MINUTES OF A REGULAR MEETING OF THE COUNCIL OF THE VILLAGE OF HAY LAKES IN THE PROVINCE OF ALBERTA HELD AUGUST 17, 2009 IN THE COUNCIL CHAMBER OF THE HAY LAKES MUNICIPAL BUILDING.

COUNCILLORS: Cory Bowler, Sherry Krozser, Steve Nickoleff and Baren Stewart
MUNICIPAL ADMINISTRATOR / RECORDER: Heather Nadeau
Order / Mayor Harke called the meeting to order at 6:58 p.m.

APPEARING BEFORE COUNCIL

Caroline Gilliat from UFA

Caroline Gilliat appeared before Council to discuss the remediation of the UFA properties. The current owner of #8 – 3rd Avenue would like to list his property for sale, and the chemical injection process has not been as effective as they would have liked, so they are going to have excavate all the contaminated soil from the property in order to give him an environmental clearance certificate. The excavation process will impact the foundation of the garage on the neighboring lot (which is owned by UFA) so they are going to remove the structure. It is felt that the residence on this property has also been impacted and will require moving at some point, so the garage will not be reconstructed at this time.

They are continuing to look at options to clean up the remainder of the property.

ALBERTA ANIMAL SERVICES – BYLAW ENFORCEMENT
Don Elliot and Mike Alexander appeared before council to discuss the number of patrols within the Village. Council is interested in getting more effective enforcement of the Village bylaws.
Don Elliot advised that insurance premiums may vary if your bylaw enforcement is complaint driven or actively enforced.
Animal Services is going to revise our contract and forward for review.
Mike and Don left the meeting at 8:10 p.m.
AL SCHERBARTH
Al Scherbarth appeared before Council to discuss reserve funds for the Village. The Village currently has Reserve funds split into two categories – Capital and Operating. The Operating Reserve is left as a mill rate stabilization fund or legislative reserve rather than being allocated to a number of small reserve accounts. Councillor Stewart requested information on account reporting of honorariums. Discussion on having an interim audit or review in November.

MAINTENANCE
The Public Works foreman attended the meeting to review and discuss the Council Action list and ongoing maintenance issues.
Scott submitted his notice effective August 31, 2009. Councillor Stewart requested that the public works foreman submit a list of action items that are required for the Water Treatment Plant.
Scott left the meeting at 9:45 p.m.

Council reviewed and discussed the July Financial Report.
Moved by Nickoleff to accept the July Financial Report as information.

Council reviewed and discussed the written administration report submitted by the Municipal Administrator.
Moved by Councillor Krozser to accept the administrators report as information.

PORTFOLIO REPORTS
  1. Infrastructure – Regional Water – Pumping station tender closed – technical meeting August 18 at 1:30 at LeducCounty building. Regional Water – August 28, 2009 11:00 – Ground Breaking/Project ceremony.

  1. Development -
a)Lot 5, Block 18, Plan 032 4239 Council discussed the request for an extension on completion of the development on this lot.
Moved by Councillor Nickoleff to extend the caveat to the end of 2009.

b) BRSD Appeal - Council discussed correspondence from Battle River School Division with respect to the refusal to allow the County Grader Shed/Bus Barns adjacent to the residential development. Council agreed to meet with all parties listed on the letter on August 26th – 7:00 p.m.
c)Lot sales – Letter terminating the Wild Spirit Agreement has been sent to lawyers for Wild Spirit Homes. Council has authorized Administration to commence selling lots forthwith.

  • Communities in Bloom – The annual banquet is on September 19th, 2009 in Strathmore. Councillor Stewart has requested representation from Council, Administration and Public Works.

Moved by Councillor Bowler to accept the following information and correspondence
1. Letters:
a) Alberta Municipal Affairs – with the support from various gov’t dept. has compiled the Mun. Fin. Assis. Prog. Key dates Calendar. The calendar is a convenient reference guide to assist municipal administrators applying for municipal grants.
b) CamroseCounty – a letter to Honorable Ray Danyluk with concerns about MSI Funding. Our concern is the fact that rules and guidelines came our after the funding allocations had been announced.
c) Muscular Dystrophy Canada – MDC would like to request your support by the issuance of a proclamation declaring September as Muscular Dystrophy Awareness Month in you community in 2009.
d) ACFA – Borrowing bylaws must be valid as defined is section273 of the Municipal Government Act, at least 30-days prior to the borrowing date.
e) Kara Blizzard-Youth Services Officer- thank you for using our services the summer.
f) CLG Displays – Get Inspired with luminous décor form CLG Displays.
g) Canadian Fitness and Lifestyle Research Institute – Physical Activity in Canadian Communities Survey.
h) Auma – to express sincere appreciation for you attendance and participation in the June Mayors’ Caucuses.
