AFFIDAVIT OF GRATUITOUS KEEP

Pennsylvania School Code, Section 1302, states as follows: “A child shall be considered a resident of the school district in which has parents or the guardian of his person resides… When a resident of any school district keeps in his home a child of school age, not his own, supporting the child gratis as if the child were his own, such child shall be entitled to all free school privileges accorded to resident school children of the district, including the right to attend the public high school maintained in such district or in other districts in the same manner as though such child were in fact a resident school child of the district, and shall be subject to all the requirements placed upon resident school children of the district.”

“Before accepting such child as a pupil, the board of school directors of the district may require such resident to file with the secretary of the board a sworn statement that he is a resident of the district, that he is supporting the child gratis, that he will assume all personal obligations for the child relative to school requirements, and that he intends to so keep and support the child continuously and not merely through the school term.”

AFFIDAVIT OF CUSTODY AND GRATUITOUS KEEP

When an adult resident of the district keeps in his/her home a child of school age; not his/her own and not so awarded by the court; such resident must submit an affidavit of gratuitous keep to the district prior to the child’s enrollment in school.

Such affidavit shall require a sworn statement by the resident that he/she is supporting the child gratis, that he/she will assume all personal obligations for the child relation to school requirements and that he/she intends to so keep and support the child continuously and not merely through the school term.

It is the intent of this policy to provide for serious and unusual circumstances; not as a convenience, nor to allow otherwise improper enrollments, nor to avoid the proper payment of tuition.

ELIGIBILITY OF NONRESIDENT STUDENTS

POLICY NO 202

Purpose

The Board shall operate the schools of this district for the benefit of children residents in this district and eligible for attendance.

The Board may permit the admission of nonresident students in accordance with the terms of this policy.

The Board reserves the right to verify the residency of any students and to require a sworn statement of residential support for the student who resided with a person other than his/her parent, guardian or custodian.

Authority

Nonresident Children Placed in the District

Any child placed in the home of a resident of this district by a court or an agency of government shall be admitted to the schools and shall receive the same benefits and be subject to the same duties as resident children; provided that the Board reserves the right prior to such placement and within four weeks of the written request of the potential custodian of the child to the Superintendent, to deny the child’s admission when conditions exist which should exempt this district from the responsibility of admitting the nonresident custodial child.

Inmates of Institutions

A child who is an inmate of an institution for the care or training of children located within this district shall be admitted to the schools of this district.

Former Residents

Students whose parents move from the district after the beginning of the fourth grading period may remain as a student, tuition free, for the remainder of that school year only if such a request is made in writing by their parents or legal guardians to the Superintendent. Parents must provide transportation.

Other Nonresident Students

An exchange student who is part of an approved exchange program and whose admittance has been preapproved by the district may attend under the auspices and guidelines of the Exchange Program.

If a child is placed in the home of an adult relative who is a legal resident of the district, the child may attend school in the district if an only if the following conditions are met:

The adult relative assumes, free of charge, and without receipt of any payment therefore, full

responsibility for the child’s conduct, attendance, discipline and financial needs, as attested to in a

signed and notarized affidavit; and

The adult relative makes the request in writing to the Superintendent and secures his/her approval.

Delegation of Responsibility

The Superintendent shall develop procedures for the enrollment of nonresident children which:

admit such children only on the proper application of the parent or guardian;

do not exclude any child, otherwise eligible, on the basis of said child’s race, creed, color, religion,

natural origin or ancestry;

verify claims of residency;

deny admission where the educational facilities or program maintained for the children of this district is

inadequate to meet the needs of the applicant;

make continued enrollment of any nonresident students contingent upon maintaining good standards of

citizenship and discipline.

The Board shall not be responsible for the transportation to or from school of any student residence

outside district boundaries.
