Dear Mr. Clearfield:

On March 18, 2016, you filed with the Commission the Petition of Direct Energy Services, LLC (Direct Energy) to Expand Retail Market Enhancements requesting that the Commission issue an Order restarting and modifying the Retail Opt-In Program. Attached to your Petition was a Certificate of Service indicating that the Petition had been served on the Office of Consumer Advocate, the Office of Small Business Advocate, and the Commission’s Bureau of Investigation and Enforcement. For the reasons discussed below, we direct you to serve this Petition on all jurisdictional Electric Distribution Companies (EDCs) and on all Electric Generation Suppliers (EGSs) serving retail customers in the PECO Energy Company and PPL Electric Utilities service territories.

Section 5.41(b) of the Pennsylvania Code requires that, in addition to the entities you already served, the Petition be served on all persons directly affected and on other parties whom the petitioner believes will be affected by the Petition. 52 Pa. Code § 5.41(b). As your Petition proposes to reinstate the Retail Opt-In Program as a pilot program in the service territories of PECO Energy Company and PPL Electric Utilities, it will directly impact these two EDCs as well as those EGSs that serve retail customers in the PECO and PPLservice territories. All jurisdictional EDCs could also be impacted by the outcome of the pilot, if it is approved. Therefore, to comply with the mandates of Section 5.41(b) of the Pennsylvania Code, Direct Energy is directed to serve its Petition on all jurisdictional EDCs and on all EGSs currently serving retail customers in the PECO Energy Company and PPL Electric Utilities service territories.

The twenty-day period for the filing of Answers to the Petition, pursuant to 52 Pa. Code § 5.61, will not begin to run until such time as the required service has been made and a certificate of such service has been filed with the Secretary.
