Eskom, as a State Owned Enterprise, is supportive of the South African Government’s Growth, poverty eradication and job creation strategy, SDL (Supplier Development and Localization). Eskom's contribution to this initiative is to set local content, Black economic empowerment (BPLD, BYO, BWO and SBE) and skills development targets as part of the evaluation criteria for this tender.
In line with section 217 (2) of the Constitution and section 2 (1) (d) and (e) of the Preferential Procurement Policy Framework Act, 5 of 2000 the following methods of implementation have been developed to ensure that Eskom is able to leverage its procurement spend in support of socio-economic advancement and transformation of the South African economic market:
Objective criteria of tendering
Our objective criterion is as follows:
- Transforming this sector by appointing only Black owned contractorswith cleaning in restricted areas expertise and qualification
- Development of previously disadvantaged small contractors
- Only qualifying contractors located within Mpumalanga Operating Unit will be eligible to tender
To achieve the above criteria, the following aspects will apply:
- First choice of appointment given to 100% Black owned contractors – EME 1 and/or QSE 1.
- Encourage development of skills and jobs local to site
- Encourage subcontracting; and JV’s where the majority partner is 100% Black owned and local to MOU
BBBEE Status Level Certificate
Eskom is expected to do business with BBBEE accredited suppliers and to provide statistics to government in terms of its shareholder compact with government and compliance to PPPFA:
- Contractors are required to submit a valid a sworn affidavit stating their BBBEE status – attached with this tender
- Contractors who do not submit a sworn affidavit, or valid BBBEE certificate as an alternative, will not qualify for preference points and will be classified as non-compliant and may be disqualified for this tender
- However, where Eskom elect to contract with a contractor/s that is not BBBEE compliant, an obligation to submit the said affidavit within a period to be agreed to by the parties should be established in the contract as well as the rights or remedies that Eskom will have in the event that the contractor/s fails to meet such obligation.
SD & L Matrix
The successful contractors are encouraged to assist Eskom in developing skills local to site. The skills candidates shall be graduates from TVET colleges and / or previously disadvantaged universities or matriculants.
The matrix below shall form part of the tender returnable and also part of the contract. The contractors are encouraged to develop skills relevant to this scope of work, and complete the localisation matrix accordingly thereby committing on the intended skills for development pending their successful tendering. The actual commitment will be done at task order level where the contractors will indicate the skill types they intend developing as per the scope of the task order at that stage
The successful contractors will also be expected to commit on the number of new jobs to be created and those to be maintained as a result of this tender
Subcontracting and joint venturing
Subcontracting and/or joint venturing is encouraged where applicable, for enterprise development purpose. Joint venture may only be formed with a 100% Black owned contractor local to site MOU, within Emalahleni zone. The Black JV partner must also be the majority partner in the formed JV thereby making it eligible to be classified as Black owned in terms of Eskom’s requirements.
