STATEMENT FOR THE VERIFICATION OF SUITABILITY AS A TENDERER
Hereby, we assure and warrant that our company
· or director or any person having powers of representation, decision or control in respect of our company has not been the subject of a conviction by judgment that has obtained the force of res judicata and is specified in a criminal record for one or more offence mentioned in Section 53 of the Finnish Act on Public contracts or offence concerning his professional conduct;
· is not bankrupt or not being wound up or has not ceased operations, where it has entered into an arrangement with creditors or a reorganization plan or is in any analogous situation arising from a similar procedure under the law; and is not the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or of proceedings for other such procedures.
· has enrolled in the appropriate professional or trade register as well as other registers for business activity (i.e. VAT, employer, preliminary tax withholding) under the conditions laid down by the laws of the country in which it is established;
· has fulfilled all statutory obligations and payments concerning pension contributions, insurance and social security as well as tax liabilities in accordance with legal provisions of the country in which the it is established;
· has duly observed the statutory requirements of environmental protection, industrial safety, conditions of employment and taxation as laid down by the laws of the country in which it is established. The company complies with the collective agreements of the line of business in which it operates.
The Geological survey of Finland has upon request the right to receive certificates issued by the competent authorities in the country in which the company is established concerning all the said criteria on suitability or other related subjects (e.g. balance sheets or equivalent financial standings). The company also commit to providing the said certificates and other information referred to in the Finnish Act on the Contractor’s Obligations and Liability when Work is Contracted Out (1233/2006) before the signing of a the final contract, if they are successful in this procurement.
The tender has to include attachments of all other documents asked for tin the invitation to tender in order for the contracting authority to be able to verify the suitability.
