Lead Paint Guidelines
Maryland, Virginia and the District of Columbia
On December 6, 1996 Federal Lead Paint regulations were passed into law. Each jurisdiction has different requirements detailed below.
Regardless of the jurisdiction, any home, townhome, condominium or co-op built before 1978, you are required to provide the “Disclosure of Information on Lead-Based Paint and Lead-Based Paint Hazards” form attached to your lease at the time of the signing of the lease. You must also give your tenants the EPA booklet entitled “Protect Your Family from Lead in Your Home”.
MARYLAND – Properties built before 1978 must be inspected by a Maryland Department of the Environment accredited inspector before each tenant takes occupancy. This had previously effected house built 1950 or before. Your Property Manager has a list of licensed lead paint inspectors and will assist you with this inspection. Remember, each time a new tenant takes occupancy, the property must be re-inspected unless certified by an inspector as “lead free”. The tenant must be given a copy of the inspection report and the property must pass or the owner must remedy any area where lead a paint hazard is found. Tenants are required to receive the pamphlet “Lead Poisoning Prevention, Notice of Tenants’ Rights”. In Montgomery County, a copy of the passing lead test certificate must be provided with the Rental Unit Facility License application.
VIRGINIA - No inspection is required. The Federal Lead Paint Disclosure must be signed by all parties and attached to the Lease. Tenant must be given the EPA booklet entitled “Protect Your Family from Lead in Your Home”. Lead Hazards are required to be removed or covered.
DISTRICT OF COLUMBIA - Lead-Hazard Prevention and Elimination Act of 2008. Both the Federal Lead Disclosure and the DC Lead Disclosure must be presented to the Tenants. If the Tenant is a pregnant woman or the applying party has a child 6 years old or younger, a passing Lead Clearance Report must be obtained and presented to the Tenant prior to lease commencement.
We advise that regardless of your circumstances, if you suspect there may be lead paint in your home, make sure there are no hazards. This will protect your tenant and protect you from any potential claim or lawsuit.
