The activities of the OYT North fall within the definition of a ‘regulated activity’ (Protection of Freedoms Act 2012) and as such the trust must exercise a duty of care in the recruitment and appointment of paid employees and unpaid volunteers. We may also request production of a Disclosure and Barring Service Certificate (or equivalent Enhanced CRB check). Such a request is only made after a thorough risk assessment has indicated that one is both proportionate and relevant to the position concerned.

The requirement for self-disclosure of criminal convictions (or pending criminal investigation or prosecution) forms part of the application process; this information will be dealt with in confidence and will only be seen by those who need to see it as part of the safer recruitment process. The activities of the OYT North allow us to ask questions about your entire criminal record, and not just about ‘unspent’ convictions as defined in the Rehabilitation of Offenders Act 1974.
