comply with the Java Trademark Guidelines at (b) not do anything harmful to or inconsistent with Oracle's rights in the Java Marks; and (c) assist Oracle in protecting those rights, including assigning to Oracle any rights acquired by you in any Java Mark.
4. Source Code. The programs may contain source code that, unless expressly licensed for other purposes, is provided solely for reference purposes pursuant to the terms of the end user license agreement.
5. Third Party Code. Additional copyright notices and license terms applicable to portions of the programs are set forth in the THIRDPARTYLICENSEREADME.txt file.
6. Commercial Features. NCR hereby notifies you that use of the Commercial Features for any commercial or production purpose requires a separate license from Oracle. “Commercial Features” means those features identified in Table 1-1 (Commercial Features In Java SE Product Editions) of the program documentation accessible at
7. Business Records. You will permit NCR to audit your use of the Java Software, provide reasonable assistance and access to information in the course of such audit, and report such use to Oracle or permit NCR to assign its right to perform such audit to Oracle. Neither NCR not Oracle will have any responsibility for any of your costs incurred in cooperating with the audit.
