Dr. Ambedkar Government Law College is organizing “The 38th All India Moot Court Competition” scheduled to be held from 6.4.2018 to 8.4.2018.

2.We take this opportunity to invite your College/University to participate in the 38th all India Moot Court Competition. This time we have decided to introduce single speaker competition. Our past experience has shown that on many occasions, when a team of two are participating, one speaker’s performance is far excellent than the other but the teams fail to reach the finals due to the weak performance of the other speaker. In order to avoid such a situation, we have decided to introduce a new format for the Moot competition with only a single speaker without any researcher. Each institution is eligible to send a maximum of two individual participants with separate registration forms and separate Registration Fees for each participant. All institutions are requested to send their nominations at the earliest without waiting for the last date so that good accommodation can be arranged for them.

3.Therefore, the name of student/s those who are interested in participating in the competition may kindly forward their nominations by post to “The Principal, Dr. Ambedkar Government Law College, Kalapet, Puducherry – 605 014.” so as to reach on or before 23.03.2018, 5.00 p.m. The nomination of student should be accompanied with a Demand Draft for each participant of an amount of Rs.1,500/- (Rupees thousand five hundred only) payable at Pondicherry.

Moot Court Problem

The case concerning the right of the people to be governed by their directly elected representatives.

The State of Inroze attained independence on 1st January 2000 from the British rule. It neighbours India on the East. Both India and Inrozeshare common heritage, socially and culturally and have strong historical ties. The State of Inroze, after attaining independence, became a Republic by adopting a written Constitution, which came into effect on 1 January 2001. The State of Inrozeproclaimed its Constitution in the name of its people and declared itself as a sovereign, socialist, secular democratic republic.

The State of Inrozeconsists of a Union of 10 States and four Special Administrative Territories (SAT’s). The State of Inrozehas a federal character with strong unitary features. The Constitution of Inrozeprovided for a Union Government at the centre and State governments at the State level and SAT’s as units of the Federation. All the four SAT’s were administered by the Central Government through the President of the Republic who appointed an Administrator to each of the four SAT’s to administer the SAT’s.

The territory known and identified as Puduzam is an adjacent land mass of the Republic of Inroze and it was under colonial rule of France for about 200 years. Puduzam was peacefully ceded to the Republic of Inroze under a Treaty dated 1st January 2002 by the colonial power which was ruling it for about 200 years. After Puduzam was ceded to the Republic of Inroze, it was treated and considered as a SAT and it became the fifth SAT to be administered by the Union Government through an Administrator appointed by the President of the Republic.

The Union Parliament of Inroze passed a legislation known as The Special Administrative Territories Act, 2002 and it came into effect on 1st June 2002 after obtaining Presidential assent.

After the passing of The Special Administrative Territories Act, 2002 the original four SAT’s and the newly created SAT of Puduzam were also permitted to have a legislative assembly but their power to pass laws were subject to severe restrictions and their powers were not comparable to that of the legislative powers exercised by the States under the Constitution. The legislative measures of the legislative assembly were subject to the approval of the Union government.

The people of the SAT of Puduzam were not happy with this arrangement and frustrated by the inability of its elected members to pass laws providing for the welfare of the people living within its territory, there were boycotts, bandhs, strikes and several manifestations from different sections of the society demanding the immediate withdrawal of the restriction on the legislative powers of the legislative assembly and the matter of approval of the Union government.

While so, on 1 November 2016, a general strike was called in the SAT of Puduzam by several organizations of traders, businessmen, entrepreneurs, students with the support of political parties and civil society to protest against the inability of the elected government to promote, protect and implement economic and social welfare measures contemplated in Part IV of the Constitution of Inroze and as a result, the people living within the SAT of Puduzam were unable to exercise and enjoy their fundamental human rights in comparison to the people living in the state of Inroze. The right to live with dignity was affected and there was all round resentment. There was also a danger of violent reaction by the people within Puduzam.

At this juncture, a voluntary association known as ‘Pudukural’, formed by concerned and conscious residents of Puduzam, with the aims and objectives of safeguarding and defending the democratic principles, the essence of the principles of governance through their directly elected representatives, and for promoting, protecting, for enjoyment and enforcement of fundamental human rights covering civil, political, economic and social rights, incorporated in the Constitution, decided to challenge the validity of the restrictive provisions of The Special Administrative Territories Act, 2002 before the Supreme Court of Inroze.

Accordingly an unanimous resolution was passed in the general body of the association and the Secretary of the Association was authorized to take all necessary legal steps and action to enforce the people’s right to be governed through their elected representatives in the territorial assembly without any interference, restriction and approval from the central government for better realization of their fundamental rights. A public interest litigation was filed before the Supreme Court of Inroze in this regard and the case is now posted for final hearing of arguments and disposal of the case.

Note:The Constitution adopted by the State of Inrozeand its laws relating to the people’s representation are in pari materia with the Constitution of the Republic of India and its laws on the subject.The Special Administrative Territories Act, 2002 of Inroze is in pari materia to the The Government of Union Territories Act, 1963.

Rules and Regulation governing the competition:

Eligibility:

Participation is restricted to bonafideundergraduate student of 5 years / 3 years LL.B. programme of any University/College/Institution recognized by the Bar Council of India.

Language:

The official language for the Moot Court is English.

Dress Code:

Men: Black Pant, White Shirt, Black Coat, Tie and Formal Shoes.

Women:White Churidar/Salwar with black coat or Black Pant, White Shirt, Black Coat

Number of Participants:

Each institution can send a maximum of two individual participants.

Each student Speaker will be given an individual code. Student Speakershall not disclose his/her identity or that of his/her institution or city etc to any one during the competition. Any disclosure will invite penalties including disqualification. The decision in this regard by the Moot committee shall be final.

Researcher: No researcher is allowed

Registration:

  1. Each Student Speakerwho desires to participate in the competition shall confirm theparticipation at the latest by19th March 2018by E-MAIL: . The Student Speakermust submit his/her duly filledhard copy of Registration Form along with DD so as to reach on or before 23rd March 2018. The Registration Form should be sent by post to The Principal, Dr.Ambedkar Govt. Law College,MathurRoad,Kalapet, Pondicherry - 605014.
  2. If an institution is sending two participants, separate Registration Forms and separate Registration Fees for each participant should be submitted.
  3. No change of participants shall be entertained thereafter except at the sole discretion of the Moot committee.
  4. Registration fee of Rs. 1500/-is payable by way of DD drawn in favor of “The Principal, Dr.Ambedkar Govt. Law College” Payable at Pondicherry.

Competition Rounds:

1.The competition shall consist of Preliminary, Quarter-finals, Semi-finals and Final rounds. The top 8 Student Speakerfrom the preliminary rounds shall qualify to participate in the quarter final. Winners of the quarter final will proceed to semi- final. Winners in the Semi-final will qualify for the final round.

2.In the preliminary round each Student Speakerwill have to argue from both the sides (Petitioner and Respondent) in two separate rounds. For the said purpose, fixture of Student/Speaker will be decided by draw of lots.

3. During preliminary round, each Student Speaker will be allowed 20 minutes only. There will not be rebuttal in the preliminary rounds.

5.Student Speaker for the quarter finals will be selected based on the marks secured in the two preliminary rounds. Top eight Student Speakers will move to the Quarter-finals.

6.The 4winning Student Speakers from the quarter finals will move on to the semi –finals and two winning speakers in the semi-finals will move to the finals.

7.Both quarter final and semi -finals round will be knockout rounds.

8.During the Quarter final rounds, the Student Speaker will be required to argue either on behalf of the Petitioneror the Respondent. The Students Speaker’s particular side will be decided by a draw of lots prior to the commencement of the Quarter final rounds. During the Quarter -final rounds each Student Speakers will be allowed only 20 min to argue for respective sides.

9.During the semi -final rounds each Student Speakers will be allowed only 20 minutes to argue for their respective side, decided by a draw of lots.

10.The two winners of the Semi finals will participate in the Final Round. Each Student Speakerwill be allowed only 30 min to argue for their respective side decided by way of draw of lots

11.Participating Student Speakerswill be required to strictly follow the time limits.

Memorials/ Written submissions:

  1. All Student Speakers are required to submit Memorials for both the petitioner and the respondent.
  2. Names of the participant or his/her institution name or any kind of identification mark should not appear in any part of the Memorials.
  3. Fourcopies of the memorials of both sides shall be submitted during the desk registration at 1pm on 6thApril2018 at Dr. Ambedkar Govt. Law College, Kalapet, Pondicherry-605014.
  4. Participants are advised to carry extra copies of their Memorials for their own use. The copies submitted to the organizer would be for the use of evaluationand for the use of judges of the competition and will not be returned to the participants.
  5. After the completion of the competition, the organizers shall reserve the right to use the memorials submitted by the participating Students Speaker, as they may deem appropriate.
  6. StudentSpeaker will not be permitted to raise arguments other than those presented in the memorial.
  7. i) The memorials should not exceed 25 typed pages

ii) The font and size of the text of all the parts of the memorial must be in New Times Roman and 12 point with 1.5 line spacing. Footnote with font size of 10.

iii) The memorial must contain the following

b.Table of authorities

c.Statement of jurisdiction

d.Statement of facts

e.Statement of issues

f.Summary of arguments

g.Written pleadings

h.Prayer

Note: Memorial should be bound in spiral binding form. The cover page of the appellant side Memorial shall be BLUE and respondent shall be RED.

Each sidesMemorial will be evaluated for 10 marks and the Students Speaker memorial marks will be the aggregate of both the sides (i.e. 20 marks). Memorials will be judged by a special panel of judges.

Evaluation:

The competing StudentSpeakers will be judged on the basis of the following evaluation criteria, for a total of 100 marks (break- up of marks indicated below).

The following will be the Evaluating Criteria and the marks will be allocated to each category as under.

Awards and Prizes:

Awards and prizes for the moot court competition are as follows:

I.Winner of the moot court competition will be awarded with cash prize, trophy and Certificate of Merit

II.The Runners up will be awarded with cash prize, trophyand Certificate of Merit.

III.TheBest Male Student Advocatewill be awarded with cash prize, Trophy and Certificate of Merit.

IV.The Best Female Student Advocate will be awarded with cash prize, Trophy and Certificate of Merit

V.The Best Memorialwill be awarded with cash prize, trophy and Certificate of Merit.

VI.Each participant in the moot court competition will be awarded a certificate of participation.

SCOUTING:

Student Speaker or any one accompanying him/her will not be allowed to observe the oral argument of other court halls. Scouting is strictly prohibited. Scouting by the Student Speaker or any one on his/her behalf will result in his/her disqualification.

HOSPITALITY:

  1. Accommodation will be provided from 01.00 p.m. of 6th April 2018 to 12 noon of 9th April 2018
  2. Food will be provided to the aforesaid Student Speakers only, from the dinner of 6th April 2018 (Friday) to 8thApril 2018(Sunday) Lunch.
  3. Local Conveyance (transport between the Guest house and the competition venue) to the participating Student Speakers will be provided by the Organizers.

The Students Speakers are required to report on 6th April 2018 at 1.00 pmat Dr. Ambedkar Govt. Law College, Kalapet, Pondicherry-605014, for the Desk RegistrationandBriefing Session during which Students Speaker codes will be given and Fixtures will be made (by lot). Participantsmust submit their memorials (4copies for each side) at the time of registration.
