AT A GLANCE: TheFlorida Institute ofGovernment at FSUwill be holdingthe F.A.C.E “Legal Issues of Code Enforcement”certification classesinPensacola from March 20 - 24, 2017. The focus of this course is an in-depth look at Chapter 162 and the legal side of your job as a Code Officer. The course covers all the elements of code enforcement work that you use in the field and in the office. Also included are Code Enforcement Board processes; the use of special magistrates; and citations. Knowledge gained in this course will enhance an individual's abilities through further understanding of how his/her job is governed by Florida law.

CLASS and EXAM LOCATION: Allcertification classes, including the required certification exam onMarch 24, 2017, will be held at theEscambia County Central Office Complex. Driving directions will be sent along with confirmation letter once payment is received.

HOW TO REGISTER: You must register and submit payment for the Class andthe Exam separately. The Class Registration Form is included in this announcement and will be sent, along with payment, to the Institute of Government at FSU. The Exam Registration can be found at the following link:

CLASS REGISTRATION: The Classes will be held Monday morning, March 20th through Thursday, March 23rd, 2017(8:00 AM – 5:00 PM CST) and Friday, March 24, 2017from 8:00 AM until 12 Noon(Central Time.) Classfees are$13.00 per hour for members of FACE ($468.00 total) and$17.00 per class hour for non-members ($612.00 total). For Class Registration and payment information, please see attached form.

EXAM REGISTRATION: TheExam will be held on Friday afternoon, March 24, 2017, from 1:30 p.m. – 3:30 p.m. (Central Time). Exam fees are $85.00 for FACE members and $135.00 for non-members, if payment is postmarked two weeks prior to the exam date. (Payment must be received NO LATER than Friday, October 10, 2017!) F.A.C.E. MEMBERSHIP INFO: Membership is $35 for ACTIVE officers (working in codeor with an agency that enforces them) and $25 for ASSOCIATES (students, those retired from F. A. C. IMPORTANT POLICY NOTE: Effective Jan. 1, 2016, no person may attend F.A.C.E. training or take an exam if approved payment has not been made prior to the start of the class or exam.

HOTEL ACCOMMODATIONS: A small blockof rooms has been reserved at the Residence Inn Downtown in Pensacola. To make your hotel reservations, call (850) 432-0202and request the “Code Enforcement Training” government rate of $122 per night as soon as you have been approved to attend the Legal Issues class. This room block and special group rate is expected to sell out quickly(prior to the cut-off date of February 19, 2017.)

ADDITIONAL INFORMATION: Class size for the workshops is limited. Once approved to attend, please FAX or EMAIL your Class Registration Form to us prior to sending payment so that we can reserve your seat! Lunch is NOT included in registration fees. Refreshments will be provided for breaks in the morning and afternoon.

CERTIFICATION: After attending the required 36 class hours, Code Enforcement officers

must successfully pass an examination in order to receive certification in “Legal Issues.” (Formerly called Level III.)

CONFIRMATION OF REGISTRATION: You will receive a confirmation letterupon registration andreceipt of payment for the Legal Issues of Code Enforcement certification CLASS. An additional confirmation letter will be sentupon registration andreceipt of payment for the certification EXAM.

REFUNDS: We can refund CLASS fees, minus a $30 administrative fee, if we receive written notice at least three business days prior to the beginning of the class (no later than Wednesday, March 15, 2017.) Refund requests for the EXAM fees must be made directly to the Florida Institute of Government at UCF.

The modules listed below make up the 36 hours ofcourse work required for the “Legal Issues” certification. A record is kept for each participant by the Florida Institute of Government at UCF. Certificates are awarded upon completion of all 36 class hours ANDpassing of the Legal IssuesCertification Exam. All Classes and Exam are scheduled using CENTRAL TIME ZONE.

CODE ENFORCEMENT BOARD Mon., Mar. 20 (8 AM - 12 PM)

Expansion of Chapter 162's enumeration of the Code Enforcement Board's purpose, organization, appointment, powers, role at the hearings and responsibilities as a quasi-judicial body. (4 hours)

OTHER LEGAL OPTIONS Mon., Mar. 20 (1 PM-5 PM)

Civil and criminal procedures other than the Code Enforcement Board process, including citations, injunctions, public nuisance penalties, and physical arrest. (4 hours)

CASE DEVELOPMENT Tue.,Mar. 21(8 AM-12 PM)

How to investigate and initiate a Code Enforcement case. How to issue a proper Statement of Violation and Notice of Hearing. How to ensure good service of process. (4 hours)

EVIDENTIARY ISSUES Tue., Mar. 21 (1 PM - 5 PM)

Standards of evidence necessary in a Code Enforcement Board procedure including relevance, rights of alleged violators and the Board, due process, privileges, Fourth and Fifth Amendment issues, hearsay, and use of public records. (4 hours)

LOCAL GOVERNMENT ORDINANCE Wed., Mar. 22 (8 AM –10:00 AM)

An overview of ordinance development including construction, format, adoption, and codification. (2 hours)

MOCK CITATION TRIAL Wed., Mar. 22 (10:00 AM – 12:00 PM)Following an overview of procedures to be followed in court appearances and differences with the Code Enforcement Board process, several mock citation trials are held, followed by critique and evaluation. (2 hours)

SPECIAL ISSUES Wed., Mar. 22 (1 PM - 5 PM)

Examination of special areas relating to Code Enforcement including repeat violations, demolition, right of entry, stipulations, fines, recovery of costs, and rehearing’s. (4 hours)

TESTIFYING AND DEMEANOR Thurs., Mar. 23 (8 AM - 12 PM) How to make the most effective presentation either before the Code Enforcement Board or in a courtroom. The importance of proper preparation before testifying. What to expect in the courtroom and how to proceed. Suggestions to witnesses. (4 hours)

MOCK CODE BOARD HEARING Mar. 23 (1 PM - 5 PM) Following a summary of procedures which should be followed in preparing and presenting effective cases to the Code Enforcement Board, several mock cases are enacted by the attendees. Critique and evaluation follow. (4 hours)
