Agreement for Public & Private Drainage Works
What am I agreeing to?
Your agreement enables Far North District Council to enter and construct proposed drainage works on your property. By signing the attached entry agreement you are granting consent for the council to construct and maintain sewerage works on private land, pursuantto section 181 Local Government Act 2002 / section 459 Local Government Act 1974 (as applicable). You are also agreeing to allow the council to act as your agent for the building consent required for plumbing and drainage work pursuant to the Building Act 2004.
What do I need to do?
Please read the details below and then sign the entry agreement and return it in the postage-paid envelope provided or return it to your nearest FNDC service centre.
Who should sign?
The signatures we need for consent (depending on your particular property ownership circumstances) are:
Joint or sole ownership: Signature(s) of the sole owner or all of the joint owners.
Trust: Signature(s) of all trustees or a managing trustee who is authorised by the trust deed to consent on behalf of the trust. Included with the agreement should be a copy of the last AGM minutes to prove that that person is able to sign on behalf of the trust.
Body corporate: Signature of the manager of the body corporate following his/her consultation with members.
Sale and purchase of property
If your property is currently the subject of a sale and purchase agreement, we may need to consult further with the new owners. Please cross out the following statement so that we can ensure consultation is carried out accordingly:

… give consent for the Far North District Council to act as my/our agent for any building consent required for the sewerage construction,and plumbing and drainagework described below(building consent fees will be met by the Council);
… and give consent for contractors and employees of the Far North District Council to enter my/our propertyfor the purpose of sewerage construction as follows:
- The construction on my/our property of a public sewer system comprising a purpose-built domestic pumpingstation and apipeline from the pumping station to the main sewer reticulation located in the road reserve;
- The installation and connection of a private sewer linking thehouseto the public sewer system, including the installation of an electricity supply from the house to the pumping station;
… in accordance with the following conditions:
- The work will be done in accordance with the building consent and regulations, and discussed and agreed with the property owner(s) prior to construction;
- Access to the household electricity supply is hereby granted to enable the pumping station to be connected to the supply;
- The property will be fully reinstated upon completion of the works. Any debris left on-site shall be removed by the contractors, leaving the area clean and tidy;
- The Far North District Council will take responsibility for 100% of the construction cost of the public sewer system, 43% of the construction cost of the private sewer, and 43% of the cost of installation of the electricity supply from the house to the pumping station. The property owner(s) will contribute 57% of the construction cost (including GST) of the private sewer, and will contribute 57% of the cost of installation of the electricity supply from the house to the pumping station;
- All on-going operation and maintenance costs (excluding electricity) for the pumping station and the pipeline from the pumping station to the main sewer reticulation will be the Far North District Council’s responsibility;
- All on-going maintenance costs for the private sewer and the electricity supply to the pumping station, and the on-going costs of the electricity itself, shall be the property owner(s) responsibility;
- The property owner(s) acknowledge that the Far North District Council will have the on-going right to enter the land, after giving reasonable notice to the owner(s) and occupier (if any), in order to inspect, repair, or renew the public sewer system;
- Upon the connection of the property to the public sewer the owner(s) agree to pay the sewerage targeted rates as published in the Far North District Council's annual plans.
- This agreement will be binding on any subsequent owners of the property, and can be disclosed to any person seeking information from the Council.

- I/we will maintain my/our own on-site disposal system for the wastewater produced on my/our propertyin accordance with the Far North District Council's General Bylaws;
- I/we understand that my/our property is considered to be in the Area of Benefit and upon the commissioning of the Kerikeri sewerage system, I/we will be required to pay the annual Capital charge (as published in the Far North District Council's annual plans) applicable to unconnected properties in that area;
- I/we understand that if I/we choose to connect our property to the main sewer reticulation after the completion of the Kerikeri Wastewater Project,works provided for by I/we will be required to pay for 100% of the costs of the following: a) the construction of the public sewer system (i.e. a Council-approved purpose-built domestic pumping station and apipeline from the pumping station to the main sewer reticulation located in the road reserve), b) the installation and connection of a private sewer linking the house to the public sewer system, c) a standard Council sewerage connection fee, and d) the installation of an electricity supply from the house to the pumping station.
