TENDER CALL NOTICE

The Director of Agriculture & Food Production, Odisha, Bhubaneswar ( herein after referred to as the Director) invites sealed tender in the prescribed forms from bonafied prospective Manufacturers /Authorised distributor/Dealer/Supplying Agencies/Firms who are able to provide after sales and annual service guarante facilities alongwith supply of genuine spare parts for the different equipments for establishment of Gene Bank having temprature of - 200C for long term preservation of different germplasms at State Seed Testing Laboratory, Bhubaneswar -751002 as mentioned in the Tender schedule. The prescribed Tender Schedule can be obtained from the office of the Seed Certification Officer, State Seed Testing Laboratory, Bhubaneswar -751002 on any working days between 11 AM to 4 PM from 08.12.2014 to 05.01.2015 It can also be downloaded from www.orissa.gov.in or www.agriodisha.org but the cost of tender document of Rs 10,000/- (Rupees ten thousand )+ 5 % VAT should be deposited at Office of the Seed Certification Officer, State Seed Testing Laboratory, Bhubaneswar in shape of Bank draft in favour of the Director of Agriculture & Food Production, Odisha, Bhubaneswar at the time of submission of Tender. Last date of receipt of Tender is 05.01.2015 by 1.00 PM and the tender will be opened on the same day at 4.00 PM by the Tender Committee in the presence of the Tenderers or their authorized representatives in the office of the Director of Agriculture & Food Production, Odisha, Bhubaneswar .

The authority reserves the right to reject any or all the Tenders without assigning any reason thereof

1. SALE OF TENDER PAPER: Prescribed Tender documents may be obtained from the office of the Seed Certification Officer, State Seed Testing Laboratory, Odisha, Bhubaneswar on any working day between 11.00A.M to 4.00 P.M on payment of Rs 10,000/-(Ten thousand) + 5% VAT in shape of crossed Demand draft in favour of the Director of Agriculture & Food Production, Odisha, Bhubaneswar. It can be downloaded from www.orissa.gov.in or www.agriodisha.org but the cost of tender document of Rs.10,000/- (Rupees ten thousand) + 5% VAT will be deposited separately in the office of the Seed Certification Officer, State Seed Testing Laboratory, Samantarapur, Bhubaneswar in shape of crossed Demand Draft in favour of Director of Agriculture & Food Production, Odisha, Bhubaneswar at the time of submission of Tender at Seed Certification Officer, State Seed Testing Laboratory, Bhubaneswar. The Cost of Tender document is non-refundable. Small scale industries units registered with Directorate of Export Promotion and Marketing/District Industries Centers /National Small Scale Industries Corporation, New Delhi will be entitled to get tender papers free of cost for registered item of Gene Bank -200C from State Government and Agencies under its control. Khadi and Village Industries will also be legally be eligible to get tender papers free of cost for these products. The dully filled and sealed tender documents may be dropped at office of the Seed Certification Officer, Samantarapur,Bhubaneswar-751002 on any working day up to 05.01.2015 at 1 P.M. If the tender is sent by Post, care should be taken to send by Registered Post so as to reach this office before closing date and time. This office is not liable in case of loss of tender document or delay in receipt of the same.

2. Document not accompanied with DD will summarily be rejected.

3. The last date of receipt of tender is 05.01.2015 up to 1 PM and will be opened on the same date at 4.00 PM by tender committee in the presence of the Tenders or their authorized representatives in the office of the Director of Agriculture & Food Production, Odisha, Bhubaneswar.

4. The prospective Manufacturers /Authorised distributor/Dealer/Supplying Agencies/Firms having registration certificate, valid manufacturing license, and defined technical source for their product are only eligible to participate in tender process.

5. The tender received beyond the due date and time will be liable for rejection.

6. EMD & Security Deposit:

a) The tenderer shall deposit earnest money of Rs 2,50,000/- (Two lakhs fifty thousand ) only in shape of Demand Draft (original) in favour of the Director of Agriculture & Food Production, Odisha, Bhubaneswar. Payment of Earnest money in any other form will not be accepted. No request for transfer of any previous deposit and adjustment of Earnest money from any claim payable will be entertained. Tenders without E.M.D will not be considered under any circumstances.

b) Small-scale industries registered with the Director Export Promotion and Marketing Odisha/ District Industries Centres /National Small Scale Industries Corporation will be eligible for exemption from payment of E.M.D.in respect of items covered in their certificate of registration for Gene Bank -200C provided that photocopy of the certificate of registration dully attested is submitted along with the tender. Khadi and Village Industries will also be legally eligible to get exemption of EMD for the purpose with same condition.

c) The tender shall not be entitled any interest against the E.M.D.

d) The E.M.D. of successful tender (here in after re-ferred to as the contractor unless repledged to the contract shall be retained for the fulfilment of the contract by the contractor until the contractor furnished security deposit as per the conditions of the contract.

e) The E.M.D. of unsuccessful tenders will be refunded as early as possible after expire of the validity period of tender.

f) In the event the contractor does not furnish the amount of security deposit and in the manner as stipulated as per the conditions of contract fails to execute the agreement within a period of 15 (fifteen) days from the date of issue of letter of acceptance, the E.M.D,shall be absolutely forfeited to the Government of Odisha in respect of the items for which no agreement is executed without prejudice to the right of the Director to such classifications under their terms and conditions.

g) The E.M.D shall also be forfeited under the circumstances indicated in 6(a)

7. RIGHT OF ACCEPTANCE /REJECTION OF TENDER AND AWARD OF CONTRACT.

The right of acceptance of tender/or award of contract rests with Director who does not bind himself to accept the lowest tender and also reserves to himself the right to reject any or all tender(s) receiver without assigning any reasons what so ever.

The right to acceptance of tender and award of contract includes not withstanding anything contained in the tender documents. The right to accept the contact for the tendered quantity between any two or more parties and to increase /decrease the order to increase the tender of and order contract quantity of one or more or all of the articles.

8. VALIDITY OF TENDER

a) All the tender shall remain valid for acceptance up to 31.3.2015 from the date of opening of tenders. If the tender withdraws or amends the offer before expiry of the above period without consent of the Director of Agriculture & Food Production ,Odisha ,Bhubaneswar the earnest money furnished by him/them shall be forfeited in full.

b)  No extension of time shall be allowed for submission of tender in any circumstances unless otherwise specifically extended by the Director by an advertisement in the Newspaper.

9) TENDERERS UNDERSTANDING OF TENDER DOCUMENTS:

The tenderer shall careful go through the tender documents and fully confirm himself as to all the terms and conditions contained herein before submission of the tender. If a tenderer find discrepancies in or omission or should be in doubt as to their meaning should at once notify the director and obtain clarification in writing prior to submission of the tender. Verbal clarification and or information given by Director or the employees working under him or representative shall not be binding on the Director.

10) FINANCIAL CAPABILITY:

The Bidder shall furnish documentary evidence that it meets the following financial requirement.

a) The tender should have minimum Rs. 25 lakh at least 10% of the estimated cost as Average Annual financial turnover during the last 3 years ending 31st March of the Financial year ending on 2014-15.

b) Last three years audited balance sheet/Profit & Loss statement / Income Tax return of the bidder is to be submitted.

11) EXPERIENCE:

a) The manufacturer/ dealer should furnish ISO CERTIFICATE of the OEM regarding Design, manufacture, marketing of GENE BANK/ PLANT GROWTH CHAMBER and its associated equipment for agricultural research.

b) The bidder must have supplied and commissioned at least one module for the same application to any ICAR/SAU/ICRISAT/Government Organization of National or State within the last 5 years. At least one of the aforesaid machine and equipment must have completed minimum two (2) years of service satisfactorily. Documentary evidence in favour of the same is to be submitted.

12) NO CLAIM COMPENSATION FOR SUBMISSION OF TENDER.

No tender shall be entitled to claim any costs charges, expenses of incidental to or incurred by him through in connection of this tender even through the Director may elect to withdraw the invitation to tender without notice and assigning any reason.

INSTRUCTION OF TENDERERS

Submission of documents / particulars etc.

1.  All information in the tender shall be in English, Information in other languages shall be accompanied by translation in English. Failure to comply with this may lead to rejection of the tender.

2.  The tender form shall be filled in clearly typed/written in Block capitals. No tender filled in otherwise shall be considered.

3.  While filling up the tender form the tender shall not erase or overwrite. Any correction of the tender form shall be made clearly and fully signed by the tenderer, otherwise the tender shall be liable to rejection.

4.  The rate should be offered for the unit as specified in the tender schedule, it shall be quoted in Indian currency both in figures and words. The rate shall be inclusive of charges for container, packing etc. For Foreign bidder the rate should be quoted in USD both in figures and words.

5.  One rate shall be offered for one item submission of multiple rates against one item will be considered a demerit. In case those are really different qualities on brand to be offered against one item and all of them at the minimum confirmed to the standard and specifications of the required items more than one rate can be considered. But it is necessary that in such specific Brand make and model etc shall be clearly mentioned.

6.  The tender offered by a Manufacturer of the articles must furnish requisite documentary evidence to the satisfaction of the Director that he is manufacturing those articles. Failure to adhere to the instruction stipulated in Para 5 and 6 the authority is at discretion to retain only the lowest rate if more than two rates offered against any items.

7.  Tenderer having place of business inside the State of Orissa shall quote the basic rate for sale of the articles which shall be inclusive of all taxes i.e. levis duties, Entry tax, VAT, Excise etc. The tenderer must deliver the goods at the concerned Go-down of the consignee free of all expenses.
