Particular Specification for

Minor alteration and conversion works of SCHOOL NAME>

1.General

1.1This is a lump sum Contract. The Works shall be executed completely to the entire extent, dimensions, details and true intent of the drawings and Specification whether expressly shown or mentioned or not.

The Tenderer’s prices for the Works shall be deemed to include the cost of employment of AP, Insurance Coverage, all labour, material, scaffolding, protective measure to third parties and nearby properties, cartage, plant, test, the giving of notices and payment of fees required to be given or paid by any enactment or any regulation or by-law of all other things and matters necessary for the proper carrying out and completion of the Works as specified. The Contractor shall base on the requirements described in the Contract and the actual site situation to price the unit rates. The Contractor shall be deemed to have taken account of all necessary costs of labour, night works, materials, insurance, safety requirement, overheads and profits in the unit rates entered.

Some record drawings of the sites are available in the School for inspection and reference by appointment 3 days in advance. Also, record drawings may be obtained from the relevant Government Departments (such as Buildings Department and Drainage Services Department) and other utility companies at the Contractor’s own expense. However, it is possible that modification/alteration works have been carried outfrom time to time since the issue of these drawings and there is no guarantee on the accuracy of these drawings. Tenderers may visit sites to check the accuracy of these record drawings if necessary and acquaint themselves with the site conditions and constraints which may affect their proposal and hence the quotation price.

1.2In the Schedule of Rates, the Tenderer has to fill in a realistic unit rates for all materials needed to complete the works as specified. The lump sum price of each part of work shall be the sum of all the items as stated in the Schedule of Rates for each part of work.

1.3The electricity supply is 220V/380V(+ or - 6%), 1 phase/3 phases, 50Hz (+ or - 1%), A.C. Temporary electricity and water are NOT available on Site. Make own arrangement for the temporary supply and remove the temporary facilities after work completed.Carry out the daily site cleaning and dispose all debris generated daily.

1.4Provide working platform for installation and demolition works at high level.

1.5All items to be disposed shall be removed from site immediately after dismantling and become the property of the Contractor who shall give a due credit to the Employer and indicate in the Schedule of Rates.

1.6All equipment and material specified by the Tenderer shall comply in full with the Specification

2.Drawings and Site Information Schedules

2.1Tender drawings and Site Information Schedulesareattached in the tender documents. The Tender drawings and Site Information Schedules shall be read in conjunction with the Specification. The Site Information Schedulesand Tender drawings only indicate the general requirements of Works. Take all particulars and dimensions during progress of the Works and submit for the approval of the Employer’s Representative any drawings in details as may be found necessary for the completion of the Works. No extra claim shall be made in this respect. All Tenderers are required to check all the dimensions and layout on site to complete the Contract submission.

2.2Produce completerecord drawings (including layout drawings, schematic diagrams, installation details, etc.) of the Works forALL parts of the workfor the approval and retention of the Employer’s Representative. Collect the necessary information himself for the production of these drawings. Provide all drawings to show their works and the drawing list shall be submitted to the approval of the Employer’s Representativewithin 2 weeks after issue of Service Order. Approval by the Employer’s Representative of any modification work or drawings shall not relieve the Contractor from his obligation or liabilities under this Contract. Before work completion, display a clear stencil drawn coloured schematic diagram showing all the record drawings in glass frames in a position directed by the Employer’s Representative. The dimensions of the diagram shall be standard A3 size (420mm x 590mm) and in Landscape orientation.

2.3The Contractor shall verify that the provisions and requirements stated in the Contract document matched with each other within 3 days after the issue of Service Order. The Site Information Schedules, Drawings and the Specification are mutually explanatory and complete, but Works called for on the Site Information Schedules even if not specified in this Specification and Drawings shall be fully executed by the Contractor. Shall any portion of the Works, which reasonably and obviously would be inferred as necessary for the completion, safe and satisfactory operation of the works as a whole, but not specified or explicitly described in the Specification, Drawings and/or Site Information Schedules, the Contractor notwithstanding such omission shall provide and execute the particular portion of the Works as part of the Contract and notify the Employer’s Representative before that section or portion of Works is carried out. In case of any discrepancy of requirements between the Site Information Schedules, Drawings and the Specification, the Employer’s Representative or his representative shall decide which requirements shall prevail and no claim extra shall be made in this respect.

2.4The Contractor shall submit their Materials/Equipment offer for the Contract for the Employer’s Representative’s approval within one week after the issue of the Service Order based on the Materials Schedule submitted during the Tender Stage. Selection of materials and equipment shall be in full compliance with this Particular Specification and the approval from the Employer’s Representative for the equipment/materials submission does not release the Contractor’s responsibility in this respect.

2.5Whilst the Employer intends to provide as accurate information as possible, it is the Contractor’s responsibility under this Contract to check the exact works requirements on Site in order to ensure any latest amendments not indicated in the Drawings are included in the Works. For any other item that the Tenderer considers necessary for the completion, safe and satisfactory operation of the Works, itemize such work with prices in the Schedule of Rates.

2.6The Contractor shall conduct sufficient site investigation and document review of all existing civil, structural, architectural and other services provisions for the preparation of shop drawings for approval and ensure that all his services are properly planned and coordinated without any conflict with other trades and existing building operation. It is the intent of the Site Information Schedules, Drawings and Specification to provide a complete workable system ready for the School’s operation. The Contractor shall at his own cost to provide any item not specifically shown on the Site Information Schedule or called for in the Specification, but normally required and necessary to conform tothe intent.

2.7The Contractor shall provide 3 copies of signed commissioning and testing report, as-fitted Drawings and O&M manuals within one month after the completion of the Contract work. The Contractor shall also provide 1 soft-copy of the reports and drawings (in standard PC format, i.e. .doc format for reports and manuals, pdf or dwg format for drawings and stored in CD-Recordables).

3.Program of Works

3.1Space for storage maybe availableon the Sitesand is subject to the agreement by the School; program the delivery of materials and equipment to suit the site conditions in order to avoid delivering the equipment to Site prematurely. Arrange the delivery and manufacturing of materials and equipment to cope with the approved program such that they arrive at Sites after all necessary submissions completed, structural suitability ascertained and the consent ofthe School to start work obtained. Any storage and transportation charges incurred due to early or partial shipment of the equipment shall be borne by the Contractor. Arrange for the daily supply of the necessary materials, equipment etc. for the carrying out of the works and for the removal of all surplus or dismantled material etc. at the end of each working day.

3.2Note that the materials and equipment shall be delivered to site and the whole installation works shall be completed within period as stated in the Service Order. Prepare to perform night work to ensure completion of all aspects of work according to the above mentioned period. The cost of the night work required shall be allowed in the Contract sum. Obtain approval from Environment Protection Department (EPD) to carry out the said night work as required. Take all these requirements into account when preparing the Tender.

3.3Within seven days of issue of Service Order, submit a detailed work program, key dates of submissions to the Building Authority (BA), expected BA approval dates, delivery proposal showing the full details and all details showing thebuilder's work, electrical and mechanical installation work etc. Submit all detail Drawings in full for Employer’s Representative's approval prior to actual site work, equipment fabrication and installation. Provide revised program, co-ordinating shop drawings, amendment drawings etc. as required by the Employer’s Representative from time to time during the progress of work. Update the program and delivery schedule from time to time to reflect the site condition and approval status of the submissions. Do not interrupt the normal operation of the School, unless otherwise agreed by the Employer’s Representative.

4.Restrictions and Working Conditions on Site

4.1Follow all the instructions given from time to time by the Employer’s Representative regarding any security measures, schedule and conditions of works in the Site. The Works shall be carried out in such a manner as to cause minimum disruption to the existing activities.

4.2Workers are not allowed to stay on Site outside the normal working hours or any other time specified by theEmployer’s Representative. The Contractor shall be co-operative so that the works carried out under this Quotation Contract shall not affect the smooth operation of the occupant or cause unacceptable nuisance and inconvenience to the staff of the School. The Contractor is required to keep all affected areas free from debris within the building and the Site after completion of each day’s work. The Contractor shall remove all rubbish, debris, cement slurry, staining and the like, and clean the areas by sweeping and flushing with water as necessary so that the Site is kept constantly clean and tidy. The Contractor shall be responsible for ensuring that no debris is deposited on public or private rights of way as a result of the Works, including any deposits arising from the movement of plant and vehicles.

4.3Ensure that the noise emitted during the working period complies with the requirements stipulated by EPD. Submit details of his staff who will be working on Site to the Employer’s Representative for approval. Any staff of the Contractor not on the list will be considered as trespassers and shall not be allowed to work on Site. Provide staff identification card for each member of his staff who shall carry it when working on Site. Such identification card shall be approved by the Employer’s Representative and bear the name and company seal of the Contractor and shall contain the information including the personal name, photograph and rank.

4.4For Works located in restricted areas, allow the expenses pertaining to the issue of special security passes for works in these restricted areas. This will include provision of photographs, filling in of forms or questionnaires, collection of passes from the issuing offices, etc. Apply for the security passes in time. No extension of time will be given if there is any delay in obtaining these passes.

4.5Ensure that staff employed for the works are in proper dressing and shall keep it clean and good order. Allow in Tender for having manpower and other resources available to execute the Works.

5.Site Safety

5.1A Site Safety Plan is not required under this Contract. Enhance with priority accorded in all activities connected with the Works, the safety and health of all persons on or adjacent to the Site and to ensure that in particular all persons employed on the Works are appropriately trained for their tasks with consideration given to safety and health issue.

5.2The Contractor shall:

a.Comply with all legislation of latest version relating to safety, environmental protection and health;

b.Keep himself informed of all relevant codes of practice published by the Hong Kong Government of Special Administration Region (HKSAR Government) and by the Occupational Safety and Health Council and comply with the provisions in the codes of practice;

c.Where appropriate, keep on the Site one set of the relevant safety and health legislation and the documents entitled ” Guide to the Factories and Industrial Undertakings Ordinance (Section 6A & 6B) - Know Your General Duties” and “Guide to the Construction Sites (Safety) Regulations” published by the HKSAR Government together with a set of the relevant codes of practice, guides to safety and health legislation, safety guides and safety pamphlets published by the Employer and the Occupational Safety and Health Council. All regulations and documents stipulated in sub-item (a) and the sub-items of this section shall also be held in Chinese when the official translation of the documents is available alongside those in the English language; and

d.Keep a working stock of all statutory forms to be used in relation to the compliance of the safety and health legislation.

5.3The Contractor's site representative shall also be engaged in the performance of the obligations and requirements of the Contract concerning safety and health. Instruct employees and any sub-contractor of the Contractor, whether directly employed or not, to cease operations and take urgent and appropriate action to make safe the Site and the Works and prevent unsafe working practices or other infringements of statutory regulations. If for any reason (e.g. injury, resignation), the Contractor's site representative cannot perform the duties, the Contractor's site representative shall be replaced within a reasonable time, but in any case within 14 days.

5.4The Employer’s Representative may give notice in writing to the Contractor for the removal and replacement of the Contractor's site representative shall there be repeated breaches of the statutory regulations or other repeated disregard for the safety of any person on or adjacent the Site. Do not employ or allow on the Site any employee or sub-contractor of the Contractor, who has repeatedly breached safety requirements and has been dismissed from the Site for that reason. Notice of the sanction of dismissal for breaches of the safety requirements shall be prominently displayed on the Site.

6.Statutory Requirements and Regulations

6.1All Works (including testing and commissioning work) shall comply with the latest version of current regulations and standards as listed in Annex I.

6.2Submit to the statutory bodies and pay the cost of statutory submission, obtain of Record Drawings, statutory inspections and certificates. All building works shall be carried out by Registered General Building Contractors under the supervision of Authorized Person(s) under the appropriate Register. All Electrical Works for this Contract shall be carried out by Registered Electrical Workers (REWs) of the appropriate grades. Comply with all statutory obligations and regulations and requirements together with any amendments made thereto as required by the following bodies:

-Fire Services Department (FSD);

-Buildings Department (BD);

-Water Supplies Department (WSD);

-Environmental Protection Department (EPD);

-Electrical and Mechanical Services Department (EMSD);

-Education Bureau (EDB);

-Utility Supply Companies;

-Any other local authority having jurisdiction.

7.Inspection, Commissioning and Testing

7.1Submit testing and commissioning program together with proposed test forms for all installation two weeks before the work to be carried out.

7.2Carry out all necessary Commissioning and Testing procedures including factory tests at manufacturers’ places, site tests during construction and commissioning, and acceptance tests as specified in the General Specificationslisted in Annex I of this specification, and as necessary for the safe, reliable and satisfactory operation of the system and equipment installed.

7.3Take over the existing works (including but not limited to the existing lock system, electrical and mechanical system and building finishes) for the alterationdismantle, modification and removal of existing work. Any defects shall be recorded and reported to the Employer’s Representative, or otherwise, any defects which are found after the Contractor has taken over the existing work shall deem to be the full responsibility of the Contractor. Provide facilities for all tests and adjustments after installation and shall bear all the cost incurred in Commissioning and Testing. All testing standards and procedures shall be submitted one month after the issue of Service Orders.
