The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Electricity Safety (Equipment Efficiency) Regulations 2009 to—

(a)prescribe standards of energy efficiency for newly proclaimed electrical equipment; and

(b)provide for the registration and labelling of newly proclaimed electrical equipment; and

(c)make miscellaneous and consequential amendments.

2Authorising provisions

These Regulations are made under sections 154 and 157 of the Electricity Safety Act 1998.

3Commencement

r. 3

These Regulations come into operation on 15December 2009.

4Principal Regulations

In these Regulations the Electricity Safety (Equipment Efficiency) Regulations 2009[1] are called the Principal Regulations.

5Revocation of regulation 3

Regulation 3 of the Principal Regulations is revoked.

6Definitions

(1)In regulation 4 of the Principal Regulations, insert the following definitions—

"AS/NZS 4776.1.1means AS/NZS4776.1.1 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 4776.1.2means AS/NZS4776.1.2 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 4776.2means AS/NZS4776.2 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 4847.1means AS/NZS4847.1 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 4847.2means AS/NZS4847.2 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 4934.1means AS/NZS4934.1 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 4934.2means AS/NZS4934.2 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 4965.1means AS/NZS4965.1 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 4965.2means AS/NZS4965.2 as referred to in Schedule 2 as published or amended from time to time;

AS/NZS 62087.2.2means AS/NZS62087.2.2 as referred to in Schedule 1 as published or amended from time to time;

close control airconditionerhas the meaning set out in clause 4.1 of AS/NZS 4965.1 but does not include equipment of the type referred to in clause 1.2 of AS/NZS 4965.2;

liquid-chilling packagehas the meaning set out in paragraphs (a) to (d) of clause 4.10 of AS/NZS 4776.1.1 but does not include—

(a)equipment of the type referred to in paragraphs (a) to (d) of clause 1 of AS/NZS 4776.1.1; or

(b)equipment with application rating conditions other than the rating conditions set out in clause 5.3 of AS/NZS 4776.1.1;

self-ballasted compact fluorescent lamphas the meaning set out in clause 3.13 of AS/NZS4847.1 but does not include equipment of the type referred to in clause1.2 of AS/NZS 4847.2;

television sethas the meaning set out in clause 3.1.12 of AS/NZS 62087.1 but does not include equipment of the type referred to in clause 1.2 of AS/NZS 62087.2.2;

tungsten filament lamphas the meaning set out in clause 1.3.13 of AS/NZS 4934.1 but does not include—

(a)equipment of the type referred to in clause 1.2 of AS/NZS 4934.2; or

(b)lamps that do not have the attributes set out in clause 1.1 of AS/NZS 4934.2;

tungsten halogen lamphas the meaning set out in clause 1.3.14 of AS/NZS 4934.1 but does not include—

(a)equipment of the type referred to in clause 1.2 of AS/NZS 4934.2; or

(b)lamps that do not have the attributes set out in clause 1.1 of AS/NZS 4934.2;".

(2)In regulation 4 of the Principal Regulations, for the definition of "AS/NZS 62087:2004" substitute

"AS/NZS 62087.1means AS/NZS62087.1 as referred to in Schedule 1 and Schedule 2 as published or amended from time to time;".

7Minimum standards for energy efficiency and performance

(1)In regulation 5(2) of the Principal Regulations, after "apply to"insert"television sets,".

(2)In regulation 5(4)(a) of the Principal Regulations—

(a)for "3.4, 3.5, 3.6 and 3.7" substitute "3.3,3.4 and 3.5";

(b)for "laboratory; or" substitute "laboratory.".

(3)Regulation 5(4)(b) of the Principal Regulations is revoked.

8New regulation 5A inserted

r. 8

After regulation 5 of the Principal Regulations insert—

"5A Television sets

Television sets must comply with the minimum energy performance standards set out in section 5 of AS/NZS 62087.2.2when tested in accordance with AS/NZS62087.1by an accredited or approved laboratory.".

9Single-phase commercial airconditioners and heat pumps and three-phase airconditioners and heat pumps

In regulation 10 of the Principal Regulations—

(a)in paragraph (a), for "2.9" (wherever occurring) substitute "2.10";

(b)in paragraph (b), for "3.4, 3.5, 3.6 and 3.7" substitute "3.3, 3.4 and 3.5".

10Set top boxes

In regulation 14 of the Principal Regulations, for "AS/NZS 62087:2004" (wherever occurring) substitute "AS/NZS 62087.1".

11New regulations 14A, 14B, 14C and 14D inserted

After regulation 14 of the Principal Regulations insert—

"14A Liquid-chilling packages

Liquid-chilling packages must comply with the minimum energy performance standards set out in clause 5 of AS/NZS 4776.2 when tested in accordance with AS/NZS4776.1.1 andAS/NZS4776.1.2 by an accredited or approved laboratory.

14BClose control airconditioners

Close control airconditioners must comply with the minimum energy performance standards set out in clause 2.2 of AS/NZS4965.2 when tested in accordance with AS/NZS4965.1 by an accredited or approved laboratory.

14CSelf-ballasted compact fluorescent lamps

Self-ballasted compact fluorescent lampsmust comply with the performance requirements set out in clause 4.2 of AS/NZS4847.2 when tested in accordance with AS/NZS4847.1 by an accredited or approved laboratory.

14DTungsten filament and tungsten halogen lamps

Tungsten filament and tungsten halogen lamps must comply with the minimum energy performance standards set out in clauses4.3 and4.4 of AS/NZS4934.2 when tested in accordance with AS/NZS4934.1 by an accredited or approved laboratory.".

12Division headings inserted

(1)In Part 3, before regulation 15 of the Principal Regulations insert—

"Division 1—General".

(2)After regulation 16 of the Principal Regulations insert—

"Division 2—Application for registration or transfer".

13Regulation 18(2) amended

In regulation 18(2) of the Principal Regulations, after "apply to" insert "television sets,".

14New regulation 20A inserted

After regulation 20 of the Principal Regulations insert—

"20A Applications for the registration of a television set

An application for the registration of a television set must—

(a)be in the form set out in Appendix A of AS/NZS 62087.2.2; and

(b)specify whether the television set complies with the minimum energy performance standards set out in regulation5A; and

(c)be accompanied by—

(i)the results of testing and calculations referred to in section3 of AS/NZS62087.2.2; and

(ii)a sample of the electrical equipment label to be attached to the television set; and

(iii)the results of testing referred to in regulation5A, set out in the form required by AppendixC of AS/NZS62087.2.2; and

(iv)the applicableregistration fee.".

15New regulations 28A, 28B, 28C and 28D inserted

After regulation 28 of the Principal Regulations insert—

"28A Applications for the registration of a liquid-chilling package

An application for the registration of a liquid-chilling package must—

(a)be made in accordance with the requirements for an application for registration set out in clause 6 of AS/NZS 4776.2; and

(b)be in the form set out in Appendix A, B orC of AS/NZS 4776.2 (as the case requires) in accordance with clause 6.2 of that standard; and

(c)specify whether the liquid-chilling package complies with the performance criteria and the minimum energy performance standards set out in regulation14A; and

(d)be accompanied by the applicable registration fee.

28BApplications for the registration of a close control airconditioner

An application for the registration of a close control airconditioner must—

(a)be made in accordance with the requirements for an application for registration set out in section 3 of AS/NZS 4965.2; and

(b)be in the form set out in Appendix A of AS/NZS 4965.2; and

(c)specify whether the close control airconditioner complies with the minimum energy performance standards set out in regulation 14B; and

(d)be accompanied by the applicable registration fee.

28CApplications for the registration of a self-ballasted compact fluorescent lamp

r. 15

An application for the registration of a self-ballasted compact fluorescent lamp must—

(a)be made in accordance with the requirements for an application for registration set out in clause 5 of AS/NZS 4847.2; and

(b)be in the form set out in Appendix A of AS/NZS 4847.2; and

(c)specify whether the self-ballasted compact fluorescent lamp complies with the minimum energy performance standards set out in regulation 14C; and

(d)be accompanied by the applicable registration fee.

28DApplications for the registration of a tungsten filament or tungsten halogen lamp

An application for the registration of a tungsten filament or tungsten halogen lamp must—

(a)be made in accordance with the requirements for an application for registration set out in clause 5 of AS/NZS 4934.2; and

(b)be in the form set out in Appendix A of AS/NZS 4934.2; and

(c)specify whether the tungsten filament or tungsten halogen lamp complies with the minimum energy performance standards set out in regulation 14D; and

(d)be accompanied by the applicable registration fee.".

16Division heading inserted

After regulation 31 of the Principal Regulations insert—

"Division 3—Registration requirements".

17Requirements for registration of electrical equipment listed in Schedule 1

In regulation 32(2) of the Principal Regulations, after "apply to" insert "television sets,".

18New regulation 34A inserted

After regulation 34 of the Principal Regulations insert—

"34A Requirements for registration of a television set

Energy Safe Victoria may only register or transfer the registration of a television set if, in the opinion of Energy Safe Victoria—

(a)the television set complies with the requirements of regulation 5A; and

(b)the electrical equipment label complies with the requirements of regulations47A(a) and 47A(b).".

19New regulations 41A, 41B, 41C and 41D inserted

After regulation 41 of the Principal Regulations insert—

"41A Requirements for registration of a liquid-chilling package

Energy Safe Victoria may only register or transfer the registration of a liquid-chilling package if, in the opinion of Energy Safe Victoria, the liquid-chilling package complies with the requirements of regulation14A.

41BRequirements for registration of a close control airconditioner

Energy Safe Victoria may only register or transfer the registration of a close control airconditioner if, in the opinion of Energy Safe Victoria, the close control airconditioner complies with the requirements of regulation 14B.

41CRequirements for registration of a self-ballasted compact fluorescent lamp

Energy Safe Victoria may only register or transfer the registration of a self-ballasted compact fluorescent lamp if, in the opinion of Energy Safe Victoria, the self-ballasted compact fluorescent lamp complies with the requirements of regulation 14C.

41DRequirements for registration of a tungsten filament or tungsten halogen lamp

Energy Safe Victoria may only register or transfer the registration of a tungsten filament or tungsten halogen lamp if, in the opinion of Energy Safe Victoria, the lamp complies with the requirements of regulation14D.".

After regulation 42 of the Principal Regulations insert—

"Division 4—Cancellation of registration".

21Electrical equipment labels

In regulation 45(2) of the Principal Regulations, after "apply to" insert "television sets,".

22New regulation 47A inserted

After regulation 47 of the Principal Regulations insert—

"47A Labelling of television sets

For the purposes of section 68 of the Act, an electrical equipment label for a television set must—

(a)state the star rating as determined in accordance with the star rating index under section 4 of AS/NZS 62087.2.2 and the comparative energy consumption; and

(b)be in the form and contain the particulars set out in Appendix B of AS/NZS62087.2.2; and

(c)be attached to the television set as—

(i)described in clause4.3 of AS/NZS62087.2.2; or

(ii)approved in writing by a regulatory authority; and

(d)not be attached in a manner that obscures the label; and

(e)not contain any words, figures or symbols that mislead or are likely to mislead with respect to the television set's comparative energy consumption, star rating, star rating index or performance characteristics.".

23Labelling of certain airconditioners and heat pumps

In regulation 48(a) of the Principal Regulations, for "comparative energy consumption" substitute "rated power, rated capacity".

24New regulation 65 inserted

After regulation 64 of the Principal Regulations insert—

"65 Transitional—Electricity Safety (Equipment Efficiency) Amendment (Televisions, Liquid-Chilling Packages, Close ControlAirconditioners and General Lighting Services)Regulations 2009

A television set, liquid chilling package,close control airconditioner, self-ballasted compact fluorescent lamp, tungsten filament lamp or tungsten halogen lamp that was manufactured in or imported into Australia before the commencement of the Electricity Safety (Equipment Efficiency) Amendment (Televisions,Liquid-Chilling Packages, Close ControlAirconditioners and General Lighting Services) Regulations 2009 is taken to be registered and labelled in accordance with these Regulations.".

25Amendment of Schedule 1 to include television sets

After item 7 of Schedule 1 to the Principal Regulations insert—

"8 / Television sets / Australian/New Zealand Standard, 'Power consumption of audio, video and related equipment Part 1: Methods of measurement', AS/NZS62087.1; and
Australian/New Zealand Standard, 'Power consumption of audio, video and related equipment Part 2.2: Minimum energy performance standards (MEPS) and energy rating label requirements for television sets', AS/NZS62087.2.2.".

26Amendments to Schedule 2

r. 25

(1)In item 8 of Schedule 2 to the Principal Regulations, for "AS/NZS 62087:2004" substitute "AS/NZS 62087.1".

(2) After item 8 of Schedule 2 to the Principal Regulations insert—
