Permission – carriage of assistance dogs

1. Application

This instrument applies to ***** Airline, ARN ****** (the operator).

2.  Revocation

Instrument ****** is hereby revoked.

3.  Definitions

In this permission:

approved organisation means an assistance dog training organisation which is accepted by the operator, and;

(a)  is accredited by an animal training organisation prescribed by the Disability Discrimination Act 1992 – Section 9, or

(b)  meets or exceeds the minimum standards set by:

i)  Assistance Dogs International in respect of organisations which are eligible to be full members, or

ii)  Queensland Guide Hearing and Assistance Dogs Act 2009.

assistance dogs means a dog that is trained, or being trained, to assist a person with a disability to alleviate the effect of the disability;

handler means the person with a disability other than sight or hearing impairment who relies on the dog;

identity document means a proof of identity document issued by an approved organisation identifying;

(a)  the trainer; or

(b)  the assistance dog

public access test means a test to assess if an assistance dog is safe and effective in a public place or public passenger vehicle and able to be controlled by the handler of the dog;

trainer means a person affiliated with a program as being directly responsible for the training and conduct of an assistance dog in training.

4.  Permission

The operator may carry an assistance dog in the cabin of its aircraft if:

1.  it has been trained and accredited by a foreign assistance dog training organisation which meets or exceeds the minimum standards as set out by Assistance Dogs International for full membership of that organizations or

2.  it has been trained or is being trained as an assistance dog by an approved organisation, and

(a) it has passed a public access test showing it to be suitable for travel on public transport, or

(b) for an assistance dog being trained documentation evidence has been provided from an approved organisation showing it to be suitable for travel on public transport.

5.  Conditions

This permission is subject to the following conditions:

  1. An assistance dog must accompany;

(a)  its handler, or

(b)  its trainer.

  1. If the assistance dog is accompanying its trainer, the operator must be provided with a proof of identity document issued by an approved organisation, identifying that person as an approved trainer.
  2. If the assistance dog is accompanying its handler, that person accompanying the assistance dog must produced to the operator a proof of identity document issued by an approved organisation, showing that the dog has attained the appropriate level of training and/or passed the public access test;
  3. The assistance dog must be placed on a moisture absorbent mat on the floor of the aircraft, as near to the person as practicable;
  4. The assistance dog must be restrained in a way that will prevent the dog from moving from the mat;
  5. The pilot in command must have access to a copy of this permission and must make the final decision as to whether the assistance dog is carried or not. If agreeing that the assistance dog may be carried, the pilot in command may impose any further conditions that he or she requires in the interests of safety.
  6. The operator must ensure that staff associated with the carriage of the dog (including cabin staff operating the flight), are aware of the condition under which the dog is carried.
  7. A list of approved organisations is to be maintained by the operator, and be made available to CASA if requested.

6.  Expiry

This Instrument stops having effect:

(a) at the end of MM/YYYY unless varied suspended or revoked by CASA beforehand.
