A RESOLUTION AUTHORIZING THE MAYOR TO RETAIN CHAGRIN VALLEY ENGINEERING, LTD., TO PROVIDE PROFESSIONAL ENGINEERING SERVICES IN CONNECTION WITH THE RE-DESIGN OF THEPHASE 5 SANITARYSEWER PROJECT, AT A COST NOT TO EXCEED SIXTY-FIVE THOUSAND DOLLARS, CONTINGENT UPON BOND COUNSEL APPROVAL, APPROPRIATING FUNDS THEREFOR, REPEALING ALL PRIOR LEGISLATION INCONSISTENT HEREWITH, AND DECLARING AN EMERGENCY
WHEREAS, the Phase 5 Sewer Project requires modifications and significant re-design of the Project, preparation of specifications and new bid packages; and
WHEREAS, Chagrin Valley Engineering, LTD has the professional capabilities of providing the necessary re-design and bidding services in a timely and professional manner and is capable of providing the same at a cost not to exceed Sixty-Five Thousand Dollars ($65,000.00); and
WHEREAS, this Council determines to retain Chagrin Valley Engineering, LTD to perform such services. Now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF OLMSTED FALLS, CUYAHOGA COUNTY, STATE OF OHIO, THAT:
SECTION 1. It is hereby declared that the re-design and construction of the Phase 5 Sanitary Sewer Project is a necessary and proper public improvement in that said Project will extend sanitary sewer service to unsewered areas of the City.
SECTION 2. This Council hereby authorizes the Mayor to retain Chagrin Valley Engineering, LTD, to re-design said Project and prepare specifications for same at a cost not to exceed Sixty-Five Thousand Dollars ($65,000.00), contingent upon bond counsel approval.
SECTION 3. That the Interim Director of Finance is authorized to pay out such sum(s) for said services upon approval by Council and the funds therefor are hereby appropriated for the same from the capital projects fund.
SECTION 4. That all prior legislation inconsistent herewith is hereby repealed.
SECTION 5. This Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
SECTION 6. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of OlmstedFalls because the Project will extend sanitary sewer service to unsewered areas of the City. It shall therefore take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
